Re: Comprehensive Plan Amendment (PZ-19-4165) and Rezoning (PZ-19-2851) for the Property
Located at 444 Southwest 2id Avenue in the Ciry of Miami, Florida
Dear Mr. Garcia,
The Department of Real Estate and Asset Management ("DREAM") represents the City of Miami
(the "Applicant") in relation to requests for a Miami Comprehensive Neighborhood Plan ("MCNP")
amendment and rezoning of the property comprised of two tracts located at 444 SW 2"d AVE and 460 SW
2' AVE, in the City of Miami, Florida (collectively, the "Property"). See Exhibit 1, Property Appraiser
Sununa,y Reports. The Applicant seeks two items:
1. An MCNP amendment of the Property, from "Major Institutional, Public Facilities,
Transportation, and Utilities (Major PUB FAC)" to "Restricted Commercial;" and,
2. A rezoning of the Property from Civic Institutional ("CI") to T6-36B-O, Urban Core.
Please, allow this letter to serve as the required letter of intent, in connection with the foregoing
requests for the MCNP amendment and rezoning of the Property.
Property. The Property is, approximately, 3.15 acres, located on the west side of SW 2"d AVE,
between the Miami River and SW 3rd Street. Specifically, the Property is located at the southwest corner
of a signalized traffic intersection with four (4) pedestrian crosswalks.
As mentioned above, the Property is zoned CI and is abutting a property zoned T6-36B-O, to the
north, and the Miami River Special Area Plan, to the south. See Figure A, below. The property directly
north is zoned T6-36B-O and is undeveloped. The property to the east is zoned CI and has been
developed with an FPL power plant. The property to the south is zoned T6-36B-O and D3 - the Miami
River Special Area Plan - and is undeveloped, but for a defunct restaurant which is situated along the
River. Further, the properties located west of I-95 are designated Restricted Commercial, on the Future
Land Use Map ("FLUM"), with the exception of the Property and the aforementioned FPL power plant,
which have a future land use designation of "Major Institutional, Public Facilities, Transportation, and
Utilities (Major PUB FAC)."

Request. The Applicant brings forth this request, in order to allow for redevelopment of the
Property which would provide a much -needed transition from the directly abutting T6-36B-O transect, on
the north, to the adjacent Miami River Special Area Plan. Article 7, Section 7.1.2.8.a.1 of Miami 21
states, "When a CI zoned property ceases to be used for Civic functions, the successional rezoning is
determined by identifying the lowest Intensity Abutting' Transect Zone, and rezoning to that Zone's next
higher Intensity Zone." Here, the Property is used as the City of Miami's administrative headquarters
("MRC"), which is a Civic function. Pursuant to the November 2018 referendum, the voters
overwhelmingly approved the Applicant's request for the disposition of the Property to a private
developer ("Lancelot"). The referendum approval was the culmination of a Request for Proposal ("RFP")
process wherein Lancelot was selected as the most responsive, responsible proposer to acquire the
Property. In its proposal, Lancelot offered to acquire the Property and redevelop the MRC at another
location. The Applicant's rezoning of the Property is a condition to Lancelot's consummation of the
acquisition of the Property. Accordingly, in an effort to fulfill is legal obligations vis-a-vis the RFP,
effectuate the will of the people, and maintain uniform zoning and land use designation in this area, the
Applicant respectfully requests the Property be rezoned to T6-36B-O and for the land use description to
be changed to Restricted Commercial.
Abutting: To reach or touch; to touch at the end or be contiguous with; join at a border or boundary; terminate on. Abutting properties include
properties across a street or alley. See Miatni 21, Article 1, Section 1.2.

Moreover, Article 7, Section 7.1.2.8.c. of Miami 21 provides a rezoning of land w
considered where the proposal involves an extension of an existing transect boundary, unless the
involves at least 40,000 square feet of land area or 200 feet of street frontage on one street (En
added). Here, not only does this proposal involve the extension of an existing transect boundary,
discussed in the preceding paragraph, but the Property consists of, approximately, 137,125 square feet of
land area. Therefore, the criteria, set forth above, has been satisfied, and rezoning of the Property should
be favorably considered.
Furthermore, an analysis, pursuant to Article 7, Section 7.1.2.8.c.2.(g) of Miami 21, is not
required. Said analysis is only required when an application for rezoning is made by any person or entity
other than the City Commission; the Planning and Zoning Appeals Board; and, any other department,
board or agency of the City. Here, the Applicant is DREAM, which is a department of the City. As such,
the analysis required by Section 7.1.2.8.c.2.(g) is not germane to this Applicant.
Criteria. Article 7, Section 7.1.2.8.f. of Miami 21 states the criteria for amendments to Miatni 21.
The section provides:
(a) The relationship of the proposed amendment to the goals, objectives and
policies of the Comprehensive Plan, with appropriate consideration as to
whether the proposed change will further the goals, objectives and
policies of the Comprehensive Plan; the Miami 21 Code; and other city
regulations.
(b) The need and justification for the proposed change, including changed or
changing conditions that make the passage of the proposed change
necessary.
The proposed amendment is consistent with the goals, objectives and policies of the MCNP. For
instance, Objective LU-1.3 of the MCNP states, as follows:
The City will continue to encourage commercial, office and industrial
development within existing commercial, office and industrial areas; increase the
utilization and enhance the physical character and appearance of existing
buildings; encourage the development of well -designed, mixed -use
neighborhoods that provide for a variety of uses within a walkable area in
accordance with neighborhood design and development standards adopted as a
result of the amendments to the City's land development regulations and other
initiatives; and concentrate new commercial and industrial activity in areas where
the capacity of existing public facilities can meet or exceed the minimum
standards for Level of Service (LOS) adopted in the Capital Improvement
Element (CIE) (Emphasis added).
The Property is located within an area, designated on the FLUM as "Major PUB, FAC" use, with
the Urban Central Business District overlay. The Applicant requests the abovementioned land -use
amendment and rezoning, in order to enhance the commercial character of the Property. Namely, the
Property is located in a rapidly changing area of the Urban Core which fronts the Miami River. To
highlight the significance of the Property's location, the Applicant's request is consistent with the existing
abutting Restricted Commercial designation to the north, as well as with the changing character of the
neighborhood, including the development of the large mixed -use projects located in close proximity to the
Property, such as the Miami River Special Area Plan, Riverside Wharf, Brickell City Centre Special Area
Plan Amendment III, and One River Point. Moreover, the intersection of SW 2"d Avenue — a transit
corridor — and SW 3rd Street includes several pedestrian crosswalks and a traffic signal to regulate traffic

flow, which is an implicit indication the Property is located in an area that was expected
evidenced by the traffic infrastructure already in place. Additionally, the Property is locate
proximity to several Metrorail (Government Center and Brickell) and Metromover (Government
Miami Avenue, Third Street and Riverwalk) stations. A positive recommendation of the Applic
request will permit mixed -use development compatible with the surrounding area, which will help support
the adjacent commercial, civic, and residential uses, as well as fulfill the Transit Oriented Development
policies set forth in Policy LU-1.1.10, HO-1.1.9, and TR-1.1.5. consistent with Objective LU-1.3 of the
MCNP, as cited above.
Moreover, Policy LU- 1.3.15 of the MCNP states, "The City will continue to encourage a
development pattern that enhances existing neighborhoods by developing a balanced mix of uses
including areas for employment, shopping, housing, and recreation in close proximity to each other." The
Applicant's proposal furthers this Policy by encouraging a development pattern that better balances a mix
of uses and, also, provides much -needed transitioning between intensities. The adjacent area has seen a
shift towards higher density and mixed -use structures that often incorporate residential and commercial
uses. The proposed requests recognize the existing development pattern in this area, and it would allow
the Property to be developed in a manner consistent with how the location is growing. Thus, approval of
this application encourages a development pattern that enhances the existing neighborhood by allowing
for development that provides a balanced mix of uses.
Conclusion. The Applicant respectfully requests the aforementioned rezoning and FLUM
amendment, in order to allow for a more balanced mix of uses on the Property. Due to current initiatives
in the City and County, there has been a revitalization of properties fronting the Miami River, such as the
Property. The adjacent area has been and will continue to be economically revitalized and reenergized.
Accordingly, the changed and changing conditions make this request necessary in order to best utilize the
Property as a mixed -use development to further benefit the neighborhood.

THE UNDERSIGNED, Florida Power & Light Company, lor a
corporation ("FPL") hereby acknowledges and agrees with The CityofMiami, its successors and assigns ("Buyer") that:
1. FPL holds various easements on the real property
described as:
TRACTS 1, 2 and 3 OF "RIVERSIDE PLAZA", ACCORDING TO THE PLAT
THEREOF, AS RECORDED IN PLAT BOOK 139 AT PAGE 43 OF THE PUBLIC
RECORDS OF DADE COUNTY, FLORIDA (the "Property")
including but not limited to those easements identified in
Paragraph 2 below (the "Easements").
2. FPL is aware of that certain Survey of the Property
prepared by A.R. TOUSSAINT & ASSOCIATES, INC., last updated August
8, 1994 which indicates that certain of the .buildings, structures
and improvements on the Property encroach over portions of the
Easements, to wit:
a Encroachment of the northeast corner of the 6 & 34 story
C.B.S. Parking Garage onto FPL platted utility easement
pursuant to Plat of RIVERSIDE PLAZA, recorded in Plat
Book 139, Page 43 and located on sheets 2 and 3 of the
above mentioned Survey.
b. Encroachment of those certain 6' high concrete walls and
sections of that certain concrete ramp onto FPL platted
utility easements pursuant to the Plat of RIVERSIDE
PLAZA, recorded in Plat Book 139, Page 43 and located on
sheet 2 of the above mentioned Survey.
c Encroachment of that certain concrete slab, located along
the westerly boundary of the Property abutting the Miami
River, onto portions of the FPL platted utility easements
pursuant to the Plat of RIVERSIDE PLAZA, recorded in Plat
Book 139, Page 43 and located on sheet 2 of the above
mentioned Survey.
d. Encroachment of those portions of asphalt pavement onto
a portion of that certain Easement granted to FPL as
recorded in Official Records Book 15422, at page 3335 and
located on sheet 3 of the above mentioned Survey, same
being the easement on the Northwesterly portion of Tract
2 and not that portion underlying the 10 Story Building
and shown on Exhibit A thereto.
e. Encroachment of portions of that certain 10 story C.B.S.
building onto that certain Easement granted to FPL
recorded in Official Records Book 15422, at page 3335 and
located on sheet 3 of the above mentioned Survey.
(collectively the "Encroachments").
3. FPL hereby consents to and acknowledges the
Encroachments, and except as hereinafter reserved it waives any
right it might have under the Easements to commit any damage,
remove, destroy or interfere with the buildings, improvements, and
structures constituting the Encroachments in the event it becomes
necessary for it to use the Easements for repair, replacement or
new installations. Provided, however, in the event that it becomes
necessary to use the Easements for repair, replacement or new
installations, FPL reserves the right to interfere with the
improvements identified in Paragraph 2 b, c and d above so long as
FPL restores the improvements when the repair, replacement and\or
installation is complete.

4. FPL agrees with the Buyer that in its
Easements, FPL will use reasonable efforts to m
avoidable or unreasonable interference with the Buyer'
Property and the improvements thereon. FPL agrees t
exercise of its rights hereunder, it will provide ade
reasonable access to all portions of the Property, inc
without limitation, the parking garage and the loading zones, so as
to avoid unnecessary and avoidable interference with the use and
enjoyment of the Property.
5. FPL agrees to vacate and execute a termination of
easement with respect to any present or future unoccupied and
unnecessary FPL utility easements affecting the Property.

Dear Mr. Garcia,
The Department of Real Estate and Asset Management ("DREAM") represents the City of Miami
(the "Applicant") in relation to requests for a Miami Comprehensive Neighborhood Plan ("MCNP")
amendment and rezoning of the property comprised of two tracts located at 444 SW 2"d AVE and 460 SW
2nd AVE, in the City of Miami, Florida (the "Property"). See Exhibit 1, Property Appraiser Summary
Reports. The Applicant seeks two items:
1. An MCNP amendment of the Property, from "Major Institutional, Public Facilities,
Transportation, and Utilities (Major PUB FAC)" to "Restricted Commercial;" and,
2. A rezoning of the Property from Civic Institutional ("CI") to T6-36B-O, Urban Core.
Please, allow this letter to serve as the required letter of intent, in connection with the foregoing
requests for the MCNP amendment and rezoning of the Property.
Property. The Property is, approximately, 3.15 acres, located on the west side of SW 2nd AVE,
between the Miami River and SW 3rd Street. Specifically, the Property is located at the southwest corner
of a signalized traffic intersection with four (4) pedestrian crosswalks.
As mentioned above, the Property is zoned CI and is abutting a property zoned T6-36B-O, to the
north, and the Miami River Special Area Plan, to the south. See Figure A, below. The property directly
north is zoned T6-36B-O and is undeveloped. The property to the east is zoned CI and is developed with
an FPL power plant. The property to the south is zoned T6-36B-O and D3 - the Miami River Special
Area Plan - and is undeveloped, but for a defunct restaurant which is situated along the River.

Request. The Applicant brings forth this request, in order to allow for redevelopment of the
Property which would provide a much -needed transition from the directly abutting T6-36B-O transect, on
the north, to the adjacent Miami River Special Area Plan. Article 7, Section 7.1.2.8.a.1 of Miami 21
states, "When a CI zoned property ceases to be used for Civic functions, the successional rezoning is
determined by identifying the lowest Intensity Abuttingl Transect Zone, and rezoning to that Zone's next
higher Intensity Zone." Here, the Property is used as the City of Miami's administrative headquarters
("MRC"), which is a Civic function. Pursuant to the November. 2018 referendum, the voters
overwhelmingly approved the Applicant's request for the disposition of the Property to a private
developer ("Lancelot"). The referendum approval was the culmination of a Request for Proposal ("RFP")
process wherein Lancelot was selected as the most responsive, responsible proposer to acquire the
Property. In its proposal, Lancelot offered to acquire the Property and redevelop the MRC at another
location. The Applicant's rezoning of the Property is a condition precedent to Lancelot's consummation
of the acquisition of the Property. Accordingly, in an effort to fulfill is legal obligations vis-a-vis the
RFP, effectuate the will of the people, and maintain uniform zoning in this area, the Applicant
respectfully requests the Property be rezoned to T6-36B-O.
Moreover, Article 7, Section 7.1.2.8.c. of Miami 21 provides a rezoning of land will only be
considered where the proposal involves an extension of an existing transect boundary, unless the rezoning

involves at least 40,000 square feet of land area or 200 feet of street frontage on one street (Emphasis
added). Here, not only does this proposal involve the extension of an existing transect boundary, as
discussed in the preceding paragraph, but the Property consists of, approximately, 137,125 square feet of
land area. Therefore, the criteria, set forth above, has been satisfied, and rezoning of the Property should
be favorably considered.
Further, an analysis, pursuant to Article 7, Section 7.1.2.8.c.2.(g) of Miami 21, is not required.
Said analysis is only required when an application for rezoning is made by any person or entity other than
the City Commission; the Planning and Zoning Appeals Board; and, any other department, board or
agency of the City. Here, the Applicant is DREAM, which is a department of the City. As such, the
analysis required by Section 7.1.2.8.c.2.(g) is not germane to this Applicant.
Criteria. Article 7, Section 7.1.2.8.f. of Miami 21 states the criteria for amendments to Miami 21.
The section provides:
(a) The relationship of the proposed amendment to the goals, objectives and
policies of the Comprehensive Plan, with appropriate consideration as to
whether the proposed change will further the goals, objectives and
policies of the Comprehensive Plan; the Miami 21 Code; and other city
regulations.
(b) The need and justification for the proposed change, including changed or
changing conditions that make the passage of the proposed change
necessary.
The proposed amendment is consistent with the goals, objectives and policies of the MCNP. For
instance, Objective LU-1.3 of the MCNP states, as follows:
The City will continue to encourage commercial, office and industrial
development within existing commercial, office and industrial areas; increase the
utilization and enhance the physical character and appearance of existing
buildings; encourage the development of well -designed, mixed -use
neighborhoods that provide for a variety of uses within a walkable area in
accordance with neighborhood design and development standards adopted as a
result of the amendments to the City's land development regulations and other
initiatives; and concentrate new commercial and industrial activity in areas where
the capacity of existing public facilities can meet or exceed the minimum
standards for Level of Service (LOS) adopted in the Capital Improvement
Element (CIE) (Emphasis added).
The Property is located within an area, designated on the Future Land Use Map, as "Major PUB,
FAC," use. The Applicant requests the abovementioned land -use amendment and rezoning, in order to
enhance the commercial character of the Property. Namely, the Property is located in a rapidly changing
area of the Urban Core which fronts the Miami River. To highlight the significance of the Property's
location, the Applicant's request is consistent with the existing abutting Restricted Commercial
designation to the north, as well as with the changing character of the neighborhood, including the
development of the large mixed -use projects located in close proximity to the Property, such as the Miami
River Special Area Plan, Riverside Wharf, Brickell City Centre Special Area Plan Amendment III, and
One River Point. Moreover, the intersection of SW 2nd AVE and SW 3`d Street includes several
pedestrian crosswalks and a traffic signal to regulate traffic flow, which is an implicit indication the
Property is located in an area that was expected to grow, as evidenced by the traffic infrastructure already
in place. The Applicant's request will better utilize the already commercially designated area, by

permitting more compatible mixed -use development which will help to support the adjacent commercial,
civic, and residential uses. Thus, approval of this application would encourage the development of a
mixed -use neighborhood that provides for a variety of uses within a walkable area, which is consistent
with Objective LU-1.3 of the MCNP, as cited above.
Further, Policy LU-1.3.15 of the MCNP states, "The City will continue to encourage a
development pattern that enhances existing neighborhoods by developing a balanced mix of uses
including areas for employment, shopping, housing, and recreation in close proximity to each other." The
Applicant's proposal furthers this Policy by encouraging a development pattern that better balances a mix
of uses and, also, provides much -needed transitioning between intensities. The adjacent area has seen a
shift towards higher density and mixed -use structures that often incorporate residential and commercial
uses. The proposed requests recognize the existing development pattern in this area, and it would allow
the Property to be developed in a manner consistent with how the location is growing. Thus, approval of
this application encourages a development pattern that enhances the existing neighborhood by allowing
for development that provides a balanced mix of uses.
Conclusion. The Applicant respectfully requests the aforementioned rezoning in order to allow
for a more balanced mix of uses on the Property. Due to current initiatives in the City and County, there
has been a revitalization of properties fronting the Miami River, such as the Property. The adjacent area
has been and will continue to be economically revitalized and reenergized. Accordingly, the changed and
changing conditions make this request necessary in order to best utilize the Property as a mixed -use
development to further benefit the neighborhood.

ACKNOWLEDGEMENT BY APPLICANT
1. The Department of Resilience and Public Works, Transportation, Coordinated Review Committee and other City
and County agencies review zoning public hearing requests and provide input, which may affect the scheduling
and outcome of my hearing. These reviews may require additional hearings before other City and County
boards, which may result in the modification of plans, studies and/or the proffering of agreements to be
recorded. The submission and acceptance of a request for public hearing means that the application is ready to
be scheduled for public hearing. I am also aware that I must comply promptly with any City or County conditions
and notify the Hearing Boards (Hearing Boards) in writing if my public hearing application will be withdrawn.
2. Filing fees may not be the total cost of a hearing. Some requests require notices to be mailed to property
owners up to a mile from the subject property and I am responsible for paying the additional radius mailing
costs. In addition to mailing costs, I am responsible for additional fees related to application changes, plan
revisions, deferrals, re -advertising, etc. that may be incurred. I understand that fees must be paid promptly. The
only fees that will be refunded after the submission and acceptance of an application for public hearing has
occurred will be the surcharge fees related to appeals, as expressly listed in Chapter 62 of the City Code
(Code).
3. Requests for public hearing will be scheduled by the Hearing Boards in accordance with the scheduling timeline
set forth in the Code and the Zoning Ordinance of the City of Miami (Miami 21), as applicable. I must submit any
requests to reschedule, continue or defer my hearing date to the attention of the decision -making body for its
consideration and vote at the public hearing on which my application is scheduled to be heard. I understand that
any requests by the applicant to reschedule, continue or defer the hearing date that are granted shall incur a
$1,000.00 fee, per instance, as per the Code.
4. Applicable Florida Building Code requirements, or other applicable requirements, may affect my ability to obtain
a building permit even if my zoning application is approved; and a building permit will probably be required. I am
responsible for obtaining any required permits and inspections for all structures and additions proposed, or built,
without permits. In addition, a Certificate of Use (C.U.) must be obtained for the use of the property after it has
been approved at a zoning public hearing. Failure to obtain the required permits and/or C.U., Certificates of
Completion (C.C.), or Certificate of Occupancy (C.O.) will result in an enforcement action against any occupant
and owner. Submittal of the zoning public hearing request may not forestall enforcement action against the
property.
