Background of Item: The United States Department of Homeland Security's National Urban Search & Rescue ("USAR") Response System has since 1989 annually funded the South Florida USAR Task Force, Florida Task Force 2 ("FL-TF2"), which is coordinated by the City of Miami ("City") Department of Fire -Rescue ("Department") as the sponsoring agency ("Sponsoring Agency") through the Federal Emergency Management Agency, State of Florida (collectively, "FEMA"), for the operation of its USAR program. Pursuant to Resolution No. 01-484, adopted May 24, 2001, and Resolution No. 05- 0212, adopted April 14, 2005, the City Manager entered into several MOAs with participating agencies ("Participating Agency MOA(s)") setting forth those agencies' responsibilities in connection with the development and support of USAR FL-TF2, with all costs to be reimbursed by state and/or federal funding sources. Pursuant to Resolution No. 11-0297, adopted July 14, 2011, the City Manager entered into revised Participating Agency MOAs in accordance with FEMA's updated guidelines for USAR. Pursuant to Resolution No. 11-0296, adopted July 14, 2011, the City Manager entered into several Professional Services Agreements ("PSAs") with strategic individuals serving as Affiliated Personnel of USAR FL-TF2. The Department desires to revise the PSAs and update the current list of strategic individuals to take into account not only long-standing Affiliated Personnel but also allow for the City to enter into future PSAs with currently unanticipated new personnel to ensure the continued effective operation of the ongoing USAR FL-TF2 Program without interruption. WHEREAS, the United States Department of Homeland Security's National Urban Search & Rescue ("USAR") Response System since 1989 has annually funded the South Florida USAR Task Force, Florida Task Force 2 ("FL-TF2"), which is coordinated by the City of Miami's ("City") Department of Fire -Rescue ("Department") as the sponsoring agency ("Sponsoring Agency") through the Federal Emergency Management Agency, State of Florida ("FEMA"), for the operation of its USAR program by FL-TF2; and WHEREAS, pursuant to Resolution No. R-01-484 adopted May 24, 2001 and Resolution No. R-05- 0212 adopted April 14, 2005, the City Manager entered into Memorandum of Agreements ("MOAs") with participating agencies setting forth those agencies' responsibilities in connection with the development and support of USAR FL-TF2, with all costs to be reimbursed by state and/or federal funding sources; and WHEREAS, pursuant to Resolution No. R-21-0382 adopted September 23, 2021, the City Commission authorized (1) the Department's earlier list of participating agencies to be updated to take into account not only long-standing participating agencies but also anticipated new participating agencies and (2) the City Manager, through the Department as the Sponsoring Agency, to enter into the revised MOA with the participating agencies; and WHEREAS, accordingly, (1) the Department's earlier list of strategic individuals, such as doctors and forensic engineers, also need to be updated to take into account not only long- standing strategic individuals but also anticipated new strategic individuals indicated on Exhibit "A," attached and incorporated (collectively, "Strategic Individuals"), and (2) the City, through the Department as Sponsoring Agency, desires to enter into the revised PSA, attached and incorporated as Exhibit "B"; and WHEREAS, Strategic Individuals serve the USAR FL-TF2 at their leisure, volunteering when their schedules permit, and may go through periods in which they are unavailable and their expertise must be replaced for continued uninterrupted response readiness; and WHEREAS, in order to continue the ongoing operation of the USAR FL-TF2 Program without interruption, the City Commission finds it is in the City's best interest to authorize the City Manager to enter into a PSA, attached and incorporated as Exhibit "B," with the Strategic Individuals indicated on Exhibit "A," attached and incorporated, and future strategic individuals not currently anticipated; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is hereby authorized1 to execute, in substantially the attached form, a PSA between the City, through the Department as the Sponsoring Agency of FL-TF2 under the USAR Response System, acting through FEMA, and each of the Strategic Individuals on Exhibit "A," attached and incorporated, in addition to future unanticipated strategic individuals required to ensure the continued ongoing operation of the USAR FL-TF2 Program without interruption. Section 3. The City Manager, subject to consultation with the Department, is authorized' to negotiate and to execute any future amendments, extensions, and/or supplements to the PSA, subject to approval of legal form and correctness by the City Attorney and subject to budgetary approval at the time of need. Section 4. This Resolution shall become effective immediately upon its adoption.
