HomeMy WebLinkAboutR-22-0163City of Miami Resolution R-22-0163 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 11869 Final Action Date: 5/12/2022 A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE CITY MANAGER TO ACCEPT PERPETUAL SIDEWALK AND UTILITIES EASEMENTS, IN FORMS ACCEPTABLE TO THE CITY ATTORNEY, FROM THE PRIVATE PROPERTY OWNERS OF 2790 SOUTHWEST 23 TERRACE, 2792 SOUTHWEST 23 TERRACE, 3195 SOUTHWEST 24 STREET, 3117 SOUTHWEST 24 STREET, 3119 SOUTHWEST 24 STREET, AND 2827 SOUTHWEST 24 STREET, MIAMI, FLORIDA, ALLOWING THE CITY OF MIAMI ACCESS AND USE OF THE PROPERTIES FOR THE CONSTRUCTION AND MAINTENANCE OF OFFICE OF CAPITAL IMPROVEMENTS PROJECT NO. 40-B50413 AND ENSURING PUBLIC INGRESS AND EGRESS. WHEREAS, the City of Miami's ("City") Office of Capital Improvements Project No. 40- B50413, Southwest 24 Street From Southwest 27 Avenue to Southwest 32 Avenue ("Project"), includes the installation of an eight (8) inch water main, driveways, sidewalks, curbs, a drainage system, milling and resurfacing, reconstruction, overbuild, pavement marking, and swale regrading and sodding; and WHEREAS, perpetual sidewalk and utilities easements are required from the private property owners of 2790 Southwest 23 Terrace, 2792 Southwest 23 Terrace, 3195 Southwest 24 Street, 3117 Southwest 24 Street, 3119 Southwest 24 Street, and 2827 Southwest 24 Street, Miami, Florida, to allow the City access and use of the properties for the construction and maintenance of the Project and to ensure public ingress and egress; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized1 to accept perpetual sidewalk and utilities easements, in forms acceptable to the City Attorney, from the private property owners of 2790 Southwest 23 Terrace, 2792 Southwest 23 Terrace, 3195 Southwest 24 Street, 3117 Southwest 24 Street, 3119 Southwest 24 Street, and 2827 Southwest 24 Street, Miami, Florida. Section 3. This Resolution shall become effective immediately upon its adoption. 1 The herein authorization is further subject to compliance with all legal requirements that may be imposed, including but not limited to those prescribed by applicable City Charter and City Code provisions.
