A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
BY A FOUR -FIFTHS (4/5THS) AFFIRMATIVE VOTE, AFTER AN ADVERTISED
PUBLIC HEARING, RATIFYING, APPROVING, AND CONFIRMING THE CITY
MANAGER'S FINDING AND RECOMMENDATION, ATTACHED AND
INCORPORATED AS EXHIBIT "A", THAT COMPETITIVE NEGOTIATION
METHODS AND PROCEDURES ARE NOT PRACTICABLE OR
ADVANTAGEOUS TO THE CITY OF MIAMI PURSUANT TO SECTION 18-
85(A) OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED
("CITY CODE"); WAIVING THE REQUIREMENTS FOR SAID PROCEDURES;
RECOGNIZING THE MIAMI SYMPHONY ORCHESTRA/ORQUESTA
SINFONICA DE MIAMI, INC. ("MISO") AS THE OFFICIAL SYMPHONY
ORCHESTRA/ORQUESTA SINFONICA OF THE CITY OF MIAMI;
AUTHORIZING MISO'S USE OF THE CITY SEAL PURSUANT TO SECTION 1-
16 OF THE CITY CODE; AUTHORIZING THE CITY MANAGER TO
NEGOTIATE AND EXECUTE A MEMORANDUM OF UNDERSTANDING, IN A
FORM ACCEPTABLE TO THE CITY ATTORNEY, WITH MISO
MEMORIALIZING SAID RECOGNITION AND USE OF THE CITY SEAL.

WHEREAS, the City of Miami ("City") has a diverse multilingual and multicultural
population with more than fifty percent (50%) of its residents being born outside the United
States; and
WHEREAS, music is an essential aspect of all human civilizations and has the power to
affect society emotionally, morally, and culturally; and
WHEREAS, the Miami Symphony Orchestra/Orquesta Sinfonica de Miami, Inc. ("MISO")
was founded in 1989 by the late Manuel Ochoa; and
WHEREAS, MISO's mission is to present symphonic music of consistently high-
performance standards to a culturally diverse audience in a variety of settings and formats with
the aim of educating, engaging, and enriching the community of one of the world's most
international cities; and
WHEREAS, MISO has been successful in its mission; and
WHEREAS, since 2006 the baton has been in the hands of Eduardo Marturet, a
Venezuelan composer and conductor acclaimed across three (3) continents who has continued
and expanded upon MISO's successful mission; and

WHEREAS, given the historical accomplishments of MISO, whose professional
musicians represent the exceptional talent and diversity that mirrors South Florida's
international and multicultural richness, the City wishes to recognize MISO as its official
symphony orchestra/orquesta sinfonica; and
WHEREAS, the City wishes to authorize MISO to use the City Seal pursuant to Section
1-16 of the Code of the City of Miami, Florida, as amended ("City Code"); and
WHEREAS, the City and MISO wish to execute a Memorandum of Understanding
("MOU") to memorialize said recognition and use of the City Seal; and
WHEREAS, the City Manager has made a written finding and recommendation, attached
and incorporated as Exhibit "A", pursuant to Section 18-85(a) of the City Code, that competitive
bidding is not practicable or advantageous to the City;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. By a four -fifths (4/5ths) affirmative vote, after an advertised public hearing,
the City Manager's finding and recommendation, attached and incorporated as Exhibit "A", that
competitive negotiation methods and procedures are not practicable or advantageous to the
City pursuant to Section 18-85(a) of the City Code are ratified, approved, and confirmed and the
requirements for said procedures are waived.
Section 3. The City recognizes MISO as its official symphony orchestra/orquesta
sinfonica.
Section 4. The City authorizes MISO to use the City Seal pursuant to Section 1-16 of
the City Code.
Section 5. The City Manager is authorized' to negotiate and execute a MOU, in a form
acceptable to the City Attorney, memorializing said recognition and use of the City Seal.
Section 6. This Resolution shall become effective immediately upon its adoption.
1 The herein authorization is further subject to compliance with all legal requirements that may be
imposed including, but not limited to, those prescribed by applicable City Charter and City Code
provisions.
