Subject: Approve - Benevate Inc. d/b/a Neighborly Software
Purpose of Item:
The nature of this item is to authorize a resolution of the Miami City Commission with
attachments(s), by a four -fifths (4/5ths) affirmative vote, retroactively ratifying,
confirming and approving the City Manager's recommendation and written findings, that
is it most advantageous for the City of Miami to waive the competitive sealed bidding
procedures pursuant to Section 18-90 of the Code of the City of Miami, Florida as
amended, ("City Code") and retroactively approving the selection of Benevate Inc. d/b/a
Neighborly Software ("Neighborly") for the purchase of twelve (12) annual licenses for
proprietary software ("software") to process business and rehabilitation program loans,
for the Department of Housing and Community Development ("HCD"), for an estimated
expenditure amount of approximately $61,200; Further authorizing the City Manager to
negotiate and execute any and all documents, including any amendments, renewals,
and extensions, subject to all allocations, appropriations, prior budgetary approvals,
compliance with all applicable provisions of the Code of the City of Miami, Florida, as
amended, ("City Code"), including the City's Procurement Ordinance, Anti -Deficiency
Act, and Financial Integrity Principles, all as set forth in Chapter 18 of the City Code, in
a form acceptable to the City Attorney, and in compliance with all applicable laws, rules,
and regulations, as may be deemed necessary for said purpose.
Background of Item:
HCD provides loans and grants to City businesses and homeowners using Community
Development Block Grant ("CDBG") funds provided by the United States Department of
Housing and Urban Development ("HUD"). HCD currently does not have an effective
means of accepting online loan/grant applications. The Software accepts and processes
loan/grant applications while ensuring HCD's perpetual compliance with all applicable
CDBG program regulations. This proprietary Software from Neighborly was selected
because it is uniquely designed to address the specifications and requirements of
different HCD programs that provide assistance to City residents and businesses. The
approximate cost is $61,200.00. Funding was allocated from Special Revenue
accounts.

A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), BY A
FOUR -FIFTHS (4/5THS) AFFIRMATIVE VOTE, RETROACTIVELY RATIFYING,
CONFIRMING, AND APPROVING THE CITY MANAGER'S RECOMMENDATION AND
WRITTEN FINDING THAT IT IS MOST ADVANTAGEOUS FOR THE CITY OF MIAMI
("CITY") TO WAIVE COMPETITIVE SEALED BIDDING REQUIREMENTS PURSUANT
TO SECTION 18-90 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS
AMENDED ("CITY CODE"), FOR THE SELECTION OF BENEVATE INC. D/B/A
NEIGHBORLY SOFTWARE, A FOREIGN PROFIT CORPORATION AUTHORIZED TO
CONDUCT BUSINESS IN FLORIDA, FOR THE EMERGENCY PURCHASE OF
TWELVE (12) ANNUAL LICENSES FOR PROPRIETARY SOFTWARE NECESSARY
FOR THE PROCESSING OF BUSINESS AND REHABILITATION PROGRAM LOANS
AND GRANTS FOR THE CITY'S DEPARTMENT OF HOUSING AND COMMUNITY
DEVELOPMENT FOR AN ESTIMATED EXPENDITURE AMOUNT OF
APPROXIMATELY SIXTY ONE THOUSAND TWO HUNDRED DOLLARS ($61,200.00)
WITH FUNDING TO BE APPROVED AND ALLOCATED FROM SPECIAL REVENUE
ACCOUNTS; AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE
ANY AND ALL DOCUMENTS, INCLUDING ANY AMENDMENTS, RENEWALS, AND
EXTENSIONS, SUBJECT TO ALL ALLOCATIONS, APPROPRIATIONS, PRIOR
BUDGETARY APPROVALS, COMPLIANCE WITH ALL APPLICABLE PROVISIONS
OF THE CITY CODE, INCLUDING THE CITY'S PROCUREMENT ORDINANCE, ANTI -
DEFICIENCY ACT, AND FINANCIAL INTEGRITY PRINCIPLES, ALL AS SET FORTH
IN CHAPTER 18 OF THE CITY CODE, IN FORMS ACCEPTABLE TO THE CITY
ATTORNEY, AND IN COMPLIANCE WITH ALL APPLICABLE LAWS, RULES, AND
REGULATIONS, AS MAY BE DEEMED NECESSARY FOR SAID PURPOSE.
WHEREAS, the City of Miami's ("City") Department of Housing and Community
Development ("HCD") provides loans and grants to City businesses and homeowners using
Community Development Block Grant ("CDBG") funds provided by the United States
Department of Housing and Urban Development; and
WHEREAS, HCD currently has no software that will accept and process online
applications for its business or rehabilitation program loans and grants; and
WHEREAS, HCD requires twelve (12) annual licenses for proprietary software
("Software") from Benevate Inc. d/b/a Neighborly Software, a foreign profit corporation
authorized to conduct business in Florida ("Neighborly"), uniquely designed to address the
specifications and requirements of different HCD programs that provide assistance to City
residents and businesses; and
WHEREAS, the Software will provide the capability of accepting and processing
application submittals online, will simplify the HCD business loan application process, will track
all regulatory required data points, and will help HCD approve business loans and grants more
expeditiously; and
WHEREAS, with respect to rehabilitation programs, the Software will integrate
underwriting, compliance, reporting, scope development, inspections, and contractor
reimbursements for the provision of seamless transactions for homeowners, while ensuring
HCD's perpetual compliance with all applicable CDBG regulations; and
WHEREAS, the City Manager, pursuant to Section 18-90 of the Code of the City of
Miami, Florida, as amended ("City Code"), approved an emergency purchase to procure the
Software from Neighborly;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. By a four -fifths (4/5ths) affirmative vote, the City Manager's recommendation
and written finding that it is most advantageous for the City to waive competitive sealed bidding
requirements pursuant to Section 18-90 of the City Code for the selection of Neighborly for the
emergency purchase of the Software necessary for the processing of business and
rehabilitation program loans and grants for HCD for an estimated expenditure amount of
approximately Sixty One Thousand Two Hundred Dollars ($61,200.00) is hereby retroactively
ratified, confirmed, and approved.
Section 3. Funding is hereby approved and allocated from Special Revenue accounts.
Section 4. The City Manager is authorized' to negotiate and execute any and all
documents, including any amendments, renewals, and extensions, subject to all allocations,
appropriations, prior budgetary approvals, compliance with all applicable provisions of the City
Code, including the City's Procurement Ordinance, Anti -Deficiency Act, and Financial Integrity
Principles, all as set forth in Chapter 18 of the City Code, in forms acceptable to the City
Attorney, and in compliance with all applicable laws, rules, and regulations, as may be deemed
necessary for said purpose.
Section 5. This Resolution shall become effective immediately upon its adoption.
