HomeMy WebLinkAboutPZAB (10619) ResolutionCity of Miami PZAB Resolution Enactment Number: PZAB-R-21-039 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File ID: 10619 Final Action Date: 10/6/2021 A RESOLUTION OF THE MIAMI PLANNING, ZONING AND APPEALS BOARD RECOMMENDING APPROVAL TO THE CITY COMMISSION OF AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING ORDINANCE NO. 13114 THE ZONING ORDINANCE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED ("MIAMI 21 CODE"), TO AMEND APPENDIX C — MIDTOWN OVERLAY DISTRICT, SECTION 627.1.6, TITLED "BUILDING PLACEMENT AND BUILDABLE AREA"; SECTION 627.1.7, TITLED "MAXIMUM HEIGHT, BUILD -TO, MINIMUM SETBACK AND USE REQUIREMENTS"; MAKING FINDINGS; CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN IMMEDIATE EFFECTIVE DATE. WHEREAS, on October 22, 2009, the City Commission adopted Ordinance No. 13114, the Zoning Ordinance of the City of Miami, known as the Miami 21 Code ("Miami 21 Code"); and WHEREAS, on November 25, 2003 the City Commission adopted Ordinance No. 12447 creating the SD-27 FEC Corridor and subsequently adopted Ordinance No. 12688 on May 26, 2005, modifying the name as the Midtown Miami Special District (the "District") and incorporated it into the Miami 21 Code as Appendix C; and WHEREAS, the District is of special and substantial public interest given its proximity to Downtown Miami and the Omni Area, the Design District, Miami Beach, the Wynwood Neighborhood and to future proposed commuter transit facilities within the Florida East Coast Railway (FEC) Corridor; and WHEREAS, the objective of the District is to promote neighborhood redevelopment through medium to high -density mixed -use development and provide intensive new housing opportunities needed to sustain future commercial growth and commuter transit facilities; and WHEREAS, the District promotes the design of buildings as strategically located visual gateway structures by providing greater allowable height at strategic street intersections within the district; and WHEREAS, the Southwest corner of the intersection of Northeast 36 Street and Northeast 2 Avenue ("Gateway 1") is the only vacant site of three such gateway sites; and WHEREAS, the Zoning Transects outside the Midtown Overlay District that abut the "Gateway 1" parcel are T6-12-0 (maximum 20 Stories) to the north, T6-24A-O (maximum 48 Stories) to the northeast, and T6-36A-O (maximum 60 Stories) to the east; and WHEREAS, the Planning, Zoning and Appeals Board ("PZAB") has considered the Planning Director's recommendations; and City of Miami Page 1 of 6 File ID: 10619 (Revision:) Printed On: 11/1/2021 WHEREAS, the PZAB has conducted a public hearing on the proposed text amendment; and WHEREAS, the PZAB has considered whether the proposed amendment will further the goals, objectives, and policies of the Miami Comprehensive Neighborhood Plan ("MCNP"), the Miami 21 Code, and other City regulations; and WHEREAS, the PZAB has considered the need and justification for the proposed change, including changed or changing conditions that make the passage of the proposed change necessary; NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING, ZONING AND APPEALS BOARD OF THE CITY OF MIAMI, FLORIDA, AS FOLLOWS: Section 1. The recitals and finding contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. It is recommended to the Miami City Commission that the Miami 21 Code be amended by amending Appendix C — Midtown Overlay District, section 627.1.7 Maximum height, Build -to, Minimum Setback and Use Requirements in the following particulars:1 "APPENDIX C — MIDTOWN OVERLAY DISTRICT SD-27.1 Midtown Miami East Special District * 627.1.6. Building Placement and buildable area. * * * 6. Gateway Designations.
