City of Miami Resolution R-22-0462 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 12848 Final Action Date: 11/17/2022 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE AMENDMENT #1 TO THE LAW ENFORCEMENT MUTUAL AID AGREEMENT BETWEEN MIAMI-DADE COUNTY AND THE CITY OF MIAMI FOR VOLUNTARY COOPERATION AND OPERATIONAL ASSISTANCE, IN SUBSTANTIALLY THE ATTACHED FORM, PROVIDING FOR SPECIAL PROVISIONS FOR CONCURRENT JURISDICTION AND THE CREATION OF "JOINT ENFORCEMENT ZONES" AS SPECIFIED TO ALLOW FOR THE ENFORCEMENT OF QUALITY OF LIFE VIOLATIONS PURSUANT TO THE MUTUAL AID ACT, CHAPTER 23, PART 1, OF THE FLORIDA STATUTES. SPONSOR(S): Commissioner Manolo Reyes WHEREAS, it is the responsibility of the governments of the City of Miami (" Ctty") anq Miami -Dade County ("County") to ensure the public safety of their citizens by providir-0k adequate levels of police services to combat criminal activity; and Fri WHEREAS, other related and ancillary "quality of life" crimes expose the re§fefients,l;o visitors, and business owners of in our community of serious health and safety risks, and WHEREAS, the City and the County previously entered into a Law Enforcement MaUaI Aid Agreement between the County and the City for Voluntary Cooperation and Operationah Assistance ("Agreement"); and c WHEREAS, the City and the County have authority under the Florida Interlocal Cooperation Act of 1969, Section 163.01, Florida Statutes, to enter into interlocal agreements to jointly exercise any power, privilege, or authority which they share and which each might exercise separately; and WHEREAS, the City and the County have authority under the Mutual Aid Act, Chapter 23, Part 1, Florida Statutes, to enter into mutual aid agreements; and WHEREAS, it is in the best interests of the community to amend the existing Agreement to provide for the special provision of concurrent jurisdiction and the creation of "Joint Enforcement Zones" to combat quality of life violations ("Amendment #1 "); and WHEREAS, the provisions of Amendment #1 to the Agreement shall take effect upon execution and approval by the City and the County; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. The City Manager is authorized' to execute Amendment #1 to the Mutual Aid Agreement between the County and the City for Voluntary Cooperation and Operational Assistance, in substantially the attached form, providing for special provisions for concurrent jurisdiction and the creation of "Joint Enforcement Zones" as specified therein to allow for the enforcement of quality of life violations pursuant to the Mutual Aid Act, Chapter 23, Part 1, of the Florida Statutes. Section 3. This Resolution shall become effective immediately upon its adoption. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: 1 T e herein authorization is further subject to compliance with all requirements that may be imposed by e City Attorney including but not limited to those prescribed by applicable City Charter and City Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
