Background of Item: There are natural and man-made challenges faced by the City of Miami's ("City") Police Department ("MPD") and the City of North Miami's ("NMPD") Police Department that are, or are likely to be, beyond the control of the services, personnel, equipment, or facilities of the City of North Miami ("North Miami"). The City and North Miami wish to enter into a Combined Voluntary Cooperation and Operational Assistance Mutual Aid Agreement ("MAA") to ensure that preparation and resources from both respective law enforcement agencies will be adequate to address natural and man-made challenges, protect public peace and safety, and to preserve the lives and property of the people of the City and North Miami. The City and North Miami have the authority under the Florida Mutual Aid Act, Chapter 23, Part 1, Sections 23.12-23.127, Florida Statutes, to enter into the MAA. The City and North Miami have the authority under the Florida Interlocal Cooperation Act of 1969, promulgated under Section 163.01, Florida Statutes, to enter into interlocal agreements for the purposes of permitting local governmental units to make the most efficient use of their powers by enabling them to cooperate with other localities on a basis of mutual advantage and thereby to provide services and facilities in a manner and pursuant to forms of governmental organization that will accord best with geographic, economic population, and other factors influencing the needs of the local communities. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized to execute the Mutual Aid Agreement, in substantially the attached form, with North Miami to receive and extend mutual aid in the form of law enforcement services and resources to ensure public safety and the ability to adequately respond to intensive situations, including but not limited to, natural or man-made disasters or emergencies as defined in Chapter 23, Part 1, Florida Statutes. Section 3. The City Manager is further authorized to negotiate and execute any and all other documents related to the Mutual Aid Agreement, in a form acceptable to the City Attorney, as may be necessary for said purpose. Section 4. This Resolution shall become effective immediately upon its adoption.2 APPROVED AS TO FORM AND CORRECTNESS: ndez, City Httor ey 4/10/2022 1 The herein authorization is further subject to compliance with all legal requirements that may be imposed, including but not limited to those prescribed by applicable City Charter and City Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
