A RESOLUTION OF THE MIAMI CITY COMMISSION TRANSFERRING AND
APPROPRIATING NINE HUNDRED FIFTY THOUSAND DOLLARS
($950,000.00) IN TREE TRUST FUND ("TTF") FUNDS ("FUNDS")
PREVIOUSLY ALLOCATED TO THE BUILDING DEPARTMENT TO THE
BAYFRONT PARK MANAGEMENT TRUST FOR ALLOWABLE TTF
EXPENDITURES AT BAYFRONT PARK AND MAURICE FERRE PARK;
RATIFYING, APPROVING, AND CONFIRMING CERTAIN NECESSARY
ACTIONS BY THE CITY MANAGER AND DESIGNATED CITY DEPARTMENTS
IN ORDER TO UPDATE AND AMEND THE CAPITAL PLAN, THE CITY'S
ADOPTED OPERATING BUDGET, RELEVANT FINANCIAL CONTROLS AND
COMPUTER SYSTEMS IN CONNECTION THEREWITH, FOR PROJECT
CLOSE-OUTS, AND FOR GRANTS AND OTHER FUNDING SOURCES IN
PROGRESS IN CONNECTION HEREWITH; PROVIDING FOR AN EFFECTIVE
DATE.

WHEREAS, except for such changes as set forth herein, all previous appropriations
remain authorized to continue as previously approved City of Miami ("City") capital projects
according to the fiscal year 2022-2023 Multi -Year Capital Plan adopted on September 10, 2022
pursuant to Resolution No. R-22-0321 ("Capital Plan"), as may be amended from time to time,
and the City's fiscal year 2022-2023 adopted operating budget, as adopted on September 22,
2022 pursuant to Resolution No. R-22-0371, as may be amended from time to time ("Adopted
Operating Budget"); and
WHEREAS, it is now necessary to transfer Tree Trust Funds ("TTF") funds in the total
amount of Nine Hundred Fifty Thousand Dollars ($950,000.00) ("Funds") previously allocated to
the Department of Building to Bayfront Park Management Trust ("Bayfront"); and
WHEREAS, pursuant to Sec 62-303 of the City of Miami Code of Ordinances ("City
Code") the Funds may only be used for tree replacement and restoration and enhancement of
tree canopy coverage and shrubs throughout the City and activities directly related to tree
replacement and shrubs and restoration and enhancement of tree canopy coverage and shrubs
throughout the City, including, but not limited to, survey work, site inventory and analysis,
landscape architectural design services, inspection services for new plantings, and other related
project expenses and incidentals; and
WHEREAS, the expenditure of the Funds by Bayfront is conditional and subject to
compliance with Article X of Chapter 62 of the City Code;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:

Section 1. The recitals and findings contained in the Preamble of this Resolution are
adopted by reference thereto and incorporated herein as if fully set forth in this Section.
Section 2. The City Commission hereby approves and authorizes' the transfer of the
Funds previously allocated to the Department of Building to Bayfront for allowable expenditures
at Bayfront Park and Maurice Ferre Park.
Section 3. The transfer may require certain necessary actions by the City Manager and
designated City officials and departments made in order to update the Capital Plan, Adopted
Operating Budget, relevant financial controls and computer systems in connection therewith, for
project close-outs, and for grants and other funding sources in progress in connection herewith
are ratified, approved, and confirmed.
Section 4. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.2

1 The herein authorization is further subject to compliance with all legal requirements that may be
imposed, including but not limited to, those prescribed by applicable City Charter and City Code
provisions.
2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
