HomeMy WebLinkAboutOrdinanceCity of Miami Ordinance Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 11938 Final Action Date: 5/31/2022 AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER 38 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, TITLED "PARKS AND RECREATION," MORE PARTICULARLY BY ADDING ARTICLE VIII, TITLED "CITY PARK AND RECREATION WATERFRONT IMPROVEMENTS," TO ESTABLISH REQUIREMENTS FOR CITY PARK AND RECREATION WATERFRONT IMPROVEMENTS; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN IMMEDIATE DATE. SPONSOR(S): Commissioner Joe Carollo WHEREAS, the City of Miami's ("City") public parks, especially its waterfront parks, exist to serve the public's recreational enjoyment; and WHEREAS, protecting wide views of the City's waterfront, protecting the City's waterfront recreational open space, and providing public access points to and from the waterfront are important public benefits; and WHEREAS, a narrow planting of mangroves along a shoreline does not protect the land from storm surge and even a mile -wide mangrove forest may not be enough to protect from storm surge; and WHEREAS, artificial reefs and oyster reefs have been proven over decades of experience to increase fish population and improve a body of water's environmental health; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by reference and incorporated as if fully set forth in this Section. Section 2. Chapter 38 of the City Code is hereby amended in the following particulars:1 "CHAPTER 38 PARKS AND RECREATION ARTICLE VIII. CITY PARK AND RECREATION WATERFRONT IMPROVEMENTS Sec. 38-256. Purpose. 1 Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. City of Miami Page 1 of 2 File ID: 11938 (Revision:) Printed On: 6/12/2025 File ID: 11938 Enactment Number: The purpose of this Article is to establish certain waterfront improvements requirements for City parks that are adjacent to Biscayne Bay or the Miami River to preserve the waterfront views from the park and maximize the full use and enjoyment of the City park land. Sec. 38-257. City Park Waterfront Improvements Requirements. Notwithstanding any other provisions in the City Code and/or in the Zoning Code, all waterfront improvement projects on City parks that are adjacent to Biscayne Bay or the Miami River require the following: 11 All seawalls and bulkheads must be constructed on the shoreline, and not inland; Z1 Mangroves and tall -growing plants are prohibited from being planted in the water and on upland area adjacent to the shoreline. 121 All waterfront improvement projects on City parks that are adjacent to Biscayne Bay or the Miami River are encouraged to: 11 Install access and boat ramps; Z1 Install rip -rap and oysters reefs on the waterside of the seawall or bulkhead; and Plant low -growing groundcover that is easily walkable, such as turf grass, along the waterfront." Section 3. If any section, part of a section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 4. This Ordinance shall become effective ten (10) days after final reading and adoption thereof.2 APPROVED AS TO FORM AND CORRECTNESS: 2 This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten (10) days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become effective immediately upon override of the veto by the City Commission or upon the effective date stated herein, whichever is later.
