Agenda item CA.10 is a resolution of the Miami City Commission officially acknowledging the City Clerk's Certification and Declaration of Results for the City of Miami's special election held on August 23, 2022. At the time the agenda went to print, the Office of the City Clerk had not yet received all the information from the 'Miami -Dade Elections Department necessary to complete the Exhibit for item CA.10. With this in mind, a placeholder Exhibit was included with the resolution that went to print with the agenda. Enclosed with this memo is the finalized Exhibit pertaining to item CA.10. This document will be submitted into the record as a substitution during the September 8, 2022 City Commission Meeting. C: Arthur Noriega, V, City Manager Victoria Mendez, City Attorney John Greco, Deputy City Attorney George Wysong, Assistant City Attorney Miriam Santana, Agenda Coordinator 12408 Substitution Memo from City Clerk CERTIFICATION AND DECLARATION OF RESULTS FOR THE CITY OF MIAMI SPECIAL ELECTION HELD ON AUGUST 23, 2022 STATE OF FLORIDA ) MIAMI-DADE COUNTY ) CITY OF MIAMI ) I, Todd B. Hannon, City Clerk of the City of Miami, Florida, do hereby certify that all necessary legal steps were taken in connection with the conduct of the City of Miami Special Election held on August 23, 2022, including, though not limited to, the following: I. Tuesday, August 2, 2022: A. Commencing at approximately 10:00 a.m., the the Canvasing Board met to vote on preliminary Canvassing Board duties and procedures for the August 23, 2022 Primary Election and City of Miami Special Election. II. Wednesday, August 3, 2022: A. Commencing at approximately 10:00 a.m., the Miami -Dade County Supervisor of Elections (hereinafter referred to as "Supervisor of Elections") conducted a logic and accuracy test of the touch screen and optical scan voting systems to be used for vote -by -mail, early voting, precinct ballots, and the independent audit system for the August 23, 2022 Primary Election and City of Miami Special Election. III. Thursday, August 4, 2022 through Tuesday, August 30, 2022 (Except August 21, 22, and 23): A. The Supervisor of Elections allowed the public to inspect vote -by -mail ballots from 8:00 a.m. to 8:30 a.m., and; B. Allowed daily opportunity for candidates, political party officials, political committee officials, or authorized designee to inspect vote -by -mail ballot and ballot materials from 8:30 a.m. to 9:00 a.m. (only provided if a written request was received no later than 48 hours prior to the scheduled inspection). IV. Thursday, August 4, 2022 through Friday, August 26, 2022 (Except for August 21, 22, and 23): A. Commencing at approximately 9:30 a.m., the Canvasing Board met to commence various tasks that included the opening and processing of vote -by - mail ballots and the duplication of ballots (as needed). These tasks were Page 1 of 4 Cetification and Declaration of Results — August 23, 2022 Special Election continued on an as -needed basis until Friday, August 26, 2022, except for the August 21, 22, and 23, 2022. V. Tuesday, August 4, 2022 and other specified dates below: A. Commencing at approximately 10:00 a.m. on the following dates: • Thursday, August 4, 2022 • Tuesday, August 9, 2022 • Thursday, August 11, 2022 • Monday, August 15, 2022 • Wednesday, August 17, 2022 • Friday, August 19, 2022 • Monday, August 22, 2022 The Canvassing Board met to canvass presumed invalid vote -by -mail ballots and duplication of ballots (as needed). Pursuant to Section 101.68(4), Florida Statutes, voters whose vote -by -mail ballots were presumed to be invalid by the Canvassing Board have the right to present written evidence supporting their eligibility to vote to the Supervisor of Elections no later than 5:00 p.m. on the second day following the election. The deadline to provide said evidence was Thursday, August 25, 2022, by 5:00 p.m. VI. Sunday, August 21, 2022 and Monday, August 22, 2022: A. On Sunday, August 21, 2022 and Monday, August 22, 2022, the Supervisor of Elections allowed the public to inspect vote -by -mail ballots from 10:00 a.m. to 10:30 a.m., and allowed daily opportunity for candidates, political party officials, political committee officials, or authorized designee to inspect vote - by -mail ballot and ballot materials from 10:30 a.m. to 11:00 a.m. (only provided if a written request was received no later than 48 hours prior to the scheduled inspection). B. On Monday, August 22, 2022, the Canvassing Board met at approximately 11:00 a.m. to perform various tasks that included the opening and processing of vote -by -mail ballots and the duplication of ballots (as needed) VII. Tuesday, August 23, 2022: A. The Supervisor of Elections allowed the public to inspect vote -by -mail ballots from: • 10:00 a.m. to 10:30 a.m. • 2:00 p.m. to 2:30 p.m. • 8:00 p.m. to 8:30 p.m. B. Furthermore, the Supervisor of Elections allowed daily opportunity for candidates, political party officials, political committee officials, or authorized designee to inspect vote -by -mail ballot and ballot materials from: • 10:30 a.m. to 11:00 a.m. Page 2 of 4 Cetification and Declaration of Results — August 23, 2022 Special Election • 2:30 p.m. to 3:00 p.m. • 8:30 p.m. to 9:00 p.m. (Only provided if a written request was received no later than 48 hours prior to the scheduled inspection) C. Additionally, at approximately 10:00 a.m. the Canvassing Board met to perform tasks that included the opening and processing of vote -by -mail ballots and the duplication of ballots (as needed). D. At approximately 3:00 p.m. the Canvassing Board canvassed presumed invalid vote -by -mail ballots (as needed), and; E. At approximately 7:00 p.m., the tabulation of results was completed, and the Supervisor of Elections filed preliminary Election results with the Department of State. VIII. Thursday, August 25, 2022: A. On Thursday, August 25, 2022, the Canvassing Board met at approximately 5:00 p.m. to canvass vote -by -mail and provisional ballots. The tabulation of results was completed, and the Canvassing Board certified the UNOFFICIAL results, including vote -by -mail and provisional ballots. IX. Friday, August 26, 2022: A. The Supervisor of Elections provided the UNOFFICIAL results for the City of Miami Special Election. B. The Canvassing Board met at approximately 3:00 p.m. to certify the OFFICIAL results or preparation for any potential recount (if needed). C. Furthermore, the Canvassing Board randomly selected a race/question and voting precincts associated with the Primary and Special Elections for the post- election manual audit or automated independent audit. X. Monday, August 29, 2022: A. On Monday, August 29, 2022, the Supervisor of Elections provided two reports containing OFFICIAL election results specifically for the City of Miami Special Election held on August 23, 2022. The reports included results from individual precincts within the City of Miami and the cumulative total of the election results for the City of Miami Special Election. XI.
