HomeMy WebLinkAboutR-22-0162City of Miami Resolution R-22-0162 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 11868 Final Action Date: 5/12/2022 A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE CITY MANAGER TO ACCEPT A PERPETUAL SIDEWALK AND UTILITIES EASEMENT, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FROM THE PRIVATE PROPERTY OWNER OF 2145 NORTHWEST 37 STREET, MIAMI, ALLOWING THE CITY ACCESS AND USE OF THE PROPERTY FOR THE CONSTRUCTION AND MAINTENANCE OF OFFICE OF CAPITAL IMPROVEMENTS PROJECT NO. 40-B50113 AND ENSURING PUBLIC INGRESS AND EGRESS. WHEREAS, the City of Miami's ("City") Office of Capital Improvements Project No. 40- B50113, Northwest 21 Court Improvements ("Project"), includes right-of-way reconstruction, curb replacement, and drainage as needed; and WHEREAS, a perpetual sidewalk and utilities easement is required from the private property owner of 2145 Northwest 37 Street, Miami, Florida to allow the City access and use of the property for the construction and maintenance of the Project and to ensure public ingress and egress; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized' to accept a perpetual sidewalk and utilities easement from the private property owner of 2145 Northwest 37 Street, Miami, Florida. Section 3. This Resolution shall become effective immediately upon its adoption.
