WHEREAS, the City of Miami's ("City") Office of Capital Improvements Project No. 40- B173613, South Golden Pines No Outlet Streets Improvements ("Project"), includes total reconstruction, ADA, major drainage, landscaping, and valley gutter improvements, and acquisition of perpetual easements for widening; and WHEREAS, as part of the project, the City requires perpetual sidewalk and utility easements ("Easements") from the private property owners for the abutting properties having the folios and street addresses listed on "Exhibit A" ("Properties"), attached and incorporated, allowing the City access and use of the Easements for the construction and maintenance of the Project; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized' to accept Easements, all in a form acceptable to the City Attorney, from the owners of the Properties, for the construction and maintenance of the Project and to ensure public ingress and egress. Section 3. The City Manager is further authorized' to negotiate and execute any and all other necessary documents related to the acceptance of said Easements, all in forms acceptable to the City Attorney. Section 4. The City Manager is further authorized' to record the Easements in the Public Records of Miami -Dade County, Florida. 1 The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. Section 5. This Resolution shall become effective immediately upon its adoption. APPROVED AS TO FORM AND CORRECTNESS:
