An home less encampment at Virginia key park is
a horrible idea. Far from needed services and
would be ruining a great location where family
and locals meet. No to a homeless camp in
Virginia key
As a board member of the Bayside Residents
Association (BRA, I am fully supportive of the
changes negotiated by the Prescott Committee
on the BRA Board with the Prescott
Developers/Minor Street LP1. Since I sit as Co -
Chair on the BRA Parks Committee and am a
member of the BRA Resiliency Committee, I
would like to request that the Commissioners and
City staff look at the interconnections between
this Prescott Development, the Baywood Park
seawall and infrastructure updgrades in the
Bayside neighborhood (e.g., pump stations,
drainage systems, seawall, etc.) that will all affect
the neighborhood's ability to weather future
storms. Depending on the vote today, Prescott
Development at 7101 NE 10th Ave & 1000 NE
72nd St may be over one hurdle - historic
compliance to the historic Bayside neighborhood
- but this development's affect on resiliency
issues facing our neighborhood will be another
huge hurdle for BRA, the Prescott Developers and
the City to collectively figure out before shovels
hit the ground on this project! Parks is
undergoing a systemwide review with Reimagine
Miami Parks so we have an opportunity here to
make sure the entire seawall affecting our
community from the Prescott Development
through Baywood Park is addressed in the future
masterplan for that park. We also understand
from research conducted by Ana Miranda, our
illustrous chair of the BRA Resiliency Committee
that upgrades to our neighborhood infrastructure
(e.g., pump stations, storm drainage, etc) to
increase capacity have been identified
[particularly Pump Station (PS) 30-051 in which
the Water & Sewer Department (WASD)
submitted a Remedial Action Plan (RAP) SEVEN
YEARS AGO on May 12, 2015 with completion by
THIS YEAR on December 31]. Will these upgrades
now be able to accommodate this higher density
Prescott Development with five homes since our
historic community has already had to endure
sewage leaks from heavy rain events as recently
as this May when Tropical Storm Alex rolled
through town filling my neighbors' yards, garages
and homes with sewage. These projects - current
infrastructure upgrades, Prescott Development
and improving Baywood Park via Reimagine
Miami Parks efforts CANNOT continue working in
individual silos. In our neighborhood, they are
intrinsically connected to each other. So due to
the resiliency issues historic Bayside is
experiencing at this moment and the fact that
these projects are moving forward as we speak, I
humbly request that the Commissioners insist
issues of resiliency in our precious neighborhood
be immediately addressed and that all parties
involved (BRA, Prescott Developers, Parks, OCI,
DERM and WASD, etc.) come together to figure
out best way forward. Thank you Commissioners
for all you do to support and protect our

As a builder and maintainer of the North Point
Bicycle Trails, I am in opposition of the proposal
to place a transition zone for the homeless at the
front of the trails. This is in no way a "secluded"

Dear Commissioners, Respectfully, I urge you to
move against a homeless transition ground on
Virginia Key and consider a different location in
Miami -Dade County. Virginia Key has nothing to
offer a homeless population in terms of grocery
stores, public transit, or other necessities.
Additionally, Virginia Key is often subject to waste
water leaks due to the treatment plant on the
island which could be of considerable health
concerns to a permanent or semi permanent
population. Virginia Key and Key Biscayne are also
subject to extreme storm flooding which could
threaten and endanger an already vulnerable
population. Virginia key is also one of the last
remaining places in Miami with little urbanization
making it an important refuge for wildlife. It is
concerning to add a standing residential
population to this area as trash production and
land usage could have further negative effects on
the area. In consideration of both humane and
environmental issues with using Virginia Key as a
transitional housing area, I strongly urge the
committee to consider alternative locations.

Virginia Key is a beautiful outdoor adventure area
where families and kids gather every day
especially on weekends to disconnect and create

Hello, I am in opposition to relocate our
homeless community to Virginia Key. Virginia Key
is a beautiful outdoor location for self propelled
aquatic, off -road vehicles where active people
can get away from City life yet dine in the
surrounding areas inside Key Biscayne and
outside of the island such as Coconut Grove,
downtown Miami. This location has epic MTB
trails for riders to challenge themselves as well as
spend quality time with families whom also love
the sport. Volunteers have put thousands of

Homeless housing on VK only compounds the
homeless issue. Transportation costs and
availability into the city will halt homeless
residents from seeking county provided services
and limit job opportunities. No earning potential
means they are homeless longer than they
deserve to be. Where and how will they evacuate
to if a hurricane is coming? The cost of bringing
services to them at VK will be cost prohibitive.
Wrong for so many reasons.
I am a resident/homeowner of the Bayside
Historic District. While I support the negotiations
of the board on our behalf regarding the
development proposed, I am concerned about
resiliency and the capacity of our infrastructure.
In speaking with DERM, I discovered we have
pump station #51 on 71St. with documented
capacity issues since 2015. Due to these issues we
have had repeated sewage leaks with heavy
rainfall over the years. We have a sea wall
currently needing repairs (due to a breach) and
also an upgrade to the 6ft height proposed by this
development to insure that water is not diverted
to adjacent areas. Mayor Suarez was on Face the
Nation this Sunday discussing upgrades to the
city's infrastructure, including pump stations. Our
coastal neighborhood needs to be prioritized.
Before shovels hit the ground with yet another
new development in our area, I would like the
city to insure (meaning funding and action, not
just promises) that these and any other
environmental matters that may arise from this
development are fully resolved.
I am against this development as proposed, for
several reasons. The height of the structures is
too imposing. This is a historical neighborhood
with only two story homes, and none of this
magnitude. It still will look like an enclave of
townhouses, completely apart in style and
enormous size. I have been in this community for
twenty years, I agree with developing the lots,
but not as what seems to be a top heavy and
dense development. The storage space
underneath the houses are too tall, not necessary
by code and designed to be possibly converted
into living space They are just too massive in
scale for this neighborhood. Please help us
maintain the charming and human scale feel of

this beloved historic neighborhood. Thank you
I am not sure if this PZ or if PZ 25 is to make way
for the soccer fields but we would prefer to
extend the Bicycle amenities/pump track, skills
section as well as add some shade for the families
that come to either use the Outdoor Center or
the Bike trails rather than put a soccer field in.
That field area just flooded a couple of weeks ago
and sewage spilled onto it. There would need to
be soil checks for sure if people will be playing
soccer there along with being able to play when
the sewer plant is sending out its stench, a time
frame that can never be determined, it just
happens. Those of us on bikes can get away from
it but not on a soccer field. Thank you.
I do not support the use of Virginia Key's beach
park area to be converted to transitional housing
for several reasons. First, the people who need
access to this housing will also need access to the
city's resources, and Virginia key is very far from
any resources. Public transportation is limited and
the closest grocery store is several miles away.
Secondly, our city needs to prioritize protecting
and preserving coastal environments that have
not been developed, as those areas are few and
far between nowadays. Virginia Key hosts several
recreational parks that are valued by Miami's
constituents. Overall, development of this area
would benefit no one. The other suggested areas
for transitional housing on the plan are much
better -suited as potential locations, due to their
proximity to downtown and many public
resources.

I have over 1000 hours volunteering at VK. There
is an approved plan in place for the use of this
area for recreation. There is also an advisory
board to guide this process. This is park land and
a homeless site seems incongruous with this
designation.

Item - VKey is a very popular park with beach areas and

Over the past 20 years the Virginia Key park area,
under consideration for a Homeless Transition
Zone, has been a mecca of sorts for Beachgoers,
MountainBikers, hikers, naturalists and others.
1000s of manhours both Govt and Volunteer have
been invested in making this area a renowned
must visit for families and enthusiasts. The all
volunteer Virginia Key Mountain Bike Club has
developed over 10 miles of world-renowned
mountain bike trails that inspired thousands of
enthusiasts and park designers. The VK Outdoor
Vendor is filled with tourists every day of the
week who want to enjoy the pristine lagoon and
waterways around VK on a Kayak. Please do not
create a Transition Zone for the Homeless on
Virginia Key. Consider an urban site where these
people in need can be better served and do not
have to walk or bike aimlessly over our bridges
and be isolated and far away from the services
they need
Please do not bring "homeless zone" to Virginia
DI. 2 Key Mountain Bike Trails. These trails are used by

The homeless transition area planned for Virginia
key is not a good idea. The north point area is
sure to the outdoor center and bike trails. The
area is a recreational and tourist area where
families go enjoy the beautiful outdoors. The
area is not near any public transport or medical
services and having the transition area there will
cause problems for the homeless, the city, and
those who use the park.
The proposed development is not appropriate for
this neighborhood. The houses are taller than the
businesses on nearby Biscayne Blvd. There are no
homes with three stories in Bayside Historic
District, and these are taller and more massive
than anything in the entire area. It seems that
that they will create a separate enclave inside our
beloved historic neighborhood. Any one
homeowner would never be approved for all the

This comment notes my opposition to the current
proposal for the new Prescott mansion and its
respective new residence designs and layout.
Specifically, the height and design are irrelevant
to the Bayside Historic District Guidelines. It is
immediate from the renders and plans submitted
that the design, while typical for Miami Beach,
would in no way integrate with this
neighborhood's character and historical design
features. As a relatively new owner, I have had
to adhere to our historical guidelines for driveway
renovations and various other changes to my
property in the last two years. I have put time and
money into working with these city rules to abide
by them carefully. I respect these rules and
understand how scarce and precious they are for
appropriate preservation and considered
modernization in a city of significant change. I

This is a family friendly space. Please don't make
it unsafe. My family and I have enjoyed this space
for years and it is an essential park in Miami.
This is a very bad idea, because this is a
recreational area, with already a lot of car traffic
(bike park and outdoor activity center) as well as
road cyclists riding in and out of Virginia Key. I
would also argue that putting homeless people in
shelters next to a smelly and regularly
overflowing water treatment plant is quite
inhumane. Lastly VK is isolated from any public
transportation system making this location unfit
for purpose.
This is absurd. Who in their right mind would
place a homeless camp out in that lot? Elected
officials them ask why "We the people no longer
trust in our government" this is why. The whole
project reeks of kickbacks and a cash grab. Let's
not forget about Jimbo's and its transients? Let's
also not forger about all the work that the bicycle
club has done to transform that part of the park
into a destination. The park charged $1.50 until
we built the bike trails and you now charge $7.00.
Let's not forget about the investment made by
the VKOC and the work they have put in. To
move forward with this project is to betray the
"we the people" on both sides.
This is not the proper area for this encampment.
Too many children and nature preserve next to it.
Too much garbage will be created and stress on
the environment. Bike Club has parking needs
and safety needs there. It is a success as -is!
This is so sad for the community I grew up in. This
is a place where I go journal, spend time alone,
with my family. It's a place so sacred to my
mental health. Every time I go to spend time
there all I see are kids and families. I beg you and
ask you to please reconsider this as it would really
devastating for many that have grown up with
this beautiful place being part of our daily lives.

safety and availability of public transportation for

relocation zone, I respectfully and strongly
encourage the City to consider an alternative to
Virginia Key. The distance from available work
and other resources needed for the homeless
population makes Virginia Key a less than ideal
location for their relocation. Additionally, the
outdoor center and mountain bike park are one
of the very few places within the City where
residents and visitors can escape our urban
environment and enjoy the outdoors with our
families. Don't ruin that for us, please!
Virginia Key far from being an "optimal" location
for the proposed homeless transition zone. One
of the reasons why those who claim it is, is that
the area is supposedly "secluded". Secluded is
defined as "(of a place) not seen or visited by
many people; sheltered and private" and Virginia
key is not that at all. Maybe those who proposed
the site visited the location on a weekday during
traditional business hours but the proposed
location is regularly visited by people on a daily
basis and ABSOLUTELY FULL of people during the
weekends. People are out having pick -nicks,
meeting friends, teaching their young children to
ride bicycle, exercising, and participating in a
variety of sports including paddleboarding,
mountain biking, road cycling kayaking etc. Tents
are put up, meals prepared, you name it, it's
happening there. Organized events and races are
also regularly held there. I do invite those
proposing the location to visit to site on a
weekend and they will immediately see how bad

Dear Commissioners, I am sorry I cannot be
present today, my work has taken me to the West
Bank in Palestine and I could not change the
dates of this trip. My attorney has filed this
motion to intervene on my behalf, as I have an
interest in this matter that is different than the
neighborhood, and I do not agree with the
position that the residents' association has taken.
The residents association is a voluntary one for
those living in the neighborhood, with less than
half of the residents of the neighborhood as
members. While some of the residents concede
to the association board handling the negotiation
with the developers in regard to their application,
the board's position by no means represents the
majority of the neighborhood. I object to the
developers' application for the following reasons,
which were shared with the developer in a zoom
meeting in April, 2022 to which the neighborhood
was invited to participate: • The proposed plans
have some minor changes from what was
presented to the HEP Board, but the number,
size, and massing of the four proposed homes on
the lot next to the Prescott mansion are basically
the same. The HEP Board's ruling of six to one
against the developer's plans should be upheld
until the developer reduces the number, size, and
massing of the four homes to conform to the
historic district requirements to which all other
homeowners are held. • The U.S. Secretary of
the Interior's historic district guidelines supersede
the State of Florida's Building Code, the City of
Miami City Code, and the City of Miami Zoning
Ordinance. The Secretary of the Interior's
Standard 9 states that "The new work shall be
differentiated from the old and shall be
compatible with the massing, size, scale, and
architectural features to protect the historic
integrity of the property and its environment."

(District/Neighborhood): The relationship of
buildings to each other, setbacks, fence patterns,
views, driveways and walkways, and street trees
and other landscaping together establish the
character of a district or neighborhood. o Since

District, any modifications must be compatible
with the massing, scale, size and features of the
setting - the existing District. The context includes
both the Prescott Mansion and the surrounding
neighborhood. The addition to the Prescott
mansion and the four other homes are not
compatible with the setting. • Key Terms and
application: o Massing is a term in architecture
which refers to the perception of the general
shape and form as well as size of a building...From
a distance, massing, more than any architectural
detail, is what creates the most impact on the
eye. The developer insists that the four houses
are two story; but the massing is of three-story
houses, and there are no three-story homes in
the historic neighborhood or in Miami's Code 21.
o Scale: Building scale means the relationship
between the mass of a building and its
surroundings, including streets, open spaces, and
surrounding buildings. Scale is a comparison of
the dimensions of various components of a
building to other related elements and to human
dimensions. The four homes adjacent to the
Prescott mansion are not compatible in scale to
the historic district homes or neighborhood. o
Size refers to the actual size of a building
(footprint, square feet, FAR, number of floors,
building height) as well as its perceived size. The
size of the developer's four adjacent homes are
much larger than the historic neighborhood
homes. • The Prescott mansion is being
reconstructed within the meaning of the
Secretary of Interior's Standard 9. Reconstruction
is defined as the act or process of depicting, by
means of new construction, the form, features,
and detailing of a non -surviving site, landscape,
building, structure, or object for the purpose of
replicating its appearance at a specific period of
time and in its historic location.

previous ruling of the HEP Board when the
original Prescott mansion was demolished
requires that what is rebuilt on the site must
replicate the original building. The developer's
argument that they are not reconstructing the

that a new addition must preserve the building's
historic character, form, significant materials, and
features. It must be compatible with the massing,
size, scale, and design of the historic building
while differentiated from the historic building.

Secretary's guidance is as follows: o A new
addition should be simple and unobtrusive in
design, and should be distinguished from the
historic building. The Prescott mansion's addition

usually the best location for a new addition.
*Public Right -of -Way. An area or strip of land,
either public or private, occupied or intended to
be occupied by a street, walkway, railroad, utility
line, drainage channel, or other similar uses (City
of Miami Historic Design Guidelines) The Prescott
mansion's new addition is plainly and clearly
visible from the public right of way — Baywood
Park, next to it. o The construction materials and
the color of the new addition should be
harmonious with the historic building materials. o
The new addition should be smaller than the
historic building —it should be subordinate in
both size and design to the historic building.

does it mean to be compatible yet different? The
guidance explains: o "...the treatment of the
addition should not be so different that it
becomes the primary focus. The difference may

existing building and uses similar proportions,
materials, textures and colors. Elements follow
the lines and proportions of the original. The
detailing is what differentiates the old from the
new. o What is specifically pointed out as
unacceptable are additions that overwhelm the
original or are starkly different from the original.
The developer's addition to the Prescott mansion
violates the Secretary's guidance. • The National
Register listing does not mean that a building or
district is frozen in time and that no change can
be made without compromising the historical
significance. It does mean, however, that a new
addition to a historic building should preserve its

new addition should always be subordinate to the
historic building; it should not compete in size,
scale or design with the historic building. An
addition that bears no relationship to the
proportions and massing of the historic building —
in other words, one that overpowers the historic

compromise the historic character as well. In the
developer's plans, the addition to the Prescott
mansion does not preserve its historic character;
it overpowers the mansion and compromises its
historic character. • The Secretary's guidance
recommends ensuring that new construction is
secondary to the historic building and does not
detract from its significance. o The Secretary's
guidance recommends NOT constructing a new
building on a historic property or on an adjacent
site that is much larger than the historic building.

adjacent lot are not secondary to the Prescott
mansion; in fact, they dominate and tower over
it, and are much larger than the historic building.
• The US Historic Park Service gives guidance on
what constitutes compatible design for historical
properties on its website:

the positive examples the addition is the same
height or lower than the existing building and
uses similar proportions, materials, textures and
colors. Elements follow the lines and proportions
of the original. The detailing is what differentiates
the old from the new. • Positive examples from
the Secretary's website include: (new addition is
smaller and to the side of the historic building)
(new addition is to the rear of the original,
smaller, and is compatible yet distinguishable. •
HEIGHT of the four adjacent homes: o In Bayside,
163 (86%) houses are one story while 26 (14%)
are two story. No three-story homes exist in the
historic district. The three-story homes should be
rejected. o On 72nd street, only 2 two-story
homes are next to each other; the remaining have
one-story homes in between. There should be no
more than one two-story home. o FEMA requires
4 feet above existing grade (11 feet NGVD);
existing homes roof peak has an average of 22
NGVD, the highest is 25 NGVD FEMA
recommends one foot of freeboard, while the
developer has planned for five feet. While the
Miami city code does not have a height cap on
where the first floor of a house starts, Miami's
code cannot supersede a federal statute. The
height of the four adjacent homes should be in
conformity with the neighborhood, and can be
built while meeting FEMA requirements. o This is
a drawing of the original plan submitted by the
developer, comparing my home to the proposed
house across the street (see below). While the
developer has lowered the total height by three
feet, that reduction is insignificant and the
contract continues to be stark. The developer
should be held to a plan whereby the four
adjacent homes are no higher than 35 feet. o "It
is difficult, if not impossible, to minimize the
impact of adding an entire new floor to relatively
low buildings, such as small-scale residential or
commercial structures, even if the new addition is
set back from the plane of the fagade.
Constructing another floor on (top of) a small,
one, two or three-story building is seldom
appropriate for buildings of this size as it would
measurably alter the building's proportions and
profile, and negatively impact its historic
character." — Secretary of Interior guidance, at
nps.gov. While the developer is not proposing an
addition to the four adjacent homes, the spirit of
the guidance is strictly applicable. •
Mass/Density: o The two lots are presently
platted for two houses: Prescott Mansion and
one on other lot. Nowhere is the historic
neighborhood are there five consecutive two-
story homes on 7,500 ft lots. o Square footage of
houses: There is only one house in the historic
district between 4,000 and 5,000 square feet;
there are only six homes in the historic district
between 3,000 and 4,000 square feet; the
average home in our historic neighborhood is
1,756 feet. The square footage of the four
adjacent houses are overwhelming to the
neighborhood. • Environmental and economic
impact: o The developer plans to rebuild and
raise the existing seawall behind the two lots; but
the seawall will only be raised there, leaving the
properties on either side highly likely to increased
damage from waters that overflow the seawall on
either side. See: "As rising seas encroach on
coastal communities, governments and property
owners often try to block the water by setting up
barriers such as seawalls or levees. But a new
study has found this conventional fix can seriously
backfire in bays and estuaries, potentially causing
worse flooding and massive economic damage in
nearby unprotected communities."

researcher, Dr. Michelle Hummel, she stated that
the same principle applies to a house with a
raised seawall where the adjacent properties do
not have seawalls raised to the same height. Dr.
Hummel and the three other Stanford University
Ph.D. engineers on the team have developed a
formula to calculate the increased economic
damage due to the raised seawall. o The
developer's appeal from the HEP Board's 6 to 1
denial of the developer's application states that
they "raised and improved the seawall to protect
the community from sea level rise". In fact, while
the raised seawall may offer additional protection
to the two Prescott lots, it creates increased
damage to the adjacent properties and the
neighborhood. o The developer has studied and
planned for 24-hour stormwater retention, as
required by the city code, but has made no effort
to study and plan for stormwater diversion
beyond the 24 hours, or the impact on the
surrounding houses and neighborhood. The

developer's offer to conduct such a study should
be rejected, as the developer has a clear conflict
of interest should the study's findings conclude
that the 24-hour stormwater retention plan is
insignificant, and should not be considered as a
mediating measure. o The developer proposes
four docks to be build in Biscayne Bay, with no
study of harm to the major manatee corridor that
exists, the extensive seagrass in that area, or the
general health risks to Biscayne Bay. The
developer purchased these two lots in a long-
standing, well known historic district. Florida case
law states that "One who purchases property
while it is in a certain zoning classification,
ordinarily will not be heard to claim as a hardship
a factor or factors which existed at the time he
acquired the property." The developer's only
consideration here is enormous profit, with
complete disregard to the standards that govern
historic neighborhoods. Bayside was designated
as a historic neighborhood in the early 1990s, the
most residents purchase their homes because of
the historic designation — we love the character
and appearance of our neighborhood. I
purchased my 1937 Art Deco home specifically
because of its appearance and historic
significance. A Florida court stated that "Historic
preservation is part and parcel of an expanded
concept of public welfare seeking to bring
harmony to our communities — to value and
conserve the unique heritage of our past in order
to enrich the quality of life for our present and
future generations. See, Estate of Tippett v. City
of Miami. In summary, I request that the
developer's current proposed plan be rejected for
all of the aforementioned reasons, and that the
developer be required to conform to the
Secretary of the Interior's regulations and
guidelines concerning historic neighborhoods.
