(the "Applicant"), the contract purchaser of the property located at 1715 SW 37 Avenue (the "Property") in the City of Miami (the "City"). This letter serves as the Applicant's request for a Plat Exemption Determination confirming that the Property can be developed without replatting. Property Description. The Property is located at the southeast corner of the intersection of SW 17 Street and SW 37 Avenue in the City. The Miami -Dade County Property Appraiser identifies the Property with Folio No. 01-4109- 029-0720, and notes that the lot is approximately 37,794 square feet in size. See Exhibit A, Property Appraiser Summary Report. The Property is described as Lots 59 and 60 of the Davis Citrus Farm Plat recorded in the Public Records of Miami -Dade County at Plat Book 4, Page 66 (the "Plat"). See Exhibit B, Plat. The legal description of the property also includes a strip of land beginning at the southwest corner of Lot 60, south 18.42 feet, then east 173.84 feet, then north 18.15, and west 173.84 (the "18-foot Strip"), less an 8.5 feet by 15 feet portion dedicated to the City for public right of way. See Exhibit C, Survey prepared by Level -Tech Surveyors, LLC, dated April 27, 2021 and marked with the City's Base Building Lines on April 29, 2021. Alan Dodd, Director Department of Resilience and Public Works Page 2 of 4 The Future Land Use Map ("FLUM") of the City's Comprehensive Neighborhood Plan ("MCNP") designates the majority of the Property "Restricted Commercial," and a sliver of the south is designated "Single Family Residential." The Miami 21 Zoning Code ("Miami 21") Atlas designates the majority of the Property as within the T6-8-O Transect and a sliver of the south is within the T3-R Transect and the Coral Gate Neighborhood Conservation District, NCD-1. In 1959, the City's Planning and Zoning Board passed and adopted a variance to allow for the development of a mortuary building on the Property. See Exhibit D, Ordinance No. 6496. Review of the Property's microfilm records, on file with City Building Department, confirm that the Property was approved and developed with a mortuary building, including areas for a chapel, office, and morgue. See Exhibit E, Tax Card. Subdivision. As noted, the Property is two platted lots and the 18-foot Strip. Generally, the City Code of Ordinances (the "City Code") provides that no building, paving, remodeling or renovation permits shall be issued for any structure or other on -site improvements, on any land for which a plat has not been recorded in the public records of Miami -Dade County or on a lot of record that has been divided into separate parcels, except as provided in Chapter 55 of the City Code. There are two exceptions which may permit development on the Property without a plat or re -plat. Pursuant to Section 55-10(e) of the City Code, a building permit may be issued for construction of a building (other than a one -family detached dwelling and customary accessory building), structure or parking lot on a lot, or lots, of record that has been divided into separate parcels, if proof is submitted that the division was described by deed prior to September 25, 1946, or that said division was approved under zoning regulations in effect prior to June 27, 1983. In 1959, the Planning and Zoning Board approved development of the Property with a mortuary building. The detailed legal description of the Property was included in the list of surrounding land owners, and notes the same dimensions of the 18-foot Strip that exists today. See Figure 1, Exhibit D Excerpt below. Further, the Property was described on the City's Tax Card as it is described today, and notes the December 30, 1959 building permit approval. See Figure 2, Exhibit E Excerpts below. This serves as sufficient evidence that the Property division was approved under zoning regulations in effect prior to June 27, 1983, and therefore, does not require platting or re -platting to redevelop.
