Background of Item: The City of Miami ("City") is the owner of property located at 1250 NW 20 Street, in Miami -Dade County, Florida ("Property"). Florida Power & Light ("FPL") has requested the grant of approximately two hundred ninety (290) square foot ("Easement"), perpetual, non-exclusive easement on City -owned property. This easement will be used for the construction, operation and maintenance of underground electric, and appurtenant above ground equipment with the right to reconstruct, improve, change and remove all or any of the facilities within the easement. WHEREAS, the City of Miami ("City") is the owner of property located at 1250 Northwest 20 Street, Miami, Florida (Folio No. 01-3135-001-0010) ("Property"); and WHEREAS, Florida Power & Light Company, a for -profit Florida corporation ("FPL"), has requested the grant of a perpetual, non-exclusive easement of approximately two hundred ninety (290) square feet located at the Property ("Easement"), as more particularly described in Exhibit "A", attached and incorporated ("Easement Area"); and WHEREAS, the purpose of the Easement is for the construction, operation, and maintenance of underground electric utility facilities (including cables, conduits, appurtenant equipment, and appurtenant above ground equipment) in accordance with the terms and conditions of the Easement; and WHEREAS, the Easement shall be granted to implement a project of a governmental agency or instrumentality in accordance with Section 29-B(c) of the Charter of the City of Miami, Florida, as amended ("City Charter"); NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated herein as if fully set forth in this Section. Section 2.
