perpetual sidewalk easements from:

Fernando Ortega for 3201 McDonald Street
for ongoing Capital Improvement Project 40-B173641 in the construction phase.
Background of Item:
Perpetual sidewalk easements are required from the private property owners for the
abutting property having the street addresses listed on the attached Exhibit A, allowing
the City access and use of the property for the construction and maintenance of various
ongoing Capital Improvement Projects.

A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE CITY
MANAGER TO ACCEPT PERPETUAL SIDEWALK AND UTILITIES EASEMENTS, IN
FORMS ACCEPTABLE TO THE CITY ATTORNEY, FROM THE PRIVATE PROPERTY
OWNERS OF 3201 DAY AVENUE, 3201 MCDONALD STREET, AND 3203
MCDONALD STREET, MIAMI, FLORIDA, ALLOWING THE CITY OF MIAMI ACCESS
AND USE OF THE PROPERTIES FOR THE CONSTRUCTION AND MAINTENANCE
OF OFFICE OF CAPITAL IMPROVEMENTS PROJECT NO. 40-B173641 AND
ENSURING PUBLIC INGRESS AND EGRESS.
WHEREAS, the City of Miami's ("City") Office of Capital Improvements Project No. 40-
B173641, Traffic Calming Circle at McDonald Street and Day Avenue ("Project"), includes a
traffic circle with drainage improvements, new sidewalks, new curbs and gutters, and
landscaping; and
WHEREAS, perpetual sidewalk and utilities easements are required from the private
property owners of 3201 Day Avenue, 3201 McDonald Street, and 3203 McDonald Street,
Miami, Florida, to allow the City access and use of the properties for the construction and
maintenance of the Project and to ensure public ingress and egress;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized' to accept perpetual sidewalk and utilities
easements, in forms acceptable to the City Attorney, from the private property owners of 3201
Day Avenue, 3201 McDonald Street, and 3203 McDonald Street, Miami, Florida.
Section 3. This Resolution shall become effective immediately upon its adoption.
