The condominium board of Point Bay North (PBN) respectfully request that you, as our elected official, make
a motion that directs the planning director to study a city -sponsored change in zoning for our entire
neighborhood. As our commissioner, such an action could uniformly modify the remaining areas proximate to
Magnolia, including PBN, This would address zoning consistency and might allow a more comprehensive urban
plan that addresses more profoundly, many of the issues affecting Magnolia.
We wish to further clarify our opinion regarding the request for a land use and zoning change of properties
immediately to our West. As you are aware, an application for re -zoning of property immediately abutting
PBN (i.e., the "Magnolia Project") is before you and the City Commission. The applicant is seeking a rezoning
from the present T5-R to a T6-8-0 designation.
Because of a lack of uniformity, especially with the future land use would ensue if only some of the
properties are up zoned, while ignoring others. We would ONLY support this up zoning if the
remaining properties along the NE 371and 38th ST enclave are equally included, as SPOT ZONING
is illegal.
In addition, a partial up zoning would unfairly devalue the few remaining lots.
The board of directors of Point Bay North strongly agrees with the action taken by the Commission
creating a Comprehensive Plan Amendment along the Miami River, which is exemplified with
Ordinance 13753 (see below)

AMENDED, THE FUTURE LAND USE MAP OF THE MIAMI COMPREHENSIVE NEIGHBORHOOD

163.3187, FLORIDA STATUTES, BY CHANGING THE FUTURE LAND USE DESIGNATION FROM
"SINGLEFAMILY RESIDENTIAL" TO "LOW DENSITY MULTIFAMILY RESIDENTIAL" OF THE
APPROXIMATELY 1.77 ACRES OF REAL PROPERTIES LOCATED AT APPROXIMATELY 1515,
1529, AND 1543 NORTHWEST SOUTH RIVER DRIVE, MIAMI, FLORIDA, AS MORE
PARTICULARLY DESCRIBED IN EXHIBIT "A'; MAKING FINDINGS; CONTAINING A
SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE.
