HomeMy WebLinkAboutPZAB (11710) ResolutionCity of Miami PZAB Resolution Enactment Number: PZAB-R-22-011 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File ID: 11710 Final Action Date: 4/6/2022 A RESOLUTION OF THE MIAMI PLANNING, ZONING AND APPEALS BOARD ("PZAB"), RECOMMENDING APPROVAL OF AN ORDINANCE TO THE MIAMI CITY COMMISSION AMENDING ARTICLE 4 "STANDARDS AND TABLES" OF ORDINANCE NO. 13114 ("MIAMI 21 CODE"), AS AMENDED, MORE SPECIFICALLY BY AMENDING ARTICLE 4, TABLE 12, TITLED "DESIGN REVIEW CRITERIA", TO AMEND THE CRITERIA FOR THE REVIEW OF ENTITLEMENTS APPLIED FOR UNDER THE MIAMI 21 CODE; CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on October 22, 2009, the City Commission adopted Ordinance No. 13114, the Zoning Ordinance of the City of Miami, known as the "Miami 21 Code" ("Miami 21 Code"); and WHEREAS, Miami 21 Code, Article 4, Table 12 titled "Design Review Criteria" provides design criteria for the review of entitlements applied for under the Miami 21 Code; and WHEREAS, since the adoption of the Miami 21 Code, Article 4, Table 12 was amended once on May 14, 2014, pursuant to Ordinance 13464 to reflect the intent of updated Article 10 titled "Sign Regulations"; and WHEREAS, it has been determined that amendments to Article 4, Table 12 are required to more effectively capture the intent of the Miami 21 Code as provided in Article 2, Section 2.1 titled "Purpose and Intent"; and WHEREAS, the proposed amendments to Article 4, Table 12 would clarify and update the design criteria in accordance with the evolving development direction, Neighborhood context, and priorities of the City; and WHEREAS, the proposed amendments to Article 4, Table 12 reflect the general recommendations of the Miami 21 Task Force, who conducted an evaluation of the Miami 21 Code pursuant to City Commission Directive R-19-0523; and WHEREAS, the Planning, Zoning and Appeals Board ("PZAB") has considered whether the proposed amendments will further the goals, objectives and policies of the Miami Comprehensive Neighborhood Plan ("MCNP"), the Miami 21 Code, and other City regulations; and City of Miami Page 1 of 5 File ID: 11710 (Revision:) Printed On: 4/11/2022 WHEREAS, PZAB has considered the need and justification for the proposed amendments, including changed or changing conditions that make the passage of the proposed amendments necessary; and WHEREAS, PZAB finds that it is in the best interest of the City and its residents to amend the Miami 21 Code for the purposes stated herein; WHEREAS, PZAB has considered the Planning Director's recommendations and conducted a public hearing on the proposed amendment; and NOW, THEREFORE, BE IT RESOLVED BY THE MIAMI PLANNING, ZONING AND APPEALS BOARD: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The Planning, Zoning and Appeals Board recommends to the City Commission that Ordinance No. 13114, the Zoning Ordinance of the City of Miami, Florida, as amended, ("Miami 21 Code") be amended by making modifications to Article 4, Table 12, entitled "DESIGN REVIEW CRITERIA" in the following particulars:[1] "MIAMI 21 CODE ARTICLE 4. STANDARDS AND TABLES * TABLE 12 DESIGN REVIEW CRITERIA * DESIGN REVIEW CRITERIA BUILDING DISPOSITION • Locate Buildings to Rrespond to the physical Lot and Neighborhood context taking into consideration 14Natural #Features, existing 4Urban (Form and Transect Zone intentionsreguirements. _ • For Buildings on Corner Lots, design Facades to acknowledge all Frontages. —_ • For modifications of nonconforming Structures. See also Article 7, Section 7.2 for specific rogulationc • Reinforce and enhance the Neighborhood pattern and scale of lots, blocks, and open QY rao • Reinforce and enhance pedestrian and vehicular connectivity between Neighborhood amenities including public open spaces, the waterfront, and community facilities. • Ensure development is contextually sensitive to historical and cultural assets that contribute to the Neighborhood character. • Locate Buildings to reinforce and enhance significant locations and conditions such as terminated vistas and view corridors that contribute to the Neighborhood character. Design Facades that respond primarily to human scale Promote pedestrian interaction • Design all walls as active Facades, with doors and windows; when not possible, embellish walls with architectural design treatment • Articulate the roof to define the top of the Building, create a transition between Building and sky, and complement the Neighborhood context. • Orient and articulate the Building mass and architectural elements to reflect the local climate. • Provide usable and inviting Open Space that allows for has visible and convenient pedestrian access from the public sidewalk realm. • Building sites should locate service elements, such as trash dumpsters, utility meters, loading docks, backflow preventers, Siamese connections and electrical, plumbing, mechanical and communications equipment away from a street front. City of Miami Page 3 of 5 File ID: 11710 (Revision:) Printed On: 4/11/2022 • Select high -quality, durable Building materials that respond to the urban context and local climate. • Incorporate architectural elements and Building materials at the ground level that enhance the pedestrian experience through variation in scale, texture, and color. • Incorporate Facade treatments such as changes in material and articulation to accentuate primary Building entries, prominent architectural features, Art, and significant locations within a Neighborhood. • Articulate Building Facades at the street level to activate the public realm and enhance pedestrian continuity, and at the upper levels to acknowledge long views of Buildings. • Establish a pattern of windows and openings that are intrinsic to the Building design and respectful of the Neighborhood context; when not possible due to site circumstances, embellish walls with architectural design treatment and/or Art. LANDSCAPE STANDARDS • Preserve existing vegetation and/or geological Natural and Geologic (Features whenever possible. • Apply Florida Friendly Landscaping to conserve water, preserve Native plant species, enhance the City's tree canopy, and promote best management practices. • Ucc Incorporate landscaping and hardscape tsthat enhance Building design, create inviting Open Spaces, and continuity of contribute to a high -quality, pedestrian -friendly Streetscape within the Neighborhood. • Use landscape material, such as plantings, trellises, pavers, screen walls, planters and similar f aturcs, to enhance building design and continuity of streetscape. • Use landscaping that screens undesirable elements, such as surface parking lots, a SIGN STANDARDS • Provide cignagoSigns appropriate for the scale and character of the Building, establishment, and immediate Neighborhood. • Signage shall be within calculated aggregate area appropriate for Transect Zone. • Signage shall be located below fifty (50) foot height limit along the Building Primary Frontage. • Number of Signs for an esta.l+shment shall not exceed the allowable amount per linear Frontage. • Monument Signs shall be located within the appropriate Setback and not to disrupt pedestrian activity. • Illumination and other lighting effects shall not create a nuisance to adjacent property or create a traffic hazard. • Design and integrate Signs that complement the Building architecture and Neighborhood character. _ • Place and design Signs so as not to create a nuisance to Abutting properties, disrupt pedestrian circulation, or cause a traffic hazard.
