A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
EXTENDING THE PILOT PROGRAM ESTABLISHED PURSUANT TO
SECTION 31-51 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS
AMENDED, TITLED"FOOD TRUCKS OPERATING ON PRIVATE LAND, FOR
THE FINAL YEAR TO ALLOW FOR APPLICATION -BASED MEAL
PRODUCTION SITES TO OCCUR IN PARKING LOTS OR ON PRIVATE
LANDS.
WHEREAS, pursuant to Ordinance No. 13993 adopted on April 22, 2021, the City.
Commission established Section 31-51(h) of the Code of the City of Miami, Florida S ' t
amended ("City Code"), titled "Pilot Program for App-Based Mobile Operations," cr'-!ating ari
Application -Based Meal Production pilot program that will automatically sunset onLMarch 40.
2022, and
WHEREAS, for the past year, Application -Based Meal Production operations .have;,
flourished and provided a much -needed option for the City of Miami ("City"); and

WHEREAS, the mobile units only provide food to delivery services and do not provide
any on -site or take out services to the general pubic, and
WHEREAS, these operations are required to obtain permits and Business Tax
Receipts from the City to operate; and
WHEREAS, the City Manager has provided statistics showing the number of people
employed, number of participating sites with sales amounts, and the number of code violations
issued at legally established Application -Based Meal Production sites, attached and incorporated
as Exhibit "A"; and
WHEREAS, Section 31-51(h)(5) of the City Code provides for one (1) extension of the
pilot program for a period of one (1) year, and
WHEREAS, the City, its residents, and visitors have benefited from the Application -
Based Food Production sites as they provide a conduit for restaurants to get their food out to
a wider population base in the City;
NOW. THEREFORE. BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI. FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The Pilot Program for Application -Based Mobile Operations pursuant to
Section 31-51(h)(5) of the City Code is extended for a final period of one (1) year from the

WHEREAS, pursuant to Ordinance No. 13993, adopted on April 2 2021, the City L

Section 3. This Resolution shall become effective immediately upon its adoption and

' If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
