A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
DIRECTING THE CITY MANAGER TO CONTINUE THE PROCESS OF REVIEWING
THE UNSOLICITED PROPOSAL SUBMITTED BY N. R. INVESTMENTS, INC., A
FLORIDA PROFIT CORPORATION ("N. R. INVESTMENTS"), ATTACHED AND
INCORPORATED AS EXHIBIT "A" ("UNSOLICITED PROPOSAL"), FOR THE
REDEVELOPMENT OF THE CITY OF MIAMI ("CITY") DEPARTMENT OF GENERAL
SERVICES ADMINISTRATION ("GSA") PROPERTY LOCATED AT 1950
NORTHWEST 12 AVENUE, MIAMI, FLORIDA (FOLIO NO. 01-3135-001-0010) AND
1970 NORTHWEST 13AVENUE, MIAMI, FLORIDA (FOLIO NO. 01-3135-000-0163)
(COLLECTIVELY, THE "GSA SITE"), IN ACCORDANCE WITH SECTION 18-119 OF
THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED ("CITY CODE"), AND
SECTION 29-B OF THE CHARTER OF THE CITY OF MIAMI, FLORIDA, AS
AMENDED ("CITY CHARTER"), AND CONSISTENT WITH THE RESOLUTION
PASSED BY THE CITY COMMISSION, SHALL NOT INCLUDE ANY PROVISION
THAT WOULD REQUIRE ANY BIDDER TO FULFILL THE RESPONSIBILITY AND
FUNCTIONS THAT FALL UNDER THE PURVIEW OF THE CITY OF MIAMI
GOVERNMENT; PURSUANT TO SAID SECTIONS OF THE CITY CODE AND CITY
CHARTER, FURTHER AUTHORIZING AND DIRECTING THE CITY MANAGER TO
ISSUE A REQUEST FOR PROPOSALS ("RFP") FOR THE REDEVELOPMENT OF
THE GSA SITE, WITHIN FORTY FIVE (45) DAYS, USING THE UNSOLICITED
PROPOSAL AS THE BASE GUIDELINE, ALONG WITH ADDITIONAL NEEDS OF THE
CITY, FOR SAID RFP, ALL IN A FORM ACCEPTABLE TO THE CITY ATTORNEY,
FOR SAID PURPOSE; FURTHER DIRECTING THE CITY MANAGER TO ENSURE
ALL ALLOCATIONS, APPROPRIATIONS, AND PRIOR BUDGETARY APPROVALS,
COMPLY WITH ALL APPLICABLE PROVISIONS OF THE CITY CODE, INCLUDING
THE CITY'S PROCUREMENT ORDINANCE, ANTI -DEFICIENCY ACT, AND
FINANCIAL INTEGRITY PRINCIPLES, ALL AS SET FORTH IN CHAPTER 18 OF THE
CITY CODE, IN FORMS ACCEPTABLE TO THE CITY ATTORNEY, AND COMPLY
WITH ALL APPLICABLE LAWS, RULES, AND REGULATIONS, AS MAY BE DEEMED
NECESSARY FOR SAID PURPOSE.
WHEREAS, the City of Miami ("City") Department of General Services Administration
("GSA") as well as other City departments currently use the City -owned property located at
1950 Northwest 12 Avenue, Miami, Florida (Folio No. 01-3135-001-0010) and 1970 Northwest
13 Avenue, Miami, Florida (Folio No. 01-3135-000-0163) (collectively, the "GSA Site"); and
WHEREAS, on May 23, 2022, the City received an unsolicited proposal for the
redevelopment of the GSA Site submitted by N. R. Investments, Inc., a Florida profit corporation
("N. R. Investments"), attached as Exhibit "A" ("Unsolicited Proposal"); and
WHEREAS, the City Manager is directed to continue the process of reviewing the
Unsolicited Proposal in accordance with Section 18-119 of the Code of the City of Miami,
Florida, as amended ("City Code"), and Section 29-B of the Charter of the City of Miami, Florida,
as amended ("City Charter"); and
WHEREAS, the City Manager is further authorized and directed to issue a request for
proposals ("RFP"), in a form acceptable to the City Attorney, for said purpose, within forty-five
(45) days; and
WHEREAS, the City Manager is further authorized to make any and all RFP addenda,
amendments, modifications, and extensions, subject to all allocations, appropriations, prior
budgetary approvals, compliance with all applicable provisions of the City Code, including the
City's procurement ordinance, anti -deficiency act, and financial integrity principles, all as set
forth in Chapter 18 of the City Code, in forms acceptable to the City Attorney, and in compliance
with all applicable laws, rules, and regulations, as may be deemed necessary for said purpose;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is directed to continue the process of reviewing the
Unsolicited Proposal submitted by N. R. Investments, for the redevelopment of the GSA Site, in
accordance with Section 18-119 of the City Code and Section 29-B of the City Charter, and
consistent with the resolution passed by the City Commission, shall not include any provision
that would require any bidder to fulfill the responsibility and functions that fall under the purview
of the City of Miami Government.
Section 3. Pursuant to said sections of the City Code and City Charter, the City Manager
is further authorized1 and directed' to issue an RFP for the redevelopment of the GSA Site,
within forty-five (45) days, using the Unsolicited Proposal as the base guideline, along with
additional needs of the City, for said RFP, all in a form acceptable to the City Attorney, for said
purpose.
Section 4. The City Manager shall ensure all allocations, appropriations, and prior
budgetary approvals, comply with all applicable provisions of the City Code, including the City's
Procurement Ordinance, Anti -Deficiency Act, and Financial Integrity Principles, all as set forth in
Chapter 18 of the City Code, in forms acceptable to the City Attorney, and comply with all
applicable laws, rules, and regulations, as may be deemed necessary for said purpose.
Section 5. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.2
1 The herein authorization is further subject to compliance with all legal requirements that may be
imposed, including but not limited to those prescribed by applicable City Charter and City Code
provisions.
2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
