Purpose of Item:
AUTHORIZING THE ALLOCATION OF EMERGENCY RENTAL ASSISTANCE
PROGRAM 2 ("ERA2") FUNDS IN AN AMOUNT OF $22,779,317.10 FROM THE
UNITED STATES DEPARTMENT OF THE TREASURY, AS SHOWN IN EXHIBIT "A"
ATTACHED, AND APPROVING THE PROGRAM SUMMARY FOR THE CITY'S
EMERGENCY RENTAL ASSISTANCE PROGRAM, TO PROVIDE FINANCIAL
ASSISTANCE AND HOUSING STABILITY TO ELIGIBLE HOUSEHOLDS AS
DESCRIBED IN EXHIBIT "B" ATTACHED; FURTHER AUTHORIZING THE CITY
MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL THE NECESSARY
DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, AS MAY BE
NECESSARY TO IMPLEMENT THE ALLOCATION, SUBJECT TO ALL FEDERAL,
STATE, AND LOCAL LAWS THAT REGULATE THE USE OF SUCH FUNDS.
Background of Item:
On July 22, 2021, pursuant to Resolution No. 21-0311, the City of Miami accepted the
amount of $22,779,317.10 from the United States Department of the Treasury
("Treasury") to establish of an Emergency Rental Assistance Program 2.
The funds must be allocated to continue promoting housing stability for eligible
households as stipulated in the guidance from the Treasury.
ERAP 2 funds must be spent by September 30, 2025.
The City has received an amount of $9,111,726.84 corresponding to 40% of the total
funds expected from the U.S. Department of the Treasury.
The rest of the funds will be contingent on the ability of the City to spend more than 75%
of the funds already sent to the City.
The City's Administration recommends the allocation of the Emergency Rental
Assistance Program 2 ("ERA2") funds in an amount of $22,779,317.10 from United
States Department of the Treasury, as shown in Exhibit "A" and approving the program
summary for the City's Emergency Rental Assistance program to provide financial
assistance and housing stability to eligible households as stipulated in the guidance
from the United States Department of Treasury as described in Exhibit "B", attached
and incorporated.

A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENTS,
ALLOCATING EMERGENCY RENTAL ASSISTANCE PROGRAM 2 ("ERA2") FUNDS
IN AN AMOUNT OF $22,779,317.10 FROM THE UNITED STATES DEPARTMENT OF
THE TREASURY AS SET FORTH IN EXHIBIT "A," ATTACHED AND
INCORPORATED, AND APPROVING THE PROGRAM SUMMARY FOR THE CITY OF
MIAMI'S EMERGENCY RENTAL ASSISTANCE PROGRAM AND ERA2 TO PROVIDE
FINANCIAL ASSISTANCE AND HOUSING STABILITY TO ELIGIBLE HOUSEHOLDS
AS DESCRIBED IN EXHIBIT "B," ATTACHED AND INCORPORATED; FURTHER
AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL
NECESSARY DOCUMENTS, ALL IN FORMS ACCEPTABLE TO THE CITY
ATTORNEY, SUBJECT TO ALL FEDERAL, STATE, AND LOCAL LAWS THAT

WHEREAS, on July 22, 2021, pursuant to Resolution No. R-21-0311, the City of Miami
("City") accepted $22,779,317.10 from the United States Department of the Treasury
("Treasury") to establish an Emergency Rental Assistance Program 2 ("ERAP 2"); and
WHEREAS, the ERAP 2 funds must be allocated to continue promoting housing stability
for eligible households as stipulated in the guidance received from the Treasury; and
WHEREAS, ERAP 2 funds must be spent by September 30, 2025; and
WHEREAS, of the $22,779,317.10, the City has received an amount of $9,111,726.84,
40% of the total funds expected from the Treasury; and
WHEREAS, receiving the rest of the $22,779,317.10 is contingent on the City's ability to
spend more than 75% of the funds already received by the City; and
WHEREAS, the City's initial Emergency Rental Assistance Program ("ERAP 1") was
established by Section 501 of Division N of the Consolidated Appropriations Act, 2021, Pub. L.
No. 116-260 (Dec. 27, 2020) and by City Commission through Resolution No. R-21-0065 with
funding from the Treasury; and
WHEREAS, the City's Administration recommends the allocation of the ERAP 2 funds in
an amount of $22,779,317.10 from the Treasury as set forth in Exhibit "A," attached and
incorporated ("Funds"), and approving the updated program summary for ERAP 1 and ERAP 2
to provide financial assistance and housing stability to eligible households as stipulated in the
guidance from the Treasury as described in Exhibit "B," attached and incorporated ("Program
Summary");
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The allocation of the Funds as described in Exhibit "A," attached and
incorporated, is authorized.'
Section 3. The Program Summary as set forth in Exhibit "B," attached and incorporated,
is approved.'
Section 4. The City Manager is authorized to negotiate and execute any and all
necessary documents, all in forms acceptable to the City Attorney, subject to all federal, state,
and local laws that regulate the use of such funds, for said purpose.
Section 5. This Resolution shall become effective immediately upon its adoption.
