Dear City of Miami Commission,
It has come to our attention that agenda items PZ2 and PZ3 are proposing rezoning and future land use
amendments for a property near the intersection of NE 38th Street and Biscayne Boulevard. Given the
already heavily congested intersection and traffic problems on 38th Street and Biscayne Boulevard, any
increase in intensity will create additional traffic that will be greatly detrimental to the mobility of the area.
The Intersection already has significant traffic issues, without adequate turning and through lanes, creating
significant safety and operational deficiencies. This is the main entrance from Mid Beach to the City of
Miami and serves the residents north of 38th street including the Bay Point and Morningside
neighborhoods, as well as commuters traveling south to the
Downtown/Brickell area during business hours. The rush-hour traffic already results in nearly standstill
congestion at the Intersection backing up west -bound traffic across the Julia Tuttle Causeway and at the
southbound left-hand turn onto 381h Street. Any increase in trips and/or additional turns onto or off 38th
Street from new development will further disrupt traffic at this Intersection and surrounding roads.
Agenda items PZ2 and PZ3 for properties located at 428, 430, 448, & 454 NE 38 Street and 433, 441, and
457 NE 37 Street request to change the Future Land Use designation from Medium Density Multifamily
Residential to Restricted Commercial, and a Rezoning request to change the Zoning designation from T5-
R to T5-8-0.
Approvals of application will amount to increased density, intensity, height, and more intense permitted
uses, resulting in significantly heavier traffic and worsening conditions for the surrounding neighborhood
and city-wide commuters. In sum, approval of either of the above applications could increase traffic and
intensity in an already heavily congested and significant intersection and would have an overall negative
impact on the area.
