A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO ACCEPT, BUDGET, ALLOCATE,
AND APPROPRIATE A TOTAL OF ELEVEN MILLION, TWO HUNDRED
TWENTY-ONE THOUSAND, SIX HUNDRED NINETEEN DOLLARS
($11,221,619.00) IN FUNDS APPROPRIATED BY THE STATE OF FLORIDA
("STATE") TO THE CITY OF MIAMI ("CITY") PURSUANT TO CHAPTER 2022-
156 OF THE LAWS OF FLORIDA, AND AS MORE PARTICULARLY
IDENTIFIED HEREIN ("STATE APPROPRIATED FUNDS"); FURTHER
AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE
AGREEMENTS WITH THE STATE, ALL IN FORMS ACCEPTABLE TO THE
CITY ATTORNEY, TO IMPLEMENT THE ACCEPTANCE, ADMINISTRATION,
AND USE OF THE STATE APPROPRIATED FUNDS; FURTHER
AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY
AND ALL OTHER NECESSARY DOCUMENTS, INCLUDING, BUT NOT
LIMITED TO, AMENDMENTS, EXTENSIONS, RENEWALS, AND
MODIFICATIONS, ALL IN FORMS ACCEPTABLE TO THE CITY ATTORNEY,
FOR THE ACCEPTANCE, IMPLEMENTATION OF, AND COMPLIANCE WITH
THE AGREEMENTS FOR THE STATE APPROPRIATED FUNDS.

WHEREAS, on June 2, 2022, Florida Governor Ron DeSantis signed Chapter 2022-156
of the Laws of Florida ("2022 General Appropriations Act"), attached and incorporated as Exhibit
"A"; and
WHEREAS, the 2022 General Appropriations Act, through the Florida Department of
Environmental Protection ("FDEP"), appropriated One Million, Five Hundred Thousand Dollars
($1,500,000.00) to the City of Miami ("City") for the Miami East Auburndale Drainage & Flood
Mitigation project; and
WHEREAS, the 2022 General Appropriations Act, through FDEP, appropriated Three
Million Dollars ($3,000,000.00) to the City for the Miami East Flagami Flood Mitigation,
Stormwater and Drainage Improvements project; and
WHEREAS, the 2022 General Appropriations Act, through FDEP, appropriated Eight
Hundred Thousand Dollars ($800,000.00) to the City for the Miami Fairlawn Community Storm
Water & Drainage (District 4) project; and
WHEREAS, the 2022 General Appropriations Act, through FDEP, appropriated Two
Million, Two Hundred Sixty -Nine Thousand, Six Hundred Nineteen Dollars ($2,269,619.00) to
the City for the Miami Kinloch Flooding Mitigation and Road Reconstruction project; and

WHEREAS, the 2022 General Appropriations Act, through FDEP, appropriated One
Million, Fifty -Two Thousand Dollars ($1,052,000.00) to the City for the Miami Localized Flooding
Improvements District 3 project; and
WHEREAS, the 2022 General Appropriations Act, through FDEP, appropriated Two
Million, Five Hundred Thousand Dollars ($2,500,000.00) to the City for the Miami Pump Stations
Upgrade District 3 project; and
WHEREAS, the 2022 General Appropriations Act, through FDEP, appropriated One
Hundred Thousand Dollars ($100,000.00) to the City for the Miami Tidal Valves and Flood
Improvements District 3 project; and
WHEREAS the City Commission finds it is in the best interest of the City to accept,
budget, allocate, and appropriate the funds appropriated to it in the 2022 General
Appropriations Act and to authorize the City Manager to negotiate and execute any and all
agreements and other necessary related documents with the State of Florida ("State"), all in
forms acceptable to the City Attorney, to implement the acceptance, administration, and use of
the funds appropriated to the City;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings set forth in the Preamble to this Resolution are
hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section.

Section 2. The City Manager is authorized' to accept, budget, allocate, and appropriate

imposed, including but not limited to, those prescribed by applicable City Charter and City Code

totaling Eleven Million, Two Hundred Twenty -One Thousand, Six Hundred Nineteen Dollars
($11,221,619.00) in State appropriated funds (collectively, "State Appropriated Funds").
Section 3. The City Manager is further authorized to negotiate and execute agreements
with the State, all in forms acceptable to the City Attorney, to implement the acceptance,
administration, and use of the State Appropriated Funds.
Section 4. The City Manager is further authorized' to negotiate and execute any and all
other necessary documents, including, but not limited to, amendments, extensions, renewals,
and modifications, all in forms acceptable to the City Attorney, for the acceptance,
implementation of, and compliance with the agreements for the State Appropriated Funds.
Section 5. The Resolution shall become effective immediately upon its adoption and
signature of the Mayor.2

2 If the Mayor does not sign this Resolution, it shall become effected at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
