At its November 18, 2021 meeting, the City Commission adopted the above -referenced
agenda item, PZ.7. The item inadvertently contained a scrivener's error as the new subsection
should have been referenced as subsection "b" but was instead referenced in the legislation as
subsection T.
The Legislation has been corrected and incremented to Revision A.

AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING
ORDINANCE NO. 13114, THE ZONING ORDINANCE OF THE CITY OF
MIAMI, FLORIDA, BY AMENDING ARTICLE 3, SECTION 3.6.9r TITLED
"GENERAL TO ZONES/OFF-STREET LOADING REQUIREMENTS", AND
ARTICLE 4, TABLE 4, TITLED "STANDARDS AND TABLES/DENSITY,
INTENSITY AND PARKING (T6)", TO PROVIDE FOR OFF -SITE LOADING
WITHIN AN ESTABLISHED DOWNTOWN FLAGLER PARKING DISTRICT
AREA BY PROCESS OF WAIVER IN CERTAIN T6 TRANSECT ZONES:
CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, on October 22, 2009, the City Commission adopted Ordinance No. 13114
as the Zoning Ordinance for the City of Miami ("Miami 21 Code"); and
WHEREAS, the City of Miami ("City") regulates parking through land development
regulations and parking requirements for Uses established in the Miami 21 Code and
through Chapter 35 of the Code of the City of Miami, Florida, as amended ("City Code");
and
WHEREAS, there is a need to provide options for loading in Downtown Miami in order to
address traffic flow and loading issues; and
WHEREAS, Chapter 35 of the City Code is being amended to create a Downtown c�
Flagler District Parking and Loading improvement Program and Trust Fund ('"Progrri") for
Downtown Miami as described in Exhibit "A"; attached and incorporated; and
WHEREAS, this proposed amendment is needed to incorporate off -site loading
consistent with the Program; and
WHEREAS, on , the Planning, Zoning and Appeals Boars
("PZAB"), at a duly noticed public hearing, considered PZAB Item No, and
PZAB Resolution No. R- by a vote of - , recommending
City Commission of the proposed amendment as stated herein; and

WHEREAS, consideration has been given as to whether this proposed amendment will
further the goals, objectives, and policies of the Miami Comprehensive Neighborhood Plan, the
Miami 21 Code, and other City regulations; and
WHEREAS. consideration has been given to the need and justification for this proposed
amendment, including changed or changing conditions that make the passage of this proposed
amendment necessary;

WHEREAS, the City Commission, after careful consideration of this matter, deems it
advisable and in the best interest of the general welfare of the City and its residents to amend
the Miami 21 Code as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA, AS FOLLOWS:
Section 1. The recitals and findings contained in the Preamble to this Ordinance are
hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section.
Section 2. Article 3 of the Miami 21 Code is hereby amended by making modifications in
the following particulars:'
"ARTICLE 3. GENERAL TO ZONES

upon both the property on which the Loading will occur and the property which requires the

Ordinance shall become and be made a part of the Miami 21 Code, which provisions may
be renumbered or relettered and that the word "ordinance" may be changed to "section",
"article", or other appropriate word to accomplish such intention.
Section 6. This Ordinance shall become effective immediately upon its adoption by
the City Commission.'

a duly noticed public hearing, considered PZAB Item No. 9 and adopted PZAB Resolution No.
R-21-046 by a vote of eight to zero (8-0), recommending approval to the City Commission of the
proposed amendment as stated herein; and
WHEREAS, consideration has been given as to whether this proposed amendment will
further the goals, objectives, and policies of the Miami Comprehensive Neighborhood Plan, the
Miami 21 Code, and other City regulations; and
WHEREAS, consideration has been given to the need and justification for this proposed
amendment, including changed or changing conditions that make the passage of this proposed
amendment necessary;and

compliance with:
• A maximum area of 55,000 square
feet per establishment, except for
Public Storage Facilities.
• Minimum of 3 parking spaces for
every 1,000 square feet of
commercial use, except for Public
Storage Facilities, minimum 1
parking space for every 10,000
square feet with a minimum of 8
parking spaces.
• Parking requirement may be
reduced according to the Shared
parking standard, Article 4, Table 5,
except for Public Storage Facilities.
• Minimum of 1 Bicycle Rack Space
for every 20 vehicular spaces
required or within a TOD area, one
(1) Bicycle Rack Space required per
3,000 sq. ft. of Commercial area.
Auto -related - Drive-Thru or Drive-
n Facilities - See Article 6.
• Except for sites within 500 feet of
an ungated T3 Transect Zone, the
parking ratio may be reduced within
a TOD area or within a Transit
Corridor area by up to thirty percent
(30%) by process of Waiver; by up
to fifty percent (50%) by process of
Waiver and payment into a transit
enhancement Trust Fund, as
established by Chapter 35 of the
City Code; or by one hundred
percent (100%) for any Structure
with a Floor Area of ten thousand
(10,000) square feet or less.
• Within a TOD area, twenty percen
(20%) of required parking spaces
may be exchanged for bicycle
parking at a ratio of six (6) Bicycle
Rack Spaces for each required
parking space.
• Parking may be provided by
ownership or lease offsite within
1,000 feet by process of Waiver,
except when site is within 500 feet
of T3.

• In T6-80 within the Downtown
Flaqler District, Loading for

Section 4. If any section, part of a section, paragraph, clause, phrase, or word of this
Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected.
Section 5. It is the intention of the City Commission that the provisions of this
Ordinance shall become and be made a part of the Miami 21 Code, which provisions may
be renumbered or relettered and that the word "ordinance" may be changed to "section",
"article", or other appropriate word to accomplish such intention.
Section 6. This Ordinance shall become effective immediately upon its adoption by
the City Commission.2
APPROVED AS TO FORM AND CORRECTNESS:
2 This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten (10)
days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become
effective immediately upon override of the veto by the City Commission or upon the effective date stated
herein, whichever is later.
