Purpose of Item:
A resolution of the Miami City Commission, with attachment(s), authorizing the City
Manager to execute a Maintenance Memorandum of Agreement with the Florida
Department of Transportation for beautification improvements on SR 968, West Flagler
Street from SW 19th Avenue to SW 18th Avenue.
Background of Item:
The Developer pursuant to FDOT Permit #2021-L-690-00012, has design plans for
beautification improvements on SR 968, West Flagler Street from SW 19th Avenue to
SW 18th Avenue. The Developer will install landscape, irrigation and tree grates in
accordance with the design plans for Permit #2021-L-690-00012. The City has made
the Developer responsible for the operation, maintenance and liability of the
Improvements via the execution of a non-standard improvement covenant.

A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO EXECUTE A MAINTENANCE
MEMORANDUM OF AGREEMENT ("MMOA") BETWEEN THE CITY OF MIAMI
("CITY") AND THE STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION
("DEPARTMENT") FOR BEAUTIFICATION IMPROVEMENTS ON STATE ROAD 968
("SR-968")/WEST FLAGLER STREET FROM SOUTHWEST 19TH AVENUE TO
SOUTHWEST 18TH AVENUE.
WHEREAS, the Florida Department of Transportation ("Department") has jurisdiction
over State Road 968 ("SR-968")/West Flagler Street from Southwest 19th Avenue to Southwest
18th Avenue, which is located within the limits of the City of Miami, Florida ("City"); and
WHEREAS, 1880 Flagler LLC, a Florida Limited Liability Company, ("Developer"),
pursuant to Permit # 2021-L-690-00012, has drafted design plans for beautification
improvements on SR-968/West Flagler Street from Southwest 19th Avenue to Southwest 18th
Avenue ("Project Limits"); and
WHEREAS, the Developer will install landscape and pavers in accordance with the
design plans for Permit # 2021-L-690-00012 ("Improvements"), as approved by the Department;
and
WHEREAS, the City is aware that this Maintenance Memorandum of Agreement
("MMOA"), which is attached and incorporated as Exhibit "A", will supplement all maintenance
requirements between the Department and the City for all previously executed permits and
agreements; and
WHEREAS, the City has made the Developer responsible for the operation,
maintenance, and liability of the Improvements via the execution of a non-standard
improvement covenant;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized' to execute the MMOA between the City and
the Department for beautification Improvements within the Project Limits.
Section 3. This Resolution shall become effective immediately upon its adoption.
1 The herein authorization is further subject to compliance with all legal requirements that may be
imposed, including but not limited to those prescribed by applicable City Charter and City Code
provisions.
