HomeMy WebLinkAboutBack-Up DocumentsResolution 21-034 A resolution by the Bayfront Park Management Trust ("Trust") appointing Mark Burns as the Executive Director of the Trust, effective July 27, 2021 or upon his expiration of employment with the City of Miami, a municipal corporation of the State of Florida, and affording him the duties of the Executive Director when representing the Trust, as enumerated in the City of Miami Code of Ordinance, as amended, ("City Code"), including not limited to, authorized signatory for all Trust documents, letters, purchase orders, Use agreements, permits, and to perform the customary duties of the Executive Director as Chief Executive Officer of the Trust, subject to City Commission approval, the City of Miami Charter and Code , and Trust By-laws ; and Whereas, Mark Burns is also approved as a signatory, effective July 27, 2021, when representing the Trust in the signing of checks and or financial documents related to the Trust's bank account, and, concurrently removing Mr. Jose Solano from all of the above duties, and Whereas, Mr. Mark Burns's salary is to be set at $120,000.000, effective as of the date his employment at the City of Miami is terminated. The Trust now makes this formal offer for you to consider acceptance of the appointment. Pursuant to Section 38-105 of the Code of the City Miami ("Code"), should you accept, your appointment will be subject to and contingent upon confirmation by the City of Miami City Commission. As the Executive Director you will be a full-time, at -will employee of the Trust. Your appointment will begin on August 12, 2021. You will be required to perform the duties described in Sections 38-105 and 38-106 of the Code as well as all other duties required of you by the Trust. You or the Trust may terminate the employment relationship at any time with or without cause, and with or without notice and for any reason or no particular reason. Your benefits will include the following: • Starting annual salary of One Hundred Twenty Thousand Dollars and 00/100 ($120,000.00). On October 1, 2022, the Trust will increase your annual salary by a minimum of five percent (5%) with the ability to give you an increase greater than five percent (5%) depending on your performance. • On October 1, 2023, and on October 1st of each subsequent year of your appointment, the Trust will increase your annual salary by a minimum of five percent (5%). • A monthly Fifty dollar ($50.00) cellular phone allowance • Eighty (80) hours to be used for sick and/or personal leave annually (use and accrual of hours are subject to the provisions of Trust's Employee Handbook ("Handbook") • One Hundred Sixty (160) hours for vacation leave annually (use and accrual of hours subject to Handbook provisions) • 12 paid holidays per year • The medical, dental, and vision insurance provided by Trust (subject to each plan's terms and conditions) This offer is conditioned upon your successful completion of a background investigation and pre -employment medical examination, if applicable. This letter of offer is not intended to create a continuing contract of employment or a contractual right to employment.
