PZ-18-384 09/01/20 Re: LETTER OF INTENT Renewal of the Certificate of Use for the Property Located at 116 NW 52 Street / Nonconforming Use Pilot Program Dear Mr. Cejas: We represent Capital Development Group (the "Purchaser") in connection with the potential purchase of the properties located at 116 NW 52 Street and 123 NW 51 Street (collectively, the "Property"), as identified by the survey attached hereto as Exhibit A. The Property contains an existing 21,420 sq. ft. structure and ancillary surface parking lot serving said structure. The Property is currently under contract for sale to the Purchaser; however, previous owners/tenants allowed the Certificate of Use (the "CU") to lapse at the Property. The City of Miami has established the Nonconforming Use Pilot Program in order to encourage economic development. The Nonconforming Use Pilot Program is codified in Section 2-212 of the City Code. Pursuant to Section 2- 212(c), CUs for nonconforming uses that have lapsed for a period of more than eighteen (18) months and less than five (5) years may be re -issued pursuant to an Exception with City Commission approval, subject to certain criteria. As noted in the City of Miami's Previous Business Usage printout, attached, a General Commercial CU was issued for the Property on August 12, 2009. Said CU lapsed on October 10, 2012, less than five (5) years ago. Nonconforming Use CUs may be reissued under the Nonconforming Use Pilot Program subject to certain criteria: The nonconforming Use was originally legally established and operated at the time the Use began. The General Commercial Use was legally established and operated in 2009, as evidenced by the City's issuance of a CU for said Use. The General Commercial Use legally operated until October 10, 2012. The T3-0 and T3-L transect zone permits only Residential Uses, which would be impractical, if not impossible, for the structure. 3. No material difference in the quality, character, intensity, or degree of nonconforming Use will exist or greater compliance with Miami 21 is provided. There is no proposed enlargement of the structure, and the General Commercial Use will be contained completely within the structure, in the same manner as the previous General Commercial Use. The structure was built to house General Commercial Uses and was built in the same era as many of the surrounding residential structures, as this General Commercial Use serviced the neighborhood. The proposed General Commercial CU will continue the tradition of a General Commercial Use in the neighborhood which has existed for more than 75 years. 4. Despite not having a tenant in place, the Applicant is submitting this Operational Plan in order to provide the steps that will be taken to ensure a low impact on the surrounding residential neighborhood. Hours of Operation/Businesses The proposed hours of operation will be restricted to 8 AM to 9 PM. Depending on the chosen tenant, the hours of operation may differ; however, the tenant may not open before 8 AM and may not close later than 9 PM. The future tenant has not been chosen; however, it may create a lower impact on the surrounding area to incorporate multiple smaller businesses into the existing property. The uploaded site plan includes multiple options for a potential buildout; however, the final buildout will be determined when a tenant is chosen and subject to approval via building permit. Loading Times Loading shall occur at the 123 NW 51 Street property (the parking lot property) and shall be restricted to not conflict with customer parking. When possible the roll up doors on the structure shall be utilized in order to internalize deliveries. All Loading will occur onsite and not within the Right of Way. Loading shall not occur between the hours of 11 PM and 7 AM on weekdays. On weekends, Loading shall occur between the hours of 9 AM and 6 PM on weekends. Loading will be restricted during peak hours so as not to interfere with the surrounding neighborhood. Parking Parking will occur on the 123 NW 51 Street property. The existing eleven (11) parking spaces are sufficient for the proposed General Commercial uses. Additional onstreet spaces are available abutting the property. Noise Regulations The potential business shall comply with the noise restrictions contained in Chapter 36 of the City Code at all times. The tenant shall be prohibited from playing or operating of music boxes, jukeboxes, radios, musical instruments or any other musical devices on or about the premises unless such music boxes, jukeboxes, radios, musical instruments and other devices are played or operated in a closed building and the sound is not audible from outside the building.
