Comments No. Department Agency Comments 1 Planning (City of Miami) CRC Meeting There are several design considerations because sight doesn't sit on right of way regarding parking, pedestrian circulation, procedural aspects, and arts in public places. Proposed Language is inconsistent with Article 11 (Miami21), Chapter 62 (Miami21), City AIPP Master Plan and Miami Dade County Code 2-11.15. Discussed with MDC Cultural Affairs. Minor Modification requires review and approval 2- 11.15(MDC). Looking to amend Art.11. Draft to be reviewed and approved by the County Provide Notice of Intent to County of said section. 2 Zoning (City of Miami) CRC Meeting Consistency with language in regulating the plans. Four minor comments pending to be addressed. 3 Building (City of Miami) CRC Meeting No Comment 4 City of Miami Attorney Office (CRC Meeting) Development Agreement has not been received, needed in advance of City commission. Impact to bicycle, vehicle, and pedestrian consideration. 6 Parks & Recreation (City of Miami) CRC Meeting No comment 7 Aviation (CRC Meeting) Issued their preliminary letter of determination with certain points they objected to that exceeded our height and zoning code, developer in the process of revising those, it appears from the site plan that was reviewed from the submittal. The points have been lowered, but they don't have coordinates, nor do they have specific heights that correspond to the coordinates. Asking for applicant to revisit their submittal to us and have them provide July 14, 2022 coordinates with clear distinct heights as to the heights they are seeking to those specific points. Concern regarding land use, not sure what the density and the type of development is there. It's impacted by the outer safety zone and their limitations, need additional information as to the type of use, density of development and occupancy to determine if it meets the outer safety zone or not. 8 Cultural Affairs MDC CRC MEETING We would like to consider Freedom Park at a similar scale as the Marlins Ballpark. Would like if the project to follow the code as its applied in Public private partnerships at the county is pursuing across the county. If project is a county project it would require complying as a whole on the one and a half percent. 9 MDX CRC Meeting No Comment 1 MDX (Traffic) Sub -Area Model Validation and Calibration are required — Due to the magnitude of development programmed, the potential impacts to the SR 836 network will be extensive. Please include at a minimum SR 836 mainline along with all the interchanges and ramps between NW 57th Avenue and NW 17th Avenue and SR 112 mainline from NW 42nd Avenue to 1-95. A map shall be provided to illustrate the extent of the traffic study area and the roadway network being evaluated. 2 MDX (Traffic) Future Traffic Conditions with Project — Please do not use Loan Depot Park as part of the modeling assumptions of other major sporting venues due to the limited attendance seen from the Loan Depot Park. 3 MDX(Traffic) Future Traffic Conditions with Project — Please do not use Loan Depot Park as part of the modeling assumptions of other major sporting venues due to the limited attendance seen from the Loan Depot Park. 4 MDX(Traffic) Background Traffic — Please explain the rationale and the need for this step when on Page 4 it is proposed to calculate the total traffic without the project for "Weekday", "Weekend" and "Peak Hour traffic". 5 MDX(Traffic) Peak Hour Project Traffic with Game — Due to the nature of the peaking characteristics from the MLS games during the evening games, applying the FDOT Standard K factors will result in much lower traffic than the actual traffic seen during the peak hour. Please use the data from Hard Rock Stadium or Atlanta United to identifying the typical K factors seen during the weekday and weekend project traffic with Game. July 14, 2022 6 MDX(Traffic) Intersection Turning Movement Counts — Please include the following intersections as part of the study area due to the magnitude of development programmed. The potential impacts to the SR 836 and SR 112 networks will be extensive. Please include at a minimum SR 836 interchanges between NW 57th Avenue and NW 17th Avenue and along SR 112 from NW 42nd Avenue (including the iron triangle area) to 1-95. o NW 57th Avenue/SR 836 o NW 42nd Avenue/SR 836 East — Signalized o NW 21st/SR 953 o NW 37th Avenue/SR 836 o NW 27th Avenue/SR 836 — DDI o NW 17th Avenue/SR 836—Signalized o Interchanges/ramp terminals along SR 112 from NW 42nd Avenue (including the iron triangle area) to 1-95 In addition, please change the #10 intersection in the list to Signalized. 7 MDX(Traffic) Ramp Roadway Volume Counts — Similar to the above comment, please include all the SR 836 ramps between NW 57th Avenue and NW 17th Avenue and SR 112 ramps between 42nd Avenue (including the iron triangle area) and 1-95 due to the substantial impacts to this limited access facility. 8 MDX(Traffic) Saturday Game Day Arrival and Departure Trip Generation — Please justify the rationale for 20% adjustments to account for other modes of transportation for all land uses as the transit availability is much less during the weekends compared to the weekdays. 9 MDX(Traffic) Saturday Game Day Arrival and Departure Trip Generation, Third Paragraph - Please justify the rationale for 20% adjustments to soccer village trips to account for interactions with stadium users and a 50% game day avoidance factor. For example, for the Soccer Village, using ITE PM peak hour trip rates would generate a net total of 820 trips (= 2,050*0.5*0.8) rather than the 664 trips. Please update and resubmit the methodology letter. 14 MDX(Traffic) VISSIM — Due to the magnitude of development programmed, the potential impacts to the SR 836 and SR 112 networks will be extensive. Please include at a minimum SR 836 interchanges between NW 57th Avenue and NW 17th Avenue and along SR 112 from NW 42nd Avenue (including the iron triangle area) to 1-95 as part of the VISSIM analysis. In addition, please propose the various measures of effectiveness (MOE's) that will be used as part of the analysis for the following: o SR 836 Mainline o SR 836 ramps o SR 836 ramp terminals o Interchanges/ramp terminals along SR 112 from NW 42nd Avenue (including the iron triangle area) to 1-95 15 MDX(Traffic) Traffic Calming Evaluation — Last sentence —The information regarding the 85th percentile speed is incomplete. Please update in the next submittal. 16 MDX(Traffic) Please ensure that any scenario with the proposed development incorporates simultaneous events with the Loan Depot Stadium. 17 MDX(Traffic) Please coordinate with the City of Miami and Miami -Dade County and include any projects that needs to be accommodated. On pages 12, 14 and 16, the project trip generation and the intersection analysis are from 6:30 to 7:30 PM (1 hr.). 23 MDX(Traffic) Analysis of Ramp Roadway Capacity, specify the Edition of the Highway Capacity Manual (HCM) that will be used. 24 MDX(Traffic) Include freeway analysis in the methodology. Freeway analysis should include mainline, ramp merge/diverge and weaving analyses for all scenarios. 25 MDX(Traffic) Potential safety/operations concern that traffic from the intersection of WB SR 836 off ramp and NW 14th Street may back up onto WB SR 836 mainline during game days. A trip generation should also be included for any other events (i.e., other soccer games, sports, concerts) that could occur during weekday off-peak and weekend afternoon time periods. This will be used to validate that the MLS games reflect the worst case scenario for trip generation. 30 MDX(Traffic) Appendix C_Daily Vehicle Trips for Stadium table shows that auto occupancy is based on "Marlins Data", clarify the source. 31 MDX(Traffic) o Traffic MOEs for SR 836, SR 112, arterials: V/C, speed, density, queue analysis, delays with and without, directional, for peak, off peak, opening (each phase of development) and design years. o Analysis and documentation of additional traffic volumes due to the new development (delta from no -build) for SR 836 and SR 112 mainline and ramps. Tabular and graphical documentation for opening, design years. Directional, peak, off peak, weekday, weekends. 32 MDX(Traffic) An existing condition analysis for SR 836, SR 112 and their access roads is required to set the base line to quantify the current operation conditions, traffic impacts, identifying mitigation solutions and measuring their effectiveness. 33 MDX(Traffic) The central criteria for accepting any proposed changes on the existing highway network is that traffic impacts must be mitigated to not degrade the system's operation. 34 MDX(Traffic) Major improvements as potential mitigation measures should be evaluated and included in the traffic report. 35 MDX(Traffic) The use of "temporary street modifications and police control" shall be a last resort after implementing all the necessary capacity and operation mitigating improvements to address the additional traffic generated by the new development. 1 MDC Traffic Engineering Include the following intersections as part of the Data Collection and Intersection Analysis: • NW 28 Street and NW S. Flagler Street and NW 27 Avenue 2 MDC Traffic Engineering Please ensure that the traffic study includes proper coordination for the proposed traffic signal on NW 14 Street mid -way between NW 42 Avenue and the WB SR 836 off -ramp wth adjacent traffic signals to the east and west. 3 MDCTraffic Engineering Please include all committed developments until the buildout year (Year 2033) instead of only improvements identified up to Year 2024. Also, please ensure to add Palmer Lake Hotel. 4 MDCTraffic Engineering Please be specific on the internalization rates being used as the Tables provided on the methodology does not clearly show the reductions for the peak periods. 5 MDC Traffic Engineering Please note that the 20% reduction for Other Modes of Transportation for the Retail and Office Land Uses must be revised given that Census data is only accepted for land uses related to residential/hotel. 6 MDC Traffic Engineering Traffic study must include a circulation plan for game days and non game days to understand which driveways will be opened and the movements allowed on each of the driveways. 7 MDCTraffic Engineering The traffic study must ensure that all existing entrances to the Airport are not affected by the additional trips generated by the proposed project. 1 Aviation Aviation Planning evaluated the revised survey of the proposed Freedom Park Stadium dated April 13, 2022, and the thirty-three (33) points at specific GPS locations with elevations ranging from 105 to 112 feet AMSL, our preliminary zoning analysis found that that the 33 points at the referenced locations and elevations conformed to the requirements of Code of Miami -Dade County, Chapter 33, Article XXXVII Airport Zoning, Sec. 33-333 (B) Height/Airspace Regulations. 2 Aviation Please note that MFP LLC is still required to re -submit to the Aviation Department, an application for an MDAD- issued "Airspace and Land -Use Letter of Determination" once the design of the stadium progresses or is finalized. The application should be submitted as a package which includes the site and architectural elevation plans for the proposed stadium as well as its ancillary mixed -use development. Similarly, other development July 14, 2022 contemplated under the Miami Freedom Park, such as parking garages, office buildings, hotels, etc., will be required to file with the Aviation Department for their own Airspace and Land -Use Determination letters. MDAD (MAAC) COMMENTS OPERATING CONCERNS 1 AVIATION Miami ATC often uses a vector from the runway to avoid thunderstorm cells on departure. After one year of debate and troubleshooting, the stadium finally agreed to purchase a secondary radar for LAX airport. 24 AVIATION LAS- The new Las Vegas Raiders football stadium in downtown Las Vegas presents a significant impact to vehicular access to McCarran Airport LAS. The Raiders and LAS have not yet reached an agreeable solution for this problem. 25 AVIATION PHX- FAA discovered they did not have the authority to prevent Arizona State University from detonating fireworks during football games at Sun Devil Stadium. PHX TRACON facility was forced to shut down landing access to the south runway complex at PHX due to firework usage. 26 AVIATION SJC- San Francisco 49ers stadium in Santa Clara creates routine concerns for flight crews due to bright lights. July 14, 2022 July 5, 2022 Comments Concerning stadium event impacts 27 AVIATION An avigation easement. MOAD cannot be responsible for noise generated from frequent and direct overflights of commercial air traffic at very low altitudes. 28 AVIATION The entire stadium inclusive of all corridors, circulation and ancillary spaces must be outside of the Outer Safety Zone. 29 AVIATION The architect's plans must illustrate mitigation of any light emissions for the stadium, numerous practice fields, and video boards. 30 AVIATION The exterior of the stadium and roof are required to contain materials that are not reflective or can degrade the airport's surface radar signals and strength. 31 AVIATION Prohibition of drone, radio -controlled aircraft and balloons, restrictions on helicopter, blimps and banner towing aircraft, prohibition of fireworks, smoke machines and laser light shows. 32 AVIATION Prohibition of establishments or uses that emit smoke, gases or dust in quantities or densities sufficient to jeopardize the safe use of the airport. 33 AVIATION The stadium's electronic gear cannot interfere with radar, voice communications and other navigational aids to aircraft. 34 AVIATION Prohibition of any associated uses that attract or sustain birds and bird movements 35 AVIATION Provide traffic mitigation 36 AVIATION A comprehensive traffic study analyzing current traffic, anticipated traffic at the airport and, upon completion, anticipated traffic related to the proposed Freedom Park (See attached Exhibit 1: Traffic Report and Summary, Methodology and MDAD's Comments from Methodology Kick -Off Meeting 37 AVIATION A copy of an airspace analysis and any airspace related coordination between the FAA and MOAD (See attached Exhibit 2: MOAD-Issued Preliminary Airspace Land Use Letter of Determination, Drawing Comparing Points Studied by MOAD and FAA, MDAD' Objection Letter to FAA, MFP's Revised Survey, MOAD Analysis of Revised Elevations, Memo to MOAD Director 38 AVIATION Proposed structure plans and renderings for all facilities at Freedom Park with GPS coordinates and structure heights (See attached MFP's CRC Submittal 5-26-22 drawings specifically: A-16 - Height Limitations, A-61 & A-62- Stadium Elevations and July 14, 2022 A-73 - Parking Garage Elevations). The elevations and locations of the proposed commercial buildings were not included in the project book. Note, during the June 8, 2022 City of Miami virtual CRC Meeting, MOAD requested a revision of the stadium elevation plans to include GPS coordinates for the proposed elevations. 39 AVIATION The construction schedule and phasing for Freedom Park (See attached Exhibit 4: PPD- 2, Economic Impact Analysis) with details on how construction will be coordinated with MOAD and the airlines. According to the June 2020 Economic Impact Analysis (Exhibit PPD-2) the phases of the proposed development are estimated to occur over a 7- to 10- year development period (although the stadium is estimated to be completed within 36+ months from project commencement). The attorney for the developer provided the following tentative schedule for the City's Masterplan/SAP Approval: • City of Miami Staff Review pending - 2-4 months • Traffic Report re -submittals, coordination with City, County, State - 8-1 0 months • Coordinated Review Committee (CRC) - June 8, 2022 • City Public Hearings; Urban Design Review Board (UDRB), Planning Zoning Appeals Boards (PZAB), City Commission First Reading, State of Florida DEO Review, City Commission Second Reading, approximately 6-8 months (estimated dates if no deferrals by the Boards). • Special Area Plan Approval - estimated First Quarter of 2023 • FAA re -submittal of stadium points - after SAP Approval - within 2 weeks • MOAD re -submittal of complete package - upon receipt of FAA approval 40 AVIATION An expected usage analysis of Freedom Park, inclusive of expected games and events has not been provided. 41 AVIATION Confirmation that the construction will comply with the FAA's Advisory Circular 150-5300 13A, the One -Engine - Inoperable surface, and all Miami -Dade County Ordinances. Please see the attached MOAD-Issued Preliminary Airspace and Land Use Letter of Determination which states that the developer must comply with federal, state and local aviation regulations 42 AVIATION Benchmark analyses and impacts of other airports with nearby stadiums. (See MDAD's January 22, 2020 "DRAFT Airspace and Land Use Impacts from Proposed Miami July 14, 2022 Freedom Park Development" (Pages 18-24 ). These draft case studies were developed by MDAD's airspace consultant while preparing MDAD's report. 43 AVIATION Zoning Ordinances and maps (see attached). January 22, 2020 Preliminary Review 44 AVIATION The developer submits a fully developed site plan which depicts the stadium, numerous soccer practice fields and lighting, and ancillary mixed -use development. The stadium's corridors, circulation and ancillary spaces for the proposed stadium must be completely outside the OSZ. 45 AVIATION The developer reduces the height of the stadium so that it complies with Article XXXVII of Chapter 33 of the Code of Miami -Dade County Airport Zoning. 46 AVIATION The FAA issues "Detennination of No Hazard to Air Navigation" for the stadium. 47 AVIATION The project is required to comply with all applicable federal, state and local aviation regulations, including the Airport Zoning Code. 48 AVIATION 5. Can submit a supplement that has the top points (Example: in the site plan they submitted it talks about the height AMSL on the stadium sheets. It does not have the point grid which you usually require, which is what the surveyor does of the top points of the stadium). Happy to include it in the package (top points of the stadium which is more detailed). For the city submittal we put it flat, like the height as a holistic not the survey of the height.
