HomeMy WebLinkAboutBack-Up DocumentsCITY OF MIAMI, FLORIDA INTER -OFFICE MEMORANDUM TO: Arthur Noriega V DATE: September 13, 2022 City Manager FROM: Jacqueline Lorenzo, interim Director Department of Real Estate & Asset Management ("DREAM") SUBJECT: 1501 SW 9 ST - Surface Parking behind Tower Theater in District 3 REFERENCES: N/A ENCLOSURES: N/A The Bay of Pigs Veterans Association, 2506 Brigade, Inc., a Florida Not for Profit Corporation, ("Brigade") operates a museum and library to preserve its historic character and support the Brigade's mission to protect its legacy and the accurate dissemination of historic information to visitors, locals, and tourists alike. In furtherance of supporting and preserving the Brigade's mission, the City of Miami ('City") and Brigade desire to enter into a Purchase and Sale Agreement or a Lease Agreement ("Agreement") for the Brigade's use of the City -owned property located at 1501 SW 9 ST, Miami, Florida, adjacent to the Tower Theater, to pursue and defend the fundamental values of democracy, justice, individual liberties and respect for human rights. The Agreement of a City -owned property is exempt from competitive bidding requirements when conveying property to implement housing programs or projects which are intended to benefit persons or households with low and/or moderate income pursuant to Section 29-B(a), and when conveying property to implement projects of any governmental agency or instrumentality under Section 29-B(c). Please confirm you recommendation that competitive negotiation methods and procedures are not practicable or advantageous to the City pursuant to Section 18-86(a)(3)(c) of the Code of the City of Miami, Florida, as amended due to the unique services and expertise provided by the Brigade which may be provided in connection with their use of the parking area behind the Tower Theater pursuant to the terms and conditions of the Agreement. In light of the above, this memorandum serves to confirm your finding and recommendation to the City Commission that it is in the best interest to consummate the Agreement.
