HomeMy WebLinkAboutPZAB (10672) ResolutionCity of Miami PZAB Resolution Enactment Number: PZAB-R-21-046 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File ID: 10672 Final Action Date: 10/20/2021 A RESOLUTION OF THE PLANNING, ZONING AND APPEALS BOARD ("PZAB"), WITH ATTACHMENTS, RECOMMENDING APPROVAL TO THE MIAMI CITY COMMISSION OF AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING ORDINANCE NO. 13114 ("Miami 21 Code"), AS AMENDED, THE ZONING ORDINANCE OF THE CITY OF MIAMI, FLORIDA, MORE SPECIFICALLY BY AMENDING ARTICLE 4, TABLE 4, TITLED "STANDARDS AND TABLES/DENSITY, INTENSITY AND PARKING (T6)", AND ARTICLE 3, SECTION 3.6.9 TITLED "GENERAL TO ZONES/OFF-STREET LOADING REQUIREMENTS", TO PROVIDE OFF -SITE LOADING WITHIN AN ESTABLISHED DOWNTOWN FLAGLER PARKING DISTRICT AREA BY PROCESS OF WAIVER IN CERTAIN T6 TRANSECT ZONES; CONTAINING A SEVERABILITY CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Miami ("City") regulates parking through land development regulations and parking requirements for Uses established in the Miami 21 Code, and through Chapter 35 of the Code of the City of Miami, Florida, as amended ("City Code"); and WHEREAS, there is a need to provide options for loading for the downtown area of the City in order to address traffic flow and loading issues; and WHEREAS, Chapter 35 of the City Code is being amended to create a Downtown Flagler District Parking and Loading Improvement Program and Trust Fund for the downtown area described in Exhibit "A", attached and incorporated; and WHEREAS, the proposed amendment is needed to incorporate off -site loading consistent with the Downtown Flagler District Parking and Loading Improvement Program and Trust Fund; and WHEREAS, consideration has been given as to whether the proposed amendment will further the goals, objectives, and policies of the Miami Comprehensive Neighborhood Plan, the Miami 21 Code, and other City regulations; and WHEREAS, consideration has been given to the need and justification for the proposed amendment, including changed or changing conditions that make the passage of the proposed amendment necessary; and WHEREAS, the PZAB recommends approval to the City Commission of the proposed text amendment, as stated herein, because it finds that it is in the best interest of the City and its residents to amend the Miami 21 Code; City of Miami Page 1 of 7 File ID: 10672 (Revision:) Printed On: 11/4/2021 NOW, THEREFORE, BE IT RESOLVED BY THE MIAMI PLANNING, ZONING AND APPEALS BOARD OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. It is recommended to the Miami City Commission that Ordinance No. 13114 ("Miami 21 Code"), as amended, the Zoning Ordinance of the City of Miami, Florida, be amended by making modifications in the following particulars:1 "ARTICLE 3. GENERAL TO ZONES 3.6 OFF-STREET PARKING AND LOADING STANDARDS * * * 3.6.9 Off-street Loading Requirements i. Within the Downtown Flagler Parking and Loading Improvement District, as described in Exhibit "A," attached and incorporated, Loading for non-residential uses may be provided on -site or off -site as established in Chapter 35 and further described in Article 4, Table 4, by process of Waiver and via a Covenant, in a form acceptable to the City Attorney, running with the land to be recorded upon both the property on which the Loading will occur and the property which requires the Loading." Section 3. It is recommended to the Miami City Commission that Ordinance No. 13114 ("Miami 21 Code"), as amended, the Zoning Ordinance of the City of Miami, Florida, be amended by amending Article 4 to make modifications in the following particulars:2 "ARTICLE 4.
