HomeMy WebLinkAboutR-22-0326City of Miami Resolution R-22-0326 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 12339 Final Action Date: 9/13/2022 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO ACCEPT, BUDGET, ALLOCATE, AND APPROPRIATE TWO (2) COMMUNITY DEVELOPMENT BLOCK GRANT — MITIGATION ("CDBG - MIT") GRANT AWARDS FROM THE FLORIDA DEPARTMENT OF ECONOMIC OPPORTUNITY ("FDEO") REBUILD FLORIDA MITIGATION GENERAL INFRASTRUCTURE PROGRAM IN AN AMOUNT NOT TO EXCEED EIGHTEEN MILLION FOUR HUNDRED FORTY-SEVEN THOUSAND FOUR HUNDRED THIRTY-NINE DOLLARS ($18,447,439.00) AND AN AMOUNT NOT TO EXCEED NINETEEN MILLION EIGHT HUNDRED FIFTY-NINE THOUSAND NINE HUNDRED SEVENTY-SEVEN DOLLARS ($19,859,977.00) FOR A TOTAL AMOUNT NOT TO EXCEED THIRTY-EIGHT MILLION THREE HUNDRED SEVEN THOUSAND FOUR HUNDRED SIXTEEN DOLLARS ($38,307,416.00)("GRANT FUNDS") AS SPECIFIED IN EXHIBIT "A," ATTACHED AND INCORPORATED HEREIN FOR RESILIENCE ACTIVITIES ("PURPOSE"); ESTABLISHING A NEW CAPITAL FUND PROJECT AND APPROPRIATING THE GRANT FUNDS; AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL NECESSARY DOCUMENTS, INCLUDING BUT NOT LIMITED TO, AMENDMENTS, EXTENSIONS, RENEWALS, AND MODIFICATIONS, ALL IN FORMS ACCEPTABLE TO THE CITY ATTORNEY, FOR THE ACCEPTANCE OF THE GRANT FUNDS, ADMINISTRATION, IMPLEMENTATION AND COMPLIANCE OF ALL APPLICABLE LAWS, RULES, AND REGULATIONS, FOR SAID PURPOSE. WHEREAS, the City of Miami ("City") submitted grant applications and was awarded two Community Development Block Grant — Mitigation ("CDBG - MIT") Rebuild Florida Mitigation General Infrastructure Program Grant Awards from Florida Department of Economic Opportunity ("FDEO") in an amount not to exceed eighteen million four hundred forty seven thousand four hundred thirty-nine dollars ($18,447,439.00) and nineteen million eight hundred fifty-nine thousand nine hundred seventy-seven dollars ($19,859,977.) for a total amount not to exceed thirty-eight million three hundred seven thousand four hundred sixteen dollars ($38,307,416.00)("Grant Funds"); and WHEREAS, the CDBG — MIT Rebuild Florida Mitigation General Infrastructure Program helps prepare coastal as well as inland communities for the adverse impacts of flooding, sea - level rise, and storm surge; and WHEREAS, the City Administration recommends the acceptance, allocation, and appropriation of Grant Funds from CDBG — MIT Rebuild Florida Mitigation General Infrastructure Program specified in Exhibit "A," attached and incorporated; and City of Miami Page 1 of 2 File ID: 12339 (Revision:) Printed On: 6/20/2025 File ID: 12339 Enactment Number: R-22-0326 WHEREAS, the CDBG — MIT Rebuild Florida Mitigation General Infrastructure Program will fund improvements to the locations specified in Exhibit "A," attached and incorporated, to enhance their resilience to future natural disasters ("Purpose"); and WHEREAS, it is appropriate for the City to accept the Grant Funds, establish a Capital Fund Project, and authorize the City Manager to negotiate and execute any and all necessary documents, including but not limited to, amendments, extensions, renewals, and modifications, all in forms acceptable to the City Attorney, for the acceptance of the Grant Funds, administration, implementation, and compliance with all applicable laws, rules, and regulations, for said Purpose; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is hereby authorized1 to accept the Grant Funds to be utilized for the Purpose stated herein. Section 3. The new Capital Fund Project is established, and resources are appropriated as described in Exhibit "A," attached and incorporated herein. Section 4. The City Manager is authorized' to negotiate and execute any and all necessary documents, including but not limited to, amendments, extensions, renewals, and modifications, all in forms acceptable to the City Attorney, for the acceptance of the Grant Funds, administration, implementation, and compliance with all applicable laws, rules, and regulations, for said Purpose. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: sndez, City Attor ey 8/26/2022 1 The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. 2 If the mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted.
