Subject: Execute - Roadway Transfer Agreement
Purpose of Item:
Florida Department of Transportation ("FDOT") is undertaking the Project Development
and Environment (PD&E), design and construction of a project on State Road ("SR")
934/NE Bayshore Drive/NE 82nd Street from west of 1-95 (13th Court) to end of SR 934,
a one way, as described in Department Financial Project Number FM 410646-6-31-01
("the Project"). FDOT has jurisdiction over SR 934/NE Bayshore Drive/NE 82nd Street
from SR 934/NE 79th Street to N. Miami Avenue ("the Roadway Segment"). FDOT and
the City have agreed that upon completion of the Project Construction, FDOT shall
transfer the Roadway Segment and the City shall accept the transfer, jurisdiction,
management, and maintenance of the Roadway Segment. FDOT will transfer roadway
segments within Miami -Dade County maintenance jurisdiction intersecting NE 82 ST to
Miami -Dade County.
Background of Item:
A Resolution of the Miami City Commission authorizing the City Manager to negotiate
and execute a Roadway Transfer agreement with the Florida Department of
Transportation ("FDOT") to accept jurisdiction of State Road ("SR") 934/NE Bayshore
DR/NE 82nd Street from SR 934/NE 79th Street to N. Miami Avenue ("the roadway
segment") in a form acceptable to the city attorney; further authorizing the City Manager
to take any and all actions necessary to accomplish said transfer from FDOT's state
highway system to the City of Miami's street system, as stated in roadway transfer
agreement attached herein as exhibit "a"; directing the City Clerk to transmit a copy of
this resolution to the officials stated herein.

A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE A ROADWAY
TRANSFER AGREEMENT ("AGREEMENT") WITH THE FLORIDA DEPARTMENT OF
TRANSPORTATION ("FDOT") TO ACCEPT JURISDICTION OF STATE ROAD ("SR")
934/NORTHEAST BAYSHORE DRIVE/NORTHEAST 82ND STREET FROM SR
934/NORTHEAST 79TH STREET TO NORTH MIAMI AVENUE, IN A FORM
ACCEPTABLE TO THE CITY ATTORNEY; FURTHER AUTHORIZING THE CITY
MANAGER TO TAKE ANY AND ALL ACTIONS NECESSARY TO ACCOMPLISH SAID
TRANSFER FROM FDOT'S STATE HIGHWAY SYSTEM TO THE CITY OF MIAMI'S
STREET SYSTEM AS STATED IN THE AGREEMENT, ATTACHED AND
INCORPORATED AS EXHIBIT "A"; DIRECTING THE CITY CLERK TO TRANSMIT A
COPY OF THIS RESOLUTION TO THE OFFICIALS STATED HEREIN.
WHEREAS, the Florida Department of Transportation ("FDOT") is undertaking the
Project Development and Environment, design, and construction of a project on State Road
("SR") 934/Northeast Bayshore Drive/Northeast 82nd Street from west of 1-95 (13th Court) to the
end of SR 934 as described in Department Project Number FM 410646-6-31-01 ("Project"); and
WHEREAS, FDOT has jurisdiction over SR 934/Northeast Bayshore Drive/Northeast
82nd Street from SR 934/Northeast 79th Street to North Miami Avenue ("Roadway Segment");
and
WHEREAS, FDOT will transfer the Roadway Segment within Miami -Dade County's
("County") maintenance jurisdiction intersecting Northeast 82nd Street to the County; and
WHEREAS, FDOT and the City of Miami ("City") have agreed that upon completion of
the Project construction, FDOT will transfer the Roadway Segment within the City's jurisdictional
limits to the City for management and maintenance; and
WHEREAS, the City Commission finds the transfer of the Roadway Segment to be in the
best interests of the City;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized1 to negotiate and execute a Roadway
Transfer Agreement, in a form acceptable to the City Attorney, with FDOT to accept the transfer,
jurisdiction, management, and maintenance of the Roadway Segment.
1 The herein authorization is further subject to compliance with all legal requirements that may be
imposed, including but not limited to, those prescribed by applicable City Charter and City Code
provisions.
Section 3. The City Manager is further authorized' to take any and all actions necessary
to accomplish said transfer of the Roadway Segment from FDOT to the City's Street System.
Section 4. The City Clerk is directed to transmit a copy of this Resolution to the FDOT
District 6 Secretary Stacy Miller.
Section 5. This Resolution shall become effective immediately upon its adoption.
