HomeMy WebLinkAboutExhibit ACITY OF MIAMI, FLORIDA INTER -OFFICE MEMORANDUM TO: Arthur Noriega V , DATE: April 15, 2022 City Manager FROM: Barbara Hernande Director, Parks and reation Department REFERENCES: SUBJECT: Approval of finding to waive competitive sealed bidding procedures for Biscayne Park Improvements ENCLOSURES: The Department of Parks and Recreation and the Department of Real Estate and Asset Management ("Departments"), on behalf of the City of Miami ("City"), respectfully request your approval and action of the Miami City Commission by a 4/5ths affirmative vote , after an advertised public hearing ratifying, approving, and confirming the recommendation and finding that competitive sealed bidding methods are not practicable or advantageous to the City, pursuant to Section 18-85(a) of the Code of the City; waiving the requirements for said procedures; authorizing the City Manager to execute a Donation and Construction Agreement, and a Parks Programming Agreement with Perpetual Love L Trust, LLC. On October 22, 2020, the City Commission passed Resolution No. R-20-0352 directing the City Manager to commence negotiations with the David and Leila Centner Family Foundation Inc. ("Foundation") for a donation of $10,000,000 to invest in a City of Miami Park space. As a result of such resolution, the Departments have negotiated a Donation and Construction Agreement, and a Parks Programming Agreement to be entered into with Perpetual Love L Trust, LLC, an affiliate of the Foundation, ("Centner") whereby the City will receive significant improvements to the City -owned and operated Biscayne Park that will be valued at $10,000,000 or more and Centner will conduct programming, will be responsible for the cost of maintenance, operations, and security, and will operate concessions at the park for ten years. In light of the above mentioned, and pursuant to Section 18-85, as amended, it is respectfully recommended that you, as the City Manager, waive competitive sealed bidding methods, via the written findings and reasons stated herein. Said waiver shall need to be ratified, confirmed, and approved by the City Commission, by a four -fifths (4/5ths) affirmative vote, during an advertised public hearing.
