PURPOSE: This Ordinance will amend Table 4 "Density, Intensity and Parking" to change the
amount that the parking ratio may be reduced within a Transit Oriented Development ("TOD")
area or within a transit corridor.

AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING
ORDINANCE NO. 13114, THE ZONING ORDINANCE OF THE CITY OF
MIAMI, FLORIDA, AS AMENDED; MORE SPECIFICALLY BY
AMENDING TABLE 4, TITLED "DENSITY, INTENSITY AND PARKING,"
TO CHANGE THE METHOD BY WHICH THE PARKING RATIO MAY BE
REDUCED WITHIN A TRANSIT ORIENTED DEVELOPMENT AREA OR
WITHIN A TRANSIT CORRIDOR FROM A WAIVER PROCESS TO THE
PROCESS OF AN EXCEPTION WITH CITY COMMISSION APPROVAL;
CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN
IMMEDIATE EFFECTIVE DATE.
WHEREAS, the Planning, Zoning and Appeals Board ("PZAB"), at its meeting on
February 2, 2022, following an advertised public hearing, adopted Resolution No. PZAB-R-22-
007 by a vote of nine to two (9-2), Item No. PZAB. 2, recommending denial of the proposed
amendment stated herein; and
WHEREAS, the City Commission has considered whether the proposed text amendment
stated herein will further the goals, objectives, and policies of the Miami Comprehensive
Neighborhood Plan ("MCNP"), Ordinance No. 13114, the Zoning Ordinance of the City of Miami,
Florida, as amended ("Miami 21 Code"), and other City of Miami ("City") regulations; and
WHEREAS, the City Commission has considered the need and justification for the
proposed text amendment stated herein, including changed or changing conditions that make
the passage of this ordinance necessary; and
WHEREAS, the City Commission finds that it is in the best interest of the City and its
residents to amend the Miami 21 Code for the purpose stated herein;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Ordinance are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. Article 4, Table 4 of the Miami 21 Code is amended in the following
particulars:1

Section 3. If any section, part of a section, paragraph, clause, phrase, or word of this
Ordinance is declared invalid, the remaining provisions of the Ordinance shall not be affected.
Section 4. New Developments under review by the City that have completed prescreen
review within ePlan prior to May 2022 shall be vested under previous parking reduction
standards.
Section 5. This Ordinance shall become effective immediately after the adoption
thereof.2
