A RESOLUTION OF THE MIAMI PLANNING, ZONING AND APPEALS BOARD
("PZAB"), RECOMMENDING APPROVAL OF AN ORDINANCE TO THE MIAMI CITY
COMMISSION AMENDING ARTICLE 4 "STANDARDS AND TABLES" OF
ORDINANCE NO. 13114 ("MIAMI 21 CODE"), AS AMENDED, MORE SPECIFICALLY
BY AMENDING ARTICLE 4, TABLE 12, TITLED "DESIGN REVIEW CRITERIA", TO
AMEND THE CRITERIA FOR THE REVIEW OF ENTITLEMENTS APPLIED FOR
UNDER THE MIAMI 21 CODE; CONTAINING A SEVERABILITY CLAUSE; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, on October 22, 2009, the City Commission adopted Ordinance No.
13114, the Zoning Ordinance of the City of Miami, known as the "Miami 21 Code"
("Miami 21 Code"); and
WHEREAS, Miami 21 Code, Article 4, Table 12 titled "Design Review Criteria"
provides design criteria for the review of entitlements applied for under the Miami 21
Code; and
WHEREAS, since the adoption of the Miami 21 Code, Article 4, Table 12 was
amended once on May 14, 2014, pursuant to Ordinance 13464 to reflect the intent of
updated Article 10 titled "Sign Regulations"; and
WHEREAS, it has been determined that amendments to Article 4, Table 12 are
required to more effectively capture the intent of the Miami 21 Code as provided in
Article 2, Section 2.1 titled "Purpose and Intent"; and
WHEREAS, the proposed amendments to Article 4, Table 12 would clarify and
update the design criteria in accordance with the evolving development direction,
Neighborhood context, and priorities of the City; and
WHEREAS, the proposed amendments to Article 4, Table 12 reflect the general
recommendations of the Miami 21 Task Force, who conducted an evaluation of the
Miami 21 Code pursuant to City Commission Directive R-19-0523; and
WHEREAS, the Planning, Zoning and Appeals Board ("PZAB") has considered
whether the proposed amendments will further the goals, objectives and policies of the
Miami Comprehensive Neighborhood Plan ("MCNP"), the Miami 21 Code, and other
City regulations; and

WHEREAS, PZAB has considered the need and justification for the proposed
amendments, including changed or changing conditions that make the passage of the
proposed amendments necessary; and
WHEREAS, PZAB finds that it is in the best interest of the City and its residents
to amend the Miami 21 Code for the purposes stated herein;
WHEREAS, PZAB has considered the Planning Director's recommendations and
conducted a public hearing on the proposed amendment; and
NOW, THEREFORE, BE IT RESOLVED BY THE MIAMI PLANNING, ZONING
AND APPEALS BOARD:
Section 1. The recitals and findings contained in the Preamble to this Resolution
are hereby adopted by reference thereto and incorporated herein as if fully set forth in
this Section.
Section 2. The Planning, Zoning and Appeals Board recommends to the City
Commission that Ordinance No. 13114, the Zoning Ordinance of the City of Miami,
Florida, as amended, ("Miami 21 Code") be amended by making modifications to Article
4, Table 12, entitled "DESIGN REVIEW CRITERIA" in the following particulars:[1]

• Design all walls as active Facades, with doors and windows; when not

and sky, and complement the Neighborhood context.
• Orient and articulate the Building mass and architectural elements to reflect the local
climate.
• Provide usable and inviting Open Space that allows for has visible and convenient
pedestrian access from the public sidewalk realm.
• Building sites should locate service elements, such as trash dumpsters, utility meters,
loading docks, backflow preventers, Siamese connections and electrical, plumbing,
mechanical and communications equipment away from a street front. All service

• Select high -quality, durable Building materials that respond to the urban context and
local climate.
• Incorporate architectural elements and Building materials at the ground level that
enhance the pedestrian experience through variation in scale, texture, and color.
• Incorporate Facade treatments such as changes in material and articulation to
accentuate primary Building entries, prominent architectural features, Art, and significant
locations within a Neighborhood.
• Articulate Building Facades at the street level to activate the public realm and enhance
pedestrian continuity, and at the upper levels to acknowledge long views of Buildings.
• Establish a pattern of windows and openings that are intrinsic to the Building design
and respectful of the Neighborhood context; when not possible due to site
circumstances, embellish walls with architectural design treatment and/or Art.
LANDSCAPE STANDARDS
• Preserve existing vegetation and/or geological Natural and Geologic (Features
whenever possible.
• Apply Florida Friendly Landscaping to conserve water, preserve Native plant species,
enhance the City's tree canopy, and promote best management practices.

• Use landscape material, such as plantings, trellises, pavers, screen walls, planters and

AMBIENT STANDARDS
• Provide on -site lighting appropriate to the Building, a landscape streetscape design,.
and Neighborhood character in a manner that coordinates with signage,. a street
lighting, and landscape.
• Orient outdoor lighting to minimize glare to the public realm and adjacent Abutting
roperties.
• Apply mitigation measures to Pprotect Abutting properties, Neighborhoods, and the

public realm residential areas from excessive noise, fumes, odors, commercial vehicle
intrusion, traffic conflicts and the light spillover effect of light.

Section 3. If any section, part of a section, paragraph, clause, phrase, or
word of this Resolution is declared invalid, the remaining provisions of this
Resolution should not be affected.
Section 4. This Resolution shall become effective immediately upon its
adoption.
