A RESOLUTION OF THE ART IN PUBLIC PLACES BOARD ("AIPPB") WITH
ATTACHMENTS PURSUANT TO CHAPTER 62/ARTICLE XVI OF THE CODE OF
THE CITY OF MIAMI, FLORIDA, AS AMENDED ("CITY CODE") TITLED "ART IN
PUBLIC PLACES", APPROVING WITH CONDITIONS THE SELECTION OF THE
TOP SHORT-LISTED ARTISTS IN ACCORDANCE WITH SECTION 62-658 OF THE
CITY CODE TO CREATE DESIGN PROPOSALS AS PART OF A CALL TO ARTISTS
FOR THE INTEGRATION OF PUBLIC ART AT THE BAY OF PIGS MEMORIAL PARK
LOCATED AT 5665 SOUTHWEST 3 STREET, MIAMI.
WHEREAS, on January 12, 2017, pursuant to Ordinance Nos. 13656 and 13657, the
Miami City Commission ("City Commission") established and enacted Phase I of the Art in
Public Places Program, requiring all applicable Government Development Projects to allocate
one and a half percent (1.5%) of project costs towards the acquisition, commissioning, and
selection of art; and
WHEREAS, the City of Miami ("City") will make park enhancements to the Bay of Pigs
Memorial Park located at 5665 Southwest 3 Street, Miami ("Property), which are subject to
public art requirements pursuant to Article 11, titled "Art in Public Places," of Ordinance No.
13114, the Zoning Ordinance of the City of Miami, as amended, ("Miami 21"); and
WHEREAS, the public art fee associated with the proposed Bay of Pigs Park
improvements has been deposited into the Public Art Fund in accordance with Article 11,
Section 11.7 of Miami 21; and
WHEREAS, on October 19, 2020, the Art in Public Places Board ("AIPPB") pursuant to
Resolution No. AIPP-R-20-019, approved with conditions the expenditure of up to sixty -four -
thousand dollars ($64,000.00) to be used for design services, commissioning, acquisition, and
installation of public art at the Bay of Pigs Memorial Park; and
WHEREAS, as part of the approval, the City's Public Art Division on October 29, 2020,
conducted a Call to Artists, attached hereto as Exhibit "A", titled "Call to Artist", in accordance
with Section 62-658 of the City Code, requesting qualifications from professional artists and/or
artist teams to create integrated artwork(s) for the Bay of Pigs Memorial Park; and
WHEREAS, the Call to Artists closed on November 11, 2020, and the Public Art Division
received over eighteen (18) respondents from artists interested in competing for the final public
art commission; and
WHEREAS, as a required part of the Call to Artists, artists submitted specific information
such as an artist statement, resume, and samples of their work; and

WHEREAS, the Public Art Division called a meeting of the Professional Advisory
Committee ("PAC") to review the submittals from artists and provide a recommendation to the
AIPPB; and
WHEREAS, the PAC concluded its review and ranked the top five (5) artists for the
AIPPB's consideration as listed on page five (5) of the report, attached and incorporated as
Exhibit "B", as follows:
1. Nilda Commas
2. Joshua Wiener
3. Xavier Cortada
4. Octavio Cuellar
5. Carlos Luna
WHEREAS, the PAC recommends that due to the significant and historical importance
of the Bay of Pigs event to the community, all five (5) top ranked artists shall be commissioned
to prepare design proposals for the AIPPB's consideration; and
WHEREAS, additional funds from the Public Art Fund have been identified to
commission the two (2) additional artists and all shortlisted artists will receive an honorarium of
One Thousand Dollars ($1,000) to develop specific proposals and compete for the
commission(s); and
WHEREAS, the AIPPB has reviewed the artists' submittals pursuant to Exhibit "B" titled
"Bay of Pigs Finalist"; and
WHEREAS, the AIPPB selected all five (5) shortlisted artists and/or artist teams, as
recommended by the PAC; and
WHEREAS, the AIPPB also selected a sixth artist, Carlos Alvez, whose One Thousand
Dollar ($1,000) honorarium must be approved by the AIPPB at a future AIPPB meeting; and
WHEREAS, the AIPPB hereby shortlists the following artists and/or artist teams to
develop specific art proposals to compete for the final public art commission for the Property:
1. Nilda Commas
2. Joshua Wiener
3. Xavier Cortada
4. Octavio Cuellar
5. Carlos Luna
6. Carlos Alves
WHEREAS, pursuant to Section 62-655(c)(4) of the City Code, the AIPPB's actions
approving, approving with conditions, or denying proposed installations, dedications, or
donations of art must be based on a public art master plan ("Master Plan") and public art
program guidelines ("Program Guidelines"); and
WHEREAS, as of the date of this resolution, no such Master Plan or Program Guidelines
have been adopted by the City Commission; and

WHEREAS, pursuant to Section 62-655(c)(1)-(2) of the City Code, the AIPPB shall
recommend a Master Plan and Program Guidelines, and amendments thereto, to the City
Commission; and
WHEREAS, the AIPPB 's actions referenced herein are taken pursuant to the Master
Plan and Program Guidelines recommended to the City Commission by AIPP-R-21-013 on July
19, 2021, which have not yet been considered by the City Commission; and
WHEREAS, the AIPPB understands that no action may be taken by the City or any other
party based on this resolution unless and until the City Commission has adopted the Master
Plan and Program Guidelines as recommended by the AIPPB via AIPP-R-21-013 on July 19,
2021, and the City Commission legislation taking such action has been rendered by the City
Clerk's Office; and
WHEREAS, the AIPPB understands that in the event the City Commission does not
adopt the Master Plan and Program Guidelines as recommended by the AIPPB via AIPP-R-21-
013 on July 19, 2021, this resolution shall be considered null and void;
NOW, THEREFORE, BE IT RESOLVED BY THE ART IN PUBLIC PLACES BOARD OF
THE CITY OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. the AIPPB hereby shortlists the six (6) artists and/or artist teams referenced
herein to develop specific art proposals to compete for the final public art commission for the
Property.
Section 3. The One Thousand Dollar ($1,000) honorarium for artist Carlos Alvez must be
approved by the AIPPB at a future AIPPB meeting.
Section 4. No action may be taken by the City or any other party based on this resolution
unless and until the City Commission has adopted the Master Plan and Program Guidelines as
recommended by the AIPPB via AIPP-R-21-013 on July 19, 2021, and the City Commission
legislation taking such action has been rendered by the City Clerk's Office.
Section 5. In the event the City Commission does not adopt the Master Plan and
Program Guidelines as recommended by the AIPPB via AIPP-R-21-013 on July 19, 2021, this
resolution shall be considered null and void.
