HomeMy WebLinkAboutO-14110City of Miami Ordinance 14110 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 11824 Final Action Date: 10/13/2022 AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING ARTICLE 4 OF ORDINANCE NO. 13114, THE ZONING ORDINANCE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED ("MIAMI 21 CODE"), TITLED "STANDARDS AND TABLES", MORE SPECIFICALLY BY AMENDING ARTICLE 4, TABLE 12, TITLED "DESIGN REVIEW CRITERIA", TO AMEND THE CRITERIA FOR THE REVIEW OF ENTITLEMENTS APPLIED FOR UNDER THE MIAMI 21 CODE; CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on October 22, 2009, the City Commission adopted Ordinance No. 13114, the Zoning Ordinance of the City of Miami, Florida, as amended ("Miami 21 Code"); and WHEREAS, Article 4, Table 12 of the Miami 21 Code, titled "Design Review Criteria", provides design criteria for the review of entitlements applied for under the Miami 21 Code; and WHEREAS, Article 4, Table 12 of the Miami 21 Code was amended once on May 14, 2014, pursuant to Ordinance 13464, to reflect the intent of updated Article 10 of the Miami 21 Code, titled "Sign Regulations"; and WHEREAS, it has been determined that amendments to Article 4, Table 12 of the Miami 21 Code are required to more effectively capture the intent of Article 2, Section 2.1 of the Miami 21 Code, titled "Purpose and Intent"; and WHEREAS, the proposed amendments to Article 4, Table 12 of the Miami 21 Code would clarify and update the design criteria in accordance with the evolving development direction, Neighborhood context, and priorities of the City of Miami ("City"); and WHEREAS, the proposed amendments to Article 4, Table 12 of the Miami 21 Code reflect the general recommendations of the Miami 21 Task Force, which conducted an evaluation of the Miami 21 Code pursuant to Resolution No. R-19-0523, adopted on December 12, 2019; and WHEREAS, the Planning, Zoning and Appeals Board ("PZAB"), at its meeting on April 6, 2022, following an advertised public hearing, adopted Resolution No. PZAB-R-22-011 by a vote of eight to zero (8 -0), Item No. PZAB.2, recommending approval, as amended, of the Zoning Text Change; and WHEREAS, the City Commission has considered whether the proposed amendments will further the goals, objectives and policies of the Miami Comprehensive Neighborhood Plan ("MCNP"), the Miami 21 Code, and other City regulations; and City of Miami Page 1 of 5 File ID: 11824 (Revision:) Printed On: 6/23/2025 File ID: 11824 Enactment Number: 14110 WHEREAS, the City Commission has considered the need and justification for the proposed amendments, including changed or changing conditions that make the passage of the proposed amendments necessary; and WHEREAS, the City Commission finds that it is in the best interest of the City and its residents to amend the Miami 21 Code for the purposes stated herein; and WHEREAS, the City Commission has considered the Planning Director's recommendations and conducted a public hearing on the proposed amendment; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by reference and incorporated herein as if fully set forth in this Section. Section 2. Article 4, Table 12 of the Miami 21 Code is hereby amended in the following particulars:' "MIAMI 21 CODE ARTICLE 4. STANDARDS AND TABLES TABLE 12 DESIGN REVIEW CRITERIA DESIGN REVIEW CRITERIA BUILDING DISPOSITION • Locate Buildings to Rrespond to the physical Lot and Neighborhood context taking into consideration RNatural Weatures, existing uUrban Worm and Transect Zone intentionsrequirements. • For Buildings on Corner Lots, design Facades to acknowledge all Frontages. - For modifications of nonconforming Structures. See also Article 7, Section 7.2 for - Create transitions in Height and macs with Abutting properties and Transect Zones. • Reinforce and enhance the Neighborhood pattern and scale of lots, blocks, and open spaces. • Reinforce and enhance pedestrian and vehicular connectivity between Neighborhood amenities including public open spaces, the waterfront, and community facilities. • Ensure development is contextually sensitive to historical and cultural assets that contribute to the Neighborhood character. • Locate Buildings to reinforce and enhance significant locations and conditions such as terminated vistas and view corridors that contribute to the Neighborhood character. Design Fanades that respond primarily to hi iman scale • Promote pedestrian interaction. • Design all walls as active Facades, with doors and windows; when not possible, embellish walls with architectural design troatment • Articulate the roof to define the top of the Building, create a transition between Building and sky, and complement the Neighborhood context. • Orient and articulate the Building mass and architectural elements to reflect the local climate. _ • Provide usable and inviting Open Space that allows for has visible and convenient access from the sidewalk realm. pedestrian public • Building sites should locate service elements, such as trash dumpsters, utility meters, loading docks, backflow siamese connections and electrical, preventers, plumbing, mechanical and communications equipment away from a street front. Enactment Number: 14110 • Incorporate architectural elements and Building materials at the ground level that enhance the pedestrian experience through variation in scale, texture, and color. • Incorporate Facade treatments such as changes in material and articulation to accentuate primary Building entries, prominent architectural features, Art, and significant locations within a Neighborhood. • Articulate Building Facades at the street level to activate the public realm and enhance pedestrian continuity, and at the upper levels to acknowledge Tong views of Buildings. • Establish a pattern of windows and openings that are intrinsic to the Building design and respectful of the Neighborhood context; when not possible due to site circumstances, embellish walls with architectural design treatment and/or Art. If any section, part of a section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance should not be affected. Section 4. It is the intention of the City Commission that the provisions of this Ordinance shall become and be made a part of the Miami 21 Code, which provisions may be renumbered or relettered and that the word "Ordinance" may be changed to "Section," "Article," or other appropriate word to accomplish such intention. Section 5. This Ordinance shall become effective ten (10) days after final reading and adoption thereof.2 APPROVED AS TO FORM AND CORRECTNESS: 2 This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten (10) days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become effective immediately upon override of the veto by the City Commission or upon the effective date stated herein, whichever is later.
