Waste -to -energy plant to be replaced, perhaps elsewhere

Miami -Dade is looking to
replace its Resources Recovery
Facility, located in Doral since
1982, with a state-of-the-art
waste -to -energy plant on the
same or a different site. The
county aims for a mass burn
combustion plant that is more
efficient than the existing
refuse -derived fuel plant, said
Michael J. Fernandez, director
of the Solid Waste Management
Department.
County commissioners ap-
proved a resolution directing
the administration to develop
and issue a request for informa-
tion within 60 days for design
criteria professionals to create a
design criteria package for new
waste -to -energy plant.
Doral residents urged com-
mission Chairman Jose "Pepe"
Diaz, who sponsored the resolu-
tion, to explore locations out-
side ofthe city after the original
document said the replacement
plant should be on the same site.

sented health and environmental
concerns.
"We're asking you to all
please reconsider relocating
the new plan somewhere else in
the county and spare the Doral
residents of having this new
plan in our backyard," Odell
Torres, a Doral resident, told
the committee meeting.
The facility, which began
commercial operations in 1985,
is being run by Covanta Dade
Renewable Energy LTD. In July
2012, the county authorized a
Fourth Amended and Restated
Operations and Management
Agreement between the county
and Covanta.
Although the existing waste -
to -energy plant might operate
for another 10 years, the county
is still interested in designing,
constructing and operating a
state-of-the-art facility.
The Miami -Dade Department
of Solid Waste Management
2020 Master Plan recommended
construction of a new waste to
energy facility to meet the future
demand of county residents, the
resolution says.
A preliminary estimated cost
for a 4,000-ton-plus, state-of-

Chairman Diaz faced criti-
cism before presenting the
amendment to search for other
locations for the facility.
"We believe that the county
should not be throwing taxpayer
money at an outdated industry
that harms public health; it
emits greenhouse gases that
worsen the climate crisis,"
said Dominique Burkhardt, an
attorney with Earthjustice, a
nonprofit environmental law
organization.
"One issue that I wholeheart-
edly understand is the smell and
the odor and the discomfort,"
Mr. Diaz said. "We went to the
one plant that [the company]
says that they had the latest
technology, produces a lot of
electricity, it pays for itself and
then some, which is not a burden
on the taxpayer. It has no smell
at all and does not produce the
pollutants outside that plant."
Commissioners Rebeca Sosa
and Raquel Regalado supported
Mr. Diaz's amendment to look
at other areas and recognized
that relocating the facility is a
countywide concern.
"This topic really does im-
pact every single district," Ms.
Regalado said. "There are those
of us that are dealing with old
incinerators and the debris and
the toxicity that they left behind.
There are areas represented by
some commissioners here that
have landfills. 1 represent an
area that has a water treatment
facility in Key Biscayne."
In a separate memorandum,
Mayor Daniella Levine Cava
acknowledges that the admin-
istration agreed that the county
needs to construct a new waste -
to -energy plant to replace the
plant currently operated by
Covanta in Doral and says the
existing plant must be renovated
and upgraded so that it can con-
tinue to operate while a new one
is being constructed.

the process of planning for a
replacement WTE [waste -to -
energy] plant," the mayor wrote.
"Currently, the Department of
Solid Waste Management and
the Internal Services Depart-
ment are preparing a solicitation
to obtain planning expertise for
this project and are also explor-
ing using the services ofthe ex-
isting bond engineer for DS WM
to expedite the process."
In the meantime, county staff
would explore the best way to
obtain the new plant, taking into
account that there is no dedi-
cated source of funds for this
kind of project and that the fed-
eral dollars from the bipartisan
infrastructure bill don't include
funding solid waste projects.
Since the facilities generate
energy that can be monetized,
there could be an opportunity for
a public private partnership to
build the plant, the mayor wrote
in her memorandum.

J&J suspends COVID-19 vaccine sales forecast

casts for its COVID-l9
vaccine only a few
months after saying
the shot could bring in
as much as 53.5 billion
this year.
A global supply sur-
plus and uncertainty
about future demand

the change, J&J said

pany also reported a
better-than-expect-
ed first-quarter profit
and announced a div-
idend increase.
J&J's one-shot vac-
cine brought in 5457
million in global sales

ny's pharmaceutical

lion.
The vaccine regis-
tered only 575 million
in sales in the US-, or
about 25% less than
what it rang up after
debuting in last year's
first quarter.
J&J has said it

Law changes universities' accreditation, professors' tenure

Saying organizations that accredit
colleges and universities have an
"inordinate amount ofpower," Gov.
Ron DeSantis signed a bill Tuesday
that will force schools to periodical ly
change accreditors.
The measure also significantly
changes the process of reviewing
professors' tenure, a provision that
hasdrawn ire from the state's largest
faculty union.

said during a bill -signing event in

Colleges and universities under
the law will be required to change
accreditors at the end of each ac-
creditation cycle, a prixo ss that can
take as long as 10 years. The law
will take effect July 1.
The state university system's
Board of Governors and the State
Board ofEducation, which oversees
thecolege system, willbedirectedto
identify organizations that are "best
suited to serve" as accreditors for
the schools. The accrediting bodies
will have to be recognized by the US
Department of Education.
The governor took aim at accredi-
tors before signing the measure.
"The role that these accreditation
agencies play, I don't even know
where they come from. I mean,
they... are effectively self -anointed.
They have an inordinate amount of
power to shape what is going on at
these universities," he said
The Southern Association ofCol-
leges and Schools Commission on
Colleges, or SACSCOC, accredits
Florida's colleges and universities.

for underperfomnance."
"I think the thing is, you know,
tenure was thereto protect people so
that they could do ideas that maybe
would cause them to lose their job or
whatever, and acadanic freedom,"
Gov. DeSantis saidTuesday. "I don't
know that that's really the role that
it plays, quite frankly, anymore. I
think what tenure does, if anything,
it's created more of an intellectual
orthodoxy."
The governor's approval of the
bill drew an immediate objection
from United Faculty of Florida
President Andrew Gothard The
union has argued that individual
schools already have processes to
review faculty tenure.
"All of Florida's faculty already
undergo an extensive performance
reviewpronocs tenuredorotherwise;
they are already held accountable
by their peers and employers," Mr.
Gothard said in a statement. "The
only missing piece in that equation
is that tenured faculty cannot be fired
for political reasons, meaning the
passing whimLs ofthe latest politician
in power cannot be used to hams
the future of Honda's studaits and
institutions."
Mr. Gothard, who is a professor
at Florida Atlantic University, also
criticized state leaders for "playing
political games" with the futures of
university students.

Business travel projected 11% below 2019

The Covid-19 pandemic con-
tinues to hamper business travel
in Florida and across the country.
A report released Tuesday said
revenue from business travel in
Florida in 2022 is projected to be
11.1%below the amount in 2019,
the last full year before the pan-
demic. Nationally, business -travel
revenue is projected to be down
23.1 %, according to the report re-
leased by the American Hotel and
Lodging Association.
Carol Dover, president and CEO
ofthe Florida Restaurant and L odg-
ing Association, issued a statement
that encouraged businesses to come
to Florida for such things as confer-
ences and events.
"Florida remains a top destina-
tion for both leisure and business
travel, but today's projections have
Florida ending the year 1 I % down
for business travel," Ms. Dover said
"We are incredibly proud of
Florida's comeback story, but this
report reiterates that there is more
work to get usback topre-pandemic
figures," she said. "Business and
corporate group travel is the leading
source ofrevenue for hotels, which
have endured years of catastrophic
losses and now face inflation,
supply chain issues, and staffing
shortages"
The report said Florida is pro-
jected to have S7.75 billion in
business -travel revenue in 2022,
down from nearly S8.72 billion
in 2019.

tander, al norte de Colom-
bia. Cuando tenia 14 anos
iba en la parte de atras de
un automovil y una bale
perdida, disparada por
un policia ebrio, 10 dejo
inmovilizado de la cintura
hacia abajo.
Aunque los primeros
anos fueron muy dffici-
les, de duelo, resignation
y aceptacion, asegura que
siempre quiso ser inde-
pendiente, y mientras su
familia dormia el inten-
taba sentarse solo para no
seguir pidiendo ayuda. Y
asi to hizo.
Lo intento tantas veces
hasta que lo 'ogre. Luego,
con mas esfuerzo y en si-
lencio, pudo pasarse a la
silla de ruedas, y meses
mas tarde; aprovechando
el viaje de sus padres fuera
de la eluded, se subio al
carro y logre conducir con
la ayuda de un palo de es-
coba. En ese instante deci-
die que nada lo detendria,
y que el estar en una silla
de ruedas era solo un obs-
taculo, pero no era su fmal.

gunta por que me paso

eso. Quiero vivir para hacer

mos decideviajar al sur de la
Florida para prober suerte.
No estaba claro si se queda-
ria o regresaria a su tierra
natal pero las cosas se fue-
ron dando hasta que toda su
familia logro instalarse en

desarrollo personal, emo-
clonal y profesionalmente.

Anos mas tarde, decidio
mostrarles a sus amigos los
escritos que tenia guarda-
dos y ellos lo impulsaron a
ponerle musica "Uno de mis
amigos estaba aprendiendo
a tocar guitarra y mientras
yo la cantaba le sacabamos
los acordes a cada una de las
piezas".
Cuando tenian varias can-
ciones completes, se pre-
sentaban en fiestas (donde
admite muchas veces no
habian sido invitados) pero
comenzaban a cantor sus
temas tropicales, asi como
cover de piezas conocidas,
por lo que no era ram verlo
en Weston. "Asi nos fuimos
dando a conocer. mezclaba
canciones propias con pie-
zas conocidas para que la
gente disfrutara. De esos
dias salio el nombre de la
banda. Porque donde esta-
bamos comenzaba la fiesta,
la celebration me entonces
muchas veces nos decian
que nosotros eramos males
influencias, por lo que de-
cidimos que no, que somos
de las buenas, y asi nacio

Court rejects suit of Miami Dade College over covid fees

In one ofnumerous cases stemming from
campus shutdowns during the early months
ofthe Covid- 19 pandemic, an appeals court
last week rejected a potential class-action
lawsuit against Miami Dade College over
fees collected from students in 2020.
A three judge panel of the 3rd District
Court of Appeal ordered the dismissal of
the lawsuit filed by Fernando Verdini, a
Miami Dade College nursing student who
was required to learn remotely in the spring
and summer of 2020 after the pandemic
hit the state.
Like similar lawsuits filed in Florida and
other states, Mr. Verdini alleged a breach
of contract because he paid fees for on -
campus services that were not provided
during the shutdown. The case involved
fees for such things as student services,
capital improvements and technology. It
did not involve tuition.
Miami -Dade Circuit Judge William
Thomas last year refused to dismiss the
case, but the appeals court said Miami
Dade College was shielded by sover-
eign immunity, which generally protects
government agencies from lawsuits. The
appeals court said sovereign immunity
blocks such a lawsuit "in the absence of
an express contract"
"Because Appellee Fernando Verdini has
not alleged breach of an express, written
contract to provide on -campus or in -person
services sufficient to overcome sovereign
immunity, we reverse (the circuit judge's
refusal to dismiss the case)," said the
16-page ruling, written by Judge Norma
Lindsey and joined by Judges Kevin Emas
and Monica Gordo.
Mr. Verdini supported his breach -of -
contract allegations with documents such as
invoices that detailed the fees. In declining
to dismiss the case, Judge Thomas pointed
to those invoices.
"It is the finding of the court that plain-
tiffs invoices, as attached to the complaint,
sufficiently contain the express written
terms and provide the specific services
MDC (Miami Dade College) was contrac-
tually obligated to provide in exchange for
plaintiff's payment of 'fees' to survive a
motion to dismiss," Judge Thomas wrote.
But the appeals court said last week
that the "issue here is whether Verdini has
sufficiently identified an express, written
contract to provide on -campus or in -person
services."
"As an initial matter, there is noth-
ing in the complaint or the attachments
that expressly requires MDC to provide
on -campus services in exchange for the
student services, financial aid, capital
improvement, and technology fees," the
ruling said. "Moreover, Verdini has not
identified anything that expressly prohibits
MDC from providing remote services in
exchange for these fees."
Judges have taken differing stances on
whether colleges and universities breached
contracts when they required students to
learn remotely to try to prevent the spread
of Covid-19.
For example, an Alachua County cir-
cuit judge in October refused to dismiss a
potential -class action lawsuit against the
UniversityofFlorida. As in the Miami Dade
College case, attorneys for the university
argued that the school was shielded by
sovereign immunity. The university has
taken that case to the 1st District Court
of Appeal.

novel introduces a cast ofdeeply
imagined characters that linger
in the mind.
Mungo, the 15-year-old main
character, remains somehow
untouched by this environment.
"Mungo had all this love to
give," Mr. Stuart writes, "and
it lay about him like ripened
fruit and nobody bothered to
gather it up."
He's the youngest child of a
coarse, narcissistic drunkard her
children call Mo-Maw.
"Sometimes," Mr. Stuart
writes, "Mo-Maw could get so
far in the drink that she would
become another woman entirely,
another creature altogether. The
first sign was how her skin grew
slack, like her real face was
sliding off to reveal this strange
woman who lurked underneath.
Mungo and his brother and sister
called this slack version of her
Tattie-bogle, like some heart-
less, shambling scarecrow. No
matter how her children stuffed
her with their love or tried to
prop her up and gather her back
together, she took in all their
care and attention and felt as
hollow as ever."
Jodie, the middle child and
only girl, is the family's real
center, struggling to keep food
on the table and some semblance
of order — a role that has made
her much more mature than
Mungo, though she's only a
year older.
The oldest of Mo-Maw's
children, Hamish, is Mungo's
temperamental opposite. As
chieftain of a Protestant street
gang, he's committed to acts of
aggression and brutality against
Catholics, cops and anyone
somehow different.
In a lively description of the
gang's demolition of a local
builder's yard, Mr. Stuart re-
veals an understanding of the
unspoken "parasitic relation-
ship" that governs Hamish's
world:
"The boys smashed and stole
what they liked, and the fore-
man claimed the damage on
insurance and still came out in
the black in his account books.
Hamish knew there were times
the canny foreman used the raids
to replace outdated models, or
tools that were half -broken and
would cost more to mend than
to replace. Hamish had seen him
once, in the Louden Tavern, and
the man had nodded a faint head
bob of respect. Twice a year, no
more. It was still cheaper than
hiring a night watchman."
When Mungo falls in love
with James, a sensitive Catholic
boy from a neighboring tene-
ment, he finds himself walking
a thin line between his feelings
and his family's attempts to
"make a man of him" — a pur-
suit that turns perilous when
Mo-Maw sends him off on an
improvised fishing trip with two
menacing strangers.
Douglas Stuart's first novel,

Miami -Dade commissioners have co -designating South Miami Avenue from Southeast 15th Road to
13th Street "Alicia Cervera Way" in honor of real estate pioneer Alicia Cervera Sr., 92, who launched the
Cervera Real Estate brokerage in 1969. In her career she has worked with 85 developers and handled
sales for more than 115 high-rise condominium towers, representing 521 billion in sales of more than
70,000 unhs. Alicia Cervera Way street signs were unveiled during a ceremony her family held last week.
Costs grow to design
Gables mobility hub

for the Coral Gables Mobility Hub
projected were approved last week
by city commissioners, costing an
additional S640,000.
During the meeting, City Man-
ager Peter J. Iglesias explained to
city officials that the project's scope
has been increased to allow for an
enhanced rooftop park, micro -mo-
bility, and electric vehicle charging
infrastructure.
The building's adaptive reuse
capability has been thoroughly
developed through multiple design
iterations and will result in an easily
convertible building that can evolve
with the needs of the city over time,

Design consultants M. Arthur
Gensler Jr. & Associates Inc. were
initially paid S2 million to design the
mobility hub and now will receive
the additional funds to redesign the
new renderings.

The Coal Gables MobilityHubm,
is set for 245 Andalusia Ave., is
projected to be completed by the
first quarter of 2024. The city has
signed an agreement with Weitz
Company to manage construction,
including demolition of the existing
parking garage where the hub will
rise — costing the city an additional
51.5 million.
The hub is to have an internal
drive-thru lane for ridesharing
services, retail and bicycle storage.
It will also offer dockless vehicle
parking, bikesharedocking stations,
awi-fi lounge, e-conmterce logistics
for drone package deliveries and
pop-up coffee shops.
City staff recently met with the
Florida Department of Transporta-
tion(FDOT), whichwasthoroughly
impressed and encouraged the city
to apply for federal grant monies,
said Naomi Levi -Garcia, assistant
city attorney and intergovernmental
affairs manager.
"We are about to do the deadline
for the raise grant," she said "We
will be seeking 1 believe S6 million
from that grant and hopefully we'll
be successfid. So, it checks off all the
boxes in terms of being a multimodal
facility, bringing the trolley into play
and just creating lots ofoppotunities
for people to get around outside of
their cars."
The city is also working with a
federal lobbyist, who is actively
looking for grants and monies to
fund a project like this that checks
all the boxes for federal funding, Mr.
Iglesias added
"We have no prior resolution on
the demolition or demolition plans.
The reason why we do not proceed
is hrmnsr in our meetings with the
FDOT federal procurement, we
cannot bid out the contract and then
go back and try to make a federal
procurement," he said "So, it's very
important that we have the time to
make sure that we have the proper
bidding or the proper GMP (good
rnanufacturingpracticesqxocechires
to make sure that we qualify for that
federal finding."

tirse en profesional, es el
otro gran reto para enfren-
tar para incorporarse al re-
novado mundo laboral.
Los cambios que la revo-
lucion digital ha impuesto
en el mundo y el paso de la
pandemia de coronavirus
han ampliado el panorama
laboral con nuevos forma-
tos que pretenden mejorar
la comunicacion, acelerar
los procesos y mejorar la
calidad del servicio.
El trabajo remoto y el
coworking son solo algu-
nos, a los cuales incor-
poramos la inteligencia
artificial, con el surgi-

Sin embargo, el camino no
siempre resulta facil para
todos, gran parte de nues-
tros alumnos combinan

SE DEFINE EN EL CONTRATO DE ARRENDAMIENTO COMERCIAL ENTRE LA CIUDAD Y MFP
("CONTRATO DE ARRENDAMIENTO COMERCIAL"), AUTORIZADO POR LA COMISION MU-
NICIPAL PARA QUE EL ADMINISTRADOR DE LA CIUDAD NEGOCIE Y EJECUTE SIMULTAN-
EAMENTE CON ESTE CONTRATO DE ACCESO Y SERVICIOS PUBLICOS DEL DERECHO DE
PASO 0 (2) AL VENCIMIENTO DEL PLAZO DE CUALQUIER SUBARRENDAMIENTO EN VIGOR
Y SUJETO A UN ACUERDO DE NO INTERRUPCION, DEFINIDO EN EL CONTRATO DE ARREN-
DAMIENTO COMERCIAL.
Se invita a todas las personas interesadas a participar en la reunion para que puedan ser escucha-
das con respecto a la resolucion propuesta. Si una persona desea apelar cualquier decision de
la Comision Municipal con respecto a algun asunto que se vaya a analizar en esta reunion, esa
persona debera asegurarse de que se haga un registro textual de los procesos, incluidos todos los
testimonios y pruebas en las que cualquier recurso pueda basarse (F.S. 286.0105).
De conformidad con la Ley de Estadounidenses con Discapacidades de 1990, las personas
