Luci C. Gomez for 3119 SW 24th Street
Natalia Boachea and Armando Bonachea for 2877 SW 24th Street
For ongoing Capital Improvement Project 40-B50412 in the construction phase.
Background of Item:
Perpetual sidewalk easements are required from the private property owners for the
abutting properties having the street addresses listed on the attached Exhibit A,
allowing the City access and use of the property for the construction and maintenance
of various ongoing Capital Improvement Projects.

A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE CITY
MANAGER TO ACCEPT PERPETUAL SIDEWALK AND UTILITIES EASEMENTS, IN
FORMS ACCEPTABLE TO THE CITY ATTORNEY, FROM THE PRIVATE PROPERTY
OWNERS OF 2895 SOUTHWEST 23 TERRACE, 2897 SOUTHWEST 23 TERRACE,
2835 SOUTHWEST 23 TERRACE, AND 2837 SOUTHWEST 23 TERRACE, MIAMI,
FLORIDA ALLOWING THE CITY OF MIAMI ACCESS AND USE OF THE
PROPERTIES FOR THE CONSTRUCTION AND MAINTENANCE OF OFFICE OF
CAPITAL IMPROVEMENTS PROJECT NO. 40-B50412 AND ENSURING PUBLIC
INGRESS AND EGRESS.
WHEREAS, the City of Miami's ("City") Office of Capital Improvements Project No. 40-
B50412, Southwest 23 Terrace From Southwest 27 Avenue To Southwest 32 Avenue
("Project"), includes the installation of two thousand seven hundred (2,700) linear feet of water
mains, sidewalks, curbs, a drainage system, milling and resurfacing, reconstruction, overbuild,
pavement marking, landscaping, and sodding; and
WHEREAS, perpetual sidewalk and utilities easements are required from the private
property owners of 2895 Southwest 23 Terrace, 2897 Southwest 23 Terrace, 2835 Southwest
23 Terrace, and 2837 Southwest 23 Terrace, Miami, Florida to allow the City access and use of
the properties for the construction and maintenance of the Project and to ensure public ingress
and egress;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized1 to accept perpetual sidewalk and utilities
easements, in forms acceptable to the City Attorney, from the private property owners of 2895
Southwest 23 Terrace, 2897 Southwest 23 Terrace, 2835 Southwest 23 Terrace, and 2837
Southwest 23 Terrace, Miami, Florida.
Section 3. This Resolution shall become effective immediately upon its adoption.
1 The herein authorization is further subject to compliance with all legal requirements that may be
imposed, including but not limited to those prescribed by applicable City Charter and City Code
provisions.
