I WANT TO ASK THE COMMISSIONERS TO
SAVE THE AMERICAN DREAM!!!
The City of Miami if over 125 years old and has buildings
which have been built pursuant to several building and
zoning codes, thought that long period of time on which
even the building, zoning codes and setback variance
protocols followed by current City officials are not very
clear.
Owning a home has long been consider the ultimate
aspiration and the American Dream but the cruel reality is
that many properties disconnect between the perfect home
terrorizing their owners and the burdens it brings visiting
the City of Miami to obtain any building pen -nits for
properties with additions or remodeling work done prior
to 2002.
Behind the optimist idea of remodeling your home, to
make it look nicer, to benefit the City by bringing value to
it, many homeowners like me can find themself trapped in
the never ending dark circle permit process forever.
City of Miami had many different zoning ordinances that
goes back to the 1915 where the master plan was
proposed, to the 1922 where the master plan for the
support and in 1934 the City of Miami adopted the first
zooning ordinance. In year 1960 the City created a
comprehensive zoning ordinance which at this time
ordinance had no regulation for setbacks. In 1982 the
City adopted the zoning ordinance 9500 which had
several addendums and revisions done as the language
a 5-n- 5,b-yul4A-1 p/ ci -r-Q„cary.uNi
and regulations were still not clear. Then the 11000
zoning ordinance was adopted in the 1990 followed by
our Miami 21.
Many of the buildings prior to the Miami 21 and prior to C�
2002 does not meet the required zoning setback of 5 feet n
on each side and 20 feet in the front and 20 feet in the g
back.
In addition, many of these old properties had 2nd layer
garages converted into living areas. The T3 zoning code
allows properties to have ancillary units; however, the
Miami 21 requires a parking space in the second layer of
the property. This requirement takes away the possibility
of adding the use for an ancillary unit to already built
properties that were existing with no 2"d layer parking
prior to the Miami 21. I'in asking the commission to
allow the use of ancillary units to grandfather properties
that do not have the 2"d layer parking prior to the Miami
21 building code or at least prior to 2002.
The severity of the Miami 21 Code represents a death
penalty for many properties including mine which at this
time it is stock in zoning department and has no legal way
to be legalized. The legalization path of additions,
structures and constructions of buildings that were
constructed without the proper building permits but that
follow the South Florida Building Code is nearly
impossible.
We all agreed that illegal construction is a plague, a
disease that affects communities across the City of
Miami. Many properties owners fear ending up having to
demolish their property because the City and it's permits
history lacks proper backup information to justify current
building.
In addition owners are not only scared but tired of been
scammed by permit runners and contractors who promise
compliance and who then despair with their pockets full
of money with no legal repercussions corning back over
and over client after client.

Homeowners are lastly very tired of buying a property
thinking that because the title company did a title search
and there are no liens recorded that everything will be
good. New homeowners should not be responsible
illegalities that were done from prior owners. There
should be consequences for the person that is doing the
wrong and not for the new property owner.
I also want to address that the City of Miami is aware
that current microfilm system is not accurate as for
example I was asked to change my plans many times
because several parts of my house were not shown in
microfilms and which records were found upon providing
the permit number found in property appraiser. The
response from the City of Miami was that the missing file
was not stored in the current city repository Iasefiche.
The City of Miami has also advise to me that going
thought each permit from 1982-1983 which is where my
other permit is lost requires many personal and probably
months just to check 1 year. The City knowing that
current microfilms was not 100% accurate, should be
ordering a revision of every single microfilm records in
the City as the lack of accuracy can harm many
ubmittedinto the public

Year 2020 was a very hard year, I as a homeowner lost
my General Contractor to Covid and had to star all over, I
had to pay again for the services I was already paid. I'm
asking the City to think if a reduce permit fee it's possible
to homeowners like me that because of the pandemic
were monetary affected.
was advised that the City of Miami Commissioners
passed an ordinance to protect homestead properties for
demolition and I'm very thankful for this. However,
currently the Miami 21 does not allow me to legalize by
house. The code relief with a 25% variance does not help
me or many other properties like the ones I will be
listing. I went out last weekend with my dad to obtain
sufficient proof for the commission that 5 feet setback
requirement as not met for many grandfather properties.

In addition to these images, i made a list of more than 25
properties per district that in a 2 mile radius that have
less than 5 feet setbacks. I meet with the building
director Mr. Ace Marrero and Zoning director Mr. Daniel
Goldberg who during the meeting questioned if these
properties had maybe additions without permits as they
stated that the city zoning code always required and
enforced the 5 feet setback.
In the list of properties that i created to stablish a
precedent and to prove that the city must have had a no
set back requirement back in the days as the setbacks of
these properties goes from 0 feet to 3.5 feet. This list
also shows that in district 1 properties 6, 15, 16, 17, 21 in
the list for district 3 properties 1, 4, 5 6, 16, 17, 18, 19,
20, 21, 22, 23, 24, 25, 26.
In the list for district 4 properties 26, 28, 30. In the list for
district 5 properties 3, 4, 5, 6, 9, 11, 15, 16, 17, 19, 20, 23,
24. There has not been any changes to the living area as
shown in the property appraiser database meaning that
these properties have the same layout and square
footage as the day they were built.
During my last meeting with the zoning director and Mrs.
Ana medina the building director assistant I was advised
that the team composed by the city attorney Rachel
Dooley, the district commissioner staff Mr. Alex Diaz the
la Portilla, the zoning director Mr. Daniel Goldberg and
the building director Mr. Ace Marrero had life safety
concerns in allowing more than 25 percent variance. I
discussed during meeting that the south Florida building
code permits wall in the same line of the property and
how asked what evidence the City of Miami have to say
that the South Florida Building Code setback requirement
is a life safety matter.
Since the city was unable to take a step forward to
change the setback requirement because of a fire safety
concern, i visited the fire department and talked to Mr.
Rodriguez and Mr. Dominguez and a few other fire
inspectors in the department. I was advised that they do
not oversees single family homes or duplexes that they
only do multifamily homes, businesses, etc. In addition,
they go by state requirements and no by the Miami 21
and there is no indications that Tess than 5 feet setbacks
it`a fire hazard.
Finally, I was advised by the City management that there
were no properties with less than 5 feet setbacks with
property existing permits. I asked the City to send
personnel to drive around the City to measure the
setbacks and to search on the microfilms. I provided to

them over 500 images of properties with Tess than 5 feet
setback within only a few blocks radius.
The Miami 21 should be amended to honor the setbacks
of grandfather properties that existed prior to the Miami
21 and even prior to the South Florida Building Code. In
addition, the Miami 21 should not restrict the right that
some zoning areas have to have an ancillary unit because
the lack of 2nd layer parking which is existing to the
Miami 21.
I wanted to meet with each of the commissioners, city
manager, City Mayor. Sent many emails, visited the City
hall many times but has been impossible.
Kindly, I'm asking for you to give some time in the
agenda to go over all this in detail.
