EASEMENTS AND UTILITY EASEMENTS, IN SUBSTANTIALLY THE ATTACHED
FORM, FROM THE PRIVATE PROPERTIES WHOSE STREET ADDRESSES ARE
LISTED ON "EXHIBIT A", ATTACHED AND INCORPORATED HEREIN;
ALLOWING THE CITY ACCESS AND USE OF THE PROPERTY FOR THE
CONSTRUCTION AND MAINTENANCE OF SOUTH GOLDEN PINES NO OUTLETS
AS PART OF OFFICE OF CAPITAL IMPROVEMENT PROJECT 40-B173613
Background of Item:
Perpetual sidewalk easements and utility easements are required from the private
property owners for the abutting properties having the street addresses listed on the
attached Exhibit A, allowing the City access and use of the property for the construction
and maintenance of Office of Capital Improvement Project 40-B173613.

A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO ACCEPT PERPETUAL SIDEWALK AND
UTILITY EASEMENTS, ALL IN FORMS ACCEPTABLE TO THE CITY ATTORNEY,
FROM THE OWNERS OF THE PRIVATE PROPERTIES DESCRIBED IN "EXHIBIT A",
ATTACHED AND INCORPORATED, FOR THE CONSTRUCTION AND
MAINTENANCE OF OFFICE OF CAPITAL IMPROVEMENTS PROJECT NUMBER 40-
B173613; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND
EXECUTE ALL OTHER NECESSARY DOCUMENTS, ALL IN FORMS ACCEPTABLE
TO THE CITY ATTORNEY, RELATED TO THE ACCEPTANCE OF SAID
EASEMENTS; FURTHER AUTHORIZING THE CITY MANAGER TO RECORD SAID
EASEMENTS IN THE PUBLIC RECORDS OF MIAMI-DADE COUNTY; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City of Miami's ("City") Office of Capital Improvements Project No. 40-
B173613, South Golden Pines No Outlet Streets Improvements ("Project"), includes total
reconstruction, ADA, major drainage, landscaping, and valley gutter improvements, and
acquisition of perpetual easements for widening; and
WHEREAS, as part of the project, the City requires perpetual sidewalk and utility
easements ("Easements") from the private property owners for the abutting properties having
the folios and street addresses listed on "Exhibit A" ("Properties"), attached and incorporated,
allowing the City access and use of the Easements for the construction and maintenance of the
Project;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized' to accept Easements, all in a form
acceptable to the City Attorney, from the owners of the Properties, for the construction and
maintenance of the Project and to ensure public ingress and egress.
Section 3. The City Manager is further authorized' to negotiate and execute any and all
other necessary documents related to the acceptance of said Easements, all in forms
acceptable to the City Attorney.
Section 4. The City Manager is further authorized' to record the Easements in the
Public Records of Miami -Dade County, Florida.
1 The herein authorization is further subject to compliance with all requirements that may be imposed by
the City Attorney, including but not limited to those prescribed by applicable City Charter and Code
provisions.
Section 5. This Resolution shall become effective immediately upon its adoption.
