As you are aware, there is pending litigation as to the design and use of Charthouse Drive and the traffic circle that could impact the proposed Easement. As such, we believe it is premature to grant and Easements at this time. As was the case with the recently proposed FPL Easement for Grove Bay, after having the time to discuss/meet with you and other staff members including Grove Bay's team, we feel we can do the same here. Unfortunately, due to the City's failure to provide us notice and request our consent (pursuant to the terms of the Lease), we continuously find ourselves having to find resolutions on the eve or da of commission meetings. We would appreciate receiving timely notice in the future. We are once again in the same situation where the City is asking GH for its consent after the fact, and in this case where the water and sewer lines have already been installed in an area that violates the tri party easement agreement to the detriment of GH as it lies outside of Parcel 4. As discussed during our call, our surveyor, Mark Johnson of Schwebke Shiskin & Associates, believes there could be alternatives that would be more beneficial to all parties and potentially less costly (we need further documentation from the city such as the utility coordination plans to make a proper determination). Mark also pointed out that Easements I, 2 and 3 on today's agenda have an incorrect legal description and it would not make sense for the City to approve it based on that fact alone. Attached to this letter is a merno from Mark on this issue. We are requesting that this item be continued to the next meeting on January 13. Please advise as soon possible if the Manager would agree to recommend this to the Commission. Failure of the City's compliance with the notice and consent provision in the Lease; 2. The parties' compliance with the tri-party easement agreement; 3. Mark Johnson's comments attached to this letter; 4. The incorrect legal description; and 5. Failure to provide Grove Harbour with as built plans and utility coordination plans to consider options.
