AUTHORIZING THE TRANSFER OF COMMUNITY DEVELOPMENT BLOCK GRANT
CORONAVIRUS ("CDBG CV3") FUNDS IN THE AMOUNT OF $2,075,000.00 FROM
THE DEPARTMENT OF HOUSING AND COMMUNITY DEVELOPMENT("HCD")
SMALL BUSINESS EMERGENCY LOAN PROGRAM II, ALLOCATING SAID FUNDS
TO THE DEPARTMENT OF PARKS AND RECREATION FOR ELIGIBLE PARK
IMPROVEMENT ACTIVITIES AS SPECIFIED IN EXHIBIT "A"; FURTHER
AUTHORIZING THE CITY MANAGER TO EXECUTE ANY AND ALL NECESSARY
DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, TO
COMPLETE THE TRANSFER AND ALLOCATION OF FUNDS.
Background of Item:
Pursuant to Resolution No.21-0064, adopted on February 11, 2021, the Miami City
Commission approved the allocation of CDBG CV3 funds, in the total amount of
$4,771,821.00 which included an amount of $2,817,456.00 to the Small Business
Emergency Loan Program II.
Due to the rules and regulations governing the activities of CDBG CV program, made it
difficult to allocate the funds.
American Rescue Plan (ARP) funds with less regulatory restrictions was used to
provide assistance to businesses meeting the program parameters.
There was an unexpended portion of the funds that needs to be reallocated to the
Department of Parks and Recreation to be used for park improvements activities.
The City's Administration recommends the transfer of CDBG CV3 funds from the
Department of Housing and Community Development ("HCD") Small Business
Emergency Loan Program II, in the amount of $2,075,000.00 to the Department of
Parks and Recreation as specified in Exhibit "A" to support park improvements
activities.

A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE TRANSFER OF COMMUNITY DEVELOPMENT BLOCK GRANT
CORONAVIRUS ("CDBG-CV3") FUNDS IN THE AMOUNT OF $2,075,000.00 FROM
THE DEPARTMENT OF HOUSING AND COMMUNITY DEVELOPMENT'S SMALL
BUSINESS EMERGENCY LOAN PROGRAM II TO THE DEPARTMENT OF PARKS
AND RECREATION FOR ELIGIBLE PARK IMPROVEMENT ACTIVITIES AS
SPECIFIED IN EXHIBIT "A", ATTACHED AND INCORPORATED; FURTHER
AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL
NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY,
FOR SAID PURPOSE.
WHEREAS, pursuant to Resolution No. 21-0064, adopted on February 11, 2021, the
Miami City Commission approved the allocation of Community Development Block Grant
Coronavirus ("CDBG CV3") funds, in the total amount of $4,771,821.00, which included an
amount of $2,817,456.00 allocated to the Department of Housing and Community
Development's ("HCD") Small Business Emergency Loan Program II ("Program"); and
WHEREAS, the rules and regulations governing the activities of the CDBG CV3
program made it difficult to allocate the funds in a timely manner; and
WHEREAS, American Rescue Plan funds were ultimately used to provide assistance to
businesses meeting the Program's parameters; and
WHEREAS, the unexpended portion of the CDBG CV3 funds are being reallocated to
the Department of Parks and Recreation ("Parks Department") to be used for eligible park
improvement activities; and
WHEREAS, the City's Administration recommends the transfer of CDBG CV3 funds from
HCD's Program, in the amount of $2,075,000.00, to the Parks Department as specified in
Exhibit "A," attached and incorporated, to support park improvement activities;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The transfer of CDBG CV3 funds, from HCD's Program to the Parks
Department, as specified in Exhibit "A", attached and incorporated, to support park improvement
activities, is approved.
Section 3. The City Manager is authorized to negotiate and execute any and all
necessary documents, in a form acceptable to the City Attorney, for said purpose.
Section 4. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.2

1 The herein authorization is further subject to compliance with all legal requirements that may be
imposed, including but not limited to those prescribed by applicable City Charter and City Code
provisions.
2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
