Cost put at $90 million to replace bridge to Key Biscayne
Construction to replace the
aged and endangered Bear Cut
Bridge linking Key Biscayne to
Virginia Key and ultimately the
mainland would cost Miami -Dade
County $90 million and could be
completed late in 2028, a report
to county commissioners said
this week.
Thecountyhas$5 million for the
planning study phase oftheproject
but no funds at all for designs or
construction, the report says. The
report does not suggest specific
sources for the funding.
The report from Mayor Daniella
Levine Cava was ordered Jan. 19,
the day that commissioners offi-
cially ended a request for proposals
issued after the county received
an unsolicited plan from a group
of firms identified as the Plan Z
Consortium to develop, maintain
and operate Rickenbacker Cause-
way, which would have included
the consortium replacing the Bear
Cut Bridge at its own cost.
The VenetianCausewaywas ini-
tially included in the plan but was
left out of the process in October.
Cancellation of the request for
proposals left the county to find a
solution for the decaying Bear Cut
Bridge, which leads to Crandon
Boulevard, the only mad serving
Key Biscayne.
The bridge, constructed in 1944
during World War IL, was widened

Pilings were being driven in November 2013 to add width to the Bear Cut Bridge, with 84 Installed.
from two lanes to four in 1983 with
sidewalks and shoulders added.
Then in 2013, the Bear Cut
Bridge went through maj or county
rehabilitation, with a partial
superstructure replacement and
widening. But at that time, the
county found in inspections that
under -seabed pilings were also
deteriorating. Because of the cost
of checking, only eight of the
about 400 pilings were inspected
and two — 25% — were found to
be below the required safety level.
They were not replaced.
Those 2013 repairs were esti-
mated to last for up to 20 years.
If the bridge were replaced on the
proposed schedule, a new Bear
Cut Bridge would be available
before the clock nuts out on bridge
durability.
In 2021, the county's Depart-
ment ofTransportation and Public
Works' Highway Bridge Engineer-
ing Division began a periodic
maintenance design project "to
address common deficiencies of

Public Works should advertise this
month for professional services for
a project development and environ-
ment study. That would be followed
by advertisement and award of a
planning, design and engineering
contract in January 2023, to be
completed in spring 2025.
If that schedule were met, the
county could advertise for design -
build services in spring 2025, then
award the design -build contract in
spring 2026.
Construction would be done
for a total bridge replacement late
in 2028, or in 2027 if the contract
were just for major rehabilitation,
the report says.
In order to replace the bridge, it
states, "additional funding sources
will be identified, and grant op-
portunities will be sought"

pero otros muchos son
manufacturados. Existe
fraude y personas que as-
piran a una remuneration
superior a 10 que contem-
pla la pbliza por el tipo de
dano que sufren".
Para el legislador, una de
las causas de que se regis-
trentantos pleitos es como
se pagan los honorarios en
Florida. "En otros estados,
cuando dos partes se en-
frentan en un litigio, cada
una paga sus honorarios.
En Florida, quien pierde
asume los honorarios del
ganador del pleito. Ade-
mas, algunas Cortes, en
ciertos casos, estan mul-
tiplicando los honorarios.
La consecuencia es que
hemos visto casos en que
el propietario, tras ganar
en Corte, recibe 5o.000 do-
laresyelabogado 25o.000.
Todo eso lo paga la com-
pania de seguros". Fabricio
considera que la ley SB-76,
aprobada en 2019 para con-
trolar los honorarios de los
abogados, no ha logrado
disminuir los pleitos.
Lluvia de propuestas
Por su parte, Annette Tad-
deo, senadora democrata
de Florida y aspirante a la
candidatura de su partido
para la carrera por la go-
bernacion, no es nada opti-
mista sobre el resultado de
la sesion especial. "No creo
que se tomen las iniciativas
necesarias para reducir los
costos de las primas".
"Cuando pasaron la ley
SB-76 hace dos arios, me
pare en el Plena y adverb
que las polizas de seguros
iban a subir y que se es-
taba votando en favor de
subirlas".
Se quejo de la falta de de-
dicacion de los represen-
tantes del partido que tiene
la mayoria en el Congreso
para arreglar los problemas
de la gente. Tienen mayo-
ria "desde hace mas de 20
anos y esta situation se ha
empeorado cada vez mas.
iFRAUDE?
•Sobre el fraude, la se-
nadora de origen colom-
biano pregunto "4por que
no estamos arrestando a

ten fraude? Tenemos leyes
contra el fraude. Hemos
invertido dinero en una
fuerza policial para evitar
el fraude en las elecciones.
Sin embargo, no tenemos
a nadie investigando quien
toca las puertas prome-
tiendole a la gente techos
nuevos, pagados por las
companias de seguros".
• La aspirante a gober-
nadora afirmo que no se
persigue "porque no hay
tal fraude. La mayoria de
las veces, son las propias
companias de seguros las
que no quieren pagar. Y los
duenos de casas, a quie-
nes se les esta cayendo el
techo encima, Ilegan a un
punto en que tienen que
contratar un abogado. Uno
de los objetivos de las
companias de seguros es
que no podamos contratar
a un abogado y tengamos
que depender de ellas.
El resultado to estamos
viendo: elevan las primas y
despues no cubren cuando
uno tiene un daft".
•Segun Taddeo, "Florida
es un mercado exitoso
para las companias de
seguros de auto. Ganan
mucho dinero. Esas mis-
mas companias en otros
estados tambien cubren
el mercado de seguros de
casa. Sin embargo, noso-
tros no les exigimos que,
para poder operar aqui,
tambien hagan polizas de
propiedades y asi aumen-
tar la competencia. Algo
que las aseguradoras loca-
les rechazan".
• Hay una iniciativa de Ta-
ddeo en la que, al pare-
cer, coincide con Fabricio.
Ambos creen que el Estado
debe crear un fondo de rea-
seguro para las companias
que operen en Florida. "Pero
muchas aseguradoras se
oponen porque ellas mis-
mas son duenas del negocio
del reaseguro. No quieren
que el Estado ponga un
fondo de reaseguros pars
bajar el costo".
•Otra manera de ayudar a
los propietarios es que pue-
dan adquirir seguros con
menos cobertura. Es decir,
polizas que solo cubren las
estructuras de la casa, el
continente, que es lo que les
preocupa a los bancos. Pero
hace falta incluir obligato-
riamente el contenido, las
pertenencias.
• La ultima iniciativa de Ta-
ddeo es que el comisionado
de seguros de Florida sea
elegido en elecciones, como
en el pasado. "Mientras
esta persona no tenga que
responder ante las urnas,
nunca va a representar al
pueblo".
•A ambos legisladores les
preguntamos que tendria
que pasar para considerar la
sesion especial un fracaso:
•"Si no podemos aprobar
nada. Entonces, veremos a

County commissioners unani-
mously approved in a committee
meeting an ordinance that would
allow the mayor to continue
to designate the director of the
Miami -Dade County Corrections
and Rehabilitation Department,
or any successor department, as
the county's chief correctional
officer once a county sheriff is
elected in 2024.
The commission is tasked with
confirming or disapproving the
candidate, according to the cur-
rent Miami -Dade County's Home
Rule Charter.
"We are prohibited from taking
away responsibilities they [the
constitutional officers] have," said
Commissioner Sally Heyman, the
sponsor of the legislation. "This
[has] not been aresponsibility they
have ever had; we have added a
separate department."
In some Florida counties the
jurisdiction of the sheriff does
include the county jailer, but those
are smaller counties, she added.
The Corrections and Reha-
bilitation Department operates the
eighth -largest jail system in the
nation, according to its website.
An average of 4,000 to 4,200
persons are incarcerated daily in
the county's detention facilities,
which is for people awaiting trial
and serving sentences of364 days
or less.
'The correctional environment
is unique and requires a knowl-
edgeable correctional professional
to direct its daily work of ensur-
ing the safe, secure, and humane
detention ofincarcerated persons,"
wrote Chief Public Safety Officer
JD Patterson in a memorandum.
Commissioner Heyman had
already proposed legislation to
shape the functions and powers to
be excluded from the new county
sheriffs office.
These 'are duties that
were not part ofthe
sheriff or director, or
departments' obligation
in the past and 1 want
to prevent it from being
considered in the future.'

For instance, at a May 5 special
meeting, she proposed a resolution
directing the mayor to exclude
all county employees, real prop-
erty, assets, equipment, contracts,
grants, and licenses used by the
Miami -Dade County Medical
Examiner from anytransfer agree-
ments with the newly reestablished
constitutional Office of Sheriff.
These "are duties that were not
part of the sheriff, or director, or
departments' obligations in the
past and I want to prevent it from
being considered in the future,"
Ms. Heyman said prior to unani-
mous approval of the resolution.
She also proposed a resolution
that would keep the county's
bailiffs within the county budget
and purview of the court until a
sheriff is elected. Once the con-
stitutional officer is elected, the
sheriff is to decide if that office
would take over the court security
responsibilities.
Grove's Greenstreet Cafe
loses covid insurance bid

sion, a Florida appeals court ruled
last week that an insurer was not
required to cover losses sustained
by Coconut Grove's 30-year-old
Greenstreet Cafe, which suspended
operations early in the Covid-19
pandemic.

3rd District Court of Appeal issued
a 19-page decision that sided with

The Coconut Grove landmark

Miami -Dade County and the City
of Miami blocked restaurants from

Greenstreet argued that financial
losses it sustained hrrause of the
shutdown were covered under its
"all-risk" commercial property -
insurance policy and sued Lloyd's.
A Miami -Dade County circuit judge
rejected the lawsuit, ruling that
the losses were not covered under
part of the policy that applied to
"direct physical loss of or damage
to property"
The Miami -based appeals court
upheld that decision last week.
"(Under) this court's case law and
the plain language of the policy,
loss of intended use alone does not
constitute 'direct physical loss,"
said the ruling, written by Judge
Fleur Lobree and joined by Judges
Thomas Logue and Eric Hendon.
"Instead," the oiling said "'di-
rect physical loss of or damage to
property' requires actual, tangible
alteration to the insured property
for coverage to be triggered under
the policy. Greenstreet's allegation
that it suffered economic losses due
to the City of Miami and Miami -
Dade County closure orders does
not satisfy this requirement"
The week before, a panel of the
Atlanta -based llth U.S. Circuit
Court of Appeals issued a similar
ruling in consolidated cases involv-

UM business school offers scholarships to Ukraine refugees

The University of Miami
Patti and Allan Herbert Busi-
ness School is providing two
full -tuition graduate scholarships
for the fall of 2022 to qualifying
students recentlydisplaced by the
war in Ukraine.
The two full-time scholarships
granted to Ukrainian students
would begin in August and are for
a master's in business administra-
tion (MBA) program — which has
an estimatedtotalcostof$134,032
— and a specialized master's
program, a faster -track program
in business, usually completed
in less than a year, with degree
options such as accountancy
and business analytics, costing
an estimation of S77,356. The
full -ride scholarships have been
provided by donors who wish to
remain anonymous, according to
the school.
"As a school, our mission has,
for many, many years, always
been driven by the concept of
principled leadership for our
students," said Cecilia Sanchez,
international relations manager
at Miami Herbert, "and I think
social impact is an important ele-
ment of that."
The initiative to help inter-
national students displaced by
war began in the spring semester
with last year's the events in
University of Miami's Herbert Business School offers two full-time
Afghanistan, when the school
offered two full -tuition scholar-
ships to people recently evacuated
and emigrated from the region.
The donation came from Global
Crossing Airlines Group, which
was directly involved in the
evacuation of Kabul last August
and offered fully paid tuitions to
one of Miami Herbert's master's
programs, including international
business and finance.
One ofthe two Afghan students
who received this scholarship was
Zakera Azizi, now studying for a
master's in international business,
with a US government stipend for

an opportunity for two Ukraine
refugees to study, "inspired by
that first experience that we had
last semester." Said Ms. Sanchez,
"When we saw what was hap-
pening in Ukraine, we sought out
and happily were able to, again,
find generous donations, [from
people] wanting to contribute to
the lives oftwo people who, again
would have had their lives heavily
disrupted by the war in Ukraine."
The Miami Herbert school
received 40 inquiries for the op-
portunity, fromwhicheight ornine
are strong qualifying candidates,
Ms. Sanchez said. Now, the uni-
versity is undertaking the selec-
tion of the two students receiving
the scholarships.
"Miami Herbert is absorbing
some additional costs to cover
books and instructional material
for the students," she added in a
statement. "We are lucky to have
some additional limited resources
that enables usto provide students
with a small stipend to help cover
living expenses. We welcome

County commissioners unani-
mously approved in a committee
meeting an ordinance that would
allow the mayor to continue
to designate the director of the
Miami -Dade County Corrections
and Rehabilitation Department,
or any successor department, as
the county's chief correctional
officer once a county sheriff is
elected in 2024.
The commission is tasked with
confirming or disapproving the
candidate, according to the cur-
rent Miami -Dade County's Home
Rule Charter.
"We are prohibited from taking
away responsibilities they [the
constitutional officers] have,"said
Commissioner Sally Heyman, the
sponsor of the legislation. "This
[has] not been aresponsibitity they
have ever had; we have added a
separate department."
In some Florida counties the
jurisdiction of the sheriff does
include the county jailer, but those
are smaller counties, she added.
The Corrections and Reha-
bilitation Department operates the
eighth -largest jail system in the
nation, according to its website.
An average of 4,000 to 4,200
persons are incarcerated daily in
the county's detention facilities,
which is for people awaiting trial
and serving sentences of364 days
or Tess.
"The correctional environment
is unique and requires a knowl-
edgeable correctional professional
to direct its daily work of ensur-
ing the safe, secure, and humane
detention ofmcarcerated persons,"
wrote Chief Public Safety Officer
JD Patterson in a memorandum.

already proposed legislation to
shape the functions and powers to
be excluded from the new county
sheriffs office.

sheriff or director, or
departments' obligations
in the past and 1 want
to prevent it from being
considered in the future.'

meeting, she proposed a resolution
directing the mayor to exclude
all county employees, real prop-
erty, assets, equipment, contracts,
grants, and licenses used by the
Miami -Dade County Medical
Examiner from any transfer agree-
ments with the newly reestablished
constitutional Office of Sheriff.
These "are duties that were not
part of the sheriff, or director, or
departments' obligations in the
past and 1 want to prevent it from
being considered in the future,"
Ms. Heyman said prior to unani-
mous approval of the resolution.
She also proposed a resolution
that would keep the county's
bailiffs within the county budget
and purview of the court until a
sheriff is elected. Once the con-
stitutional officer is elected, the
sheriff is to decide if that office
would take over the court security
responsibilities.
Grove's Greenstreet Cafe
loses covid insurance bid

judges reached a similar conclu-
sion, a Florida appeals court ruled
last week that an insurer was not
required to cover losses sustained
by Coconut Grove's 30-year-old
Greenstreet Cafe, which suspended
operations early in the Covid-19
pandemic.
Athree-judge panel of the state's
3rd District Court of Appeal issued
a 19-page decision that sided with
the insurer Certain Underwriters at
Lloyd's, London in the dispute with
Greenstreet
The Coconut Grove landmark
cafe and bar at the corner of Com-
modore Plaza and Main Highway
suspended operations in 2020 after
Miami -Dade County and the City
of Miami blocked restaurants from
serving customers in dining rc arts to
IrytopreventthespreadofCovid-19.
Greenstreet argued that financial
losses it sustained berate, of the
shutdown were covered under its
"all-risk" commercial property -
insurance policy and sued Lloyd's.
AMiami-Dade Countycircuitjudge
rejected the lawsuit, ruling that
the losses were not covered under
part of the policy that applied to
"direct physical loss of or damage
to property"
The Miami -based appeals court
upheld that decision last week.
"(Under) this court's case law and
the plain language of the policy,
loss of intended use alone does not
constitute 'direct physical loss,'"
said the ruling, written by Judge
Fleur Lobree and joined by Judges
Thomas Logue and Eric Hendon.
"Instead," the ruling said, "'di-
rect physical loss of or damage to
property' requires actual, tangible
alteration to the insured piopety
for coverage to be triggered under
the policy. Greenstreet's allegation
that it suffered economic losses due
to the City of Miami and Miami -
Dade County closure orders does
not satisfy this requirement"
The week before, a panel of the
Atlanta -based llth U.S. Circuit
Court of Appeals issued a similar
ruling in consolidated cases involv-
ing restamaritoperators from Destin,
Palm Beach and St Petersburg and

US producer prices surge 11% as food prices jump
