HomeMy WebLinkAboutPre-LegislationCity of Miami Legislation Resolution: R-20-0156 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 7449 Final Action Date: 5/14/2020 A RESOLUTION OF THE MIAMI CITY COMMISSION DIRECTING THE CITY MANAGER TO TAKE ANY AND ALL STEPS NECESSARY, INCLUDING THE WAIVER OF FEES, IF ANY, TO TEMPORARILY REPURPOSE PORTIONS OF CITY OF MIAMI ("CITY") RIGHTS -OF -WAY, INCLUDING PARKING LANES AND VEHICULAR TRAVEL LANES, WHERE DEEMED FEASIBLE BY THE CITY'S DEPARTMENT OF RESILIENCE AND PUBLIC WORKS AND THE MIAMI POLICE DEPARTMENT, TO ALLOW FOR INCREASED PEDESTRIAN USAGE FOR RESIDENTS AND ADDITIONAL SIDEWALK CAFE SEATING, INCLUDING PARKLETS SIMILAR IN NATURE TO THOSE ALLOWED BY THE PARKLET PILOT PROGRAM ADOPTED SEPTEMBER 27, 2018, PURSUANT TO RESOLUTION NO. 18-0427, TO ASSIST STRUGGLING BUSINESSES DUE TO THE NOVEL CORONAVIRUS CRISIS UNTIL AUGUST 20, 2020; URGING MIAMI-DADE COUNTY, THROUGH ITS DEPARTMENT OF TRANSPORTATION AND PUBLIC WORKS, TO ASSIST THE CITY IN ACCOMPLISHING SUCH A GOAL TO THE EXTENT NECESSARY; DIRECTING THE CITY CLERK TO TRANSMIT A CERTIFIED COPY OF THIS RESOLUTION TO THE OFFICIALS NAMED HEREIN. SPONSOR(S): Commissioner Ken Russell, Commissioner Manolo Reyes WHEREAS, under the provisions of law and Sections 252.31 - 252.60, Florida Statutes, Mayor Francis X. Suarez ("Mayor") of the City of Miami ("City") declared on March 12, 2020 that a State of Local Emergency exists within the City in response to the Novel Coronavirus ("COVID-19"); and WHEREAS, in accordance with the provisions of Section 252.38(3)(a), Florida Statutes, the Mayor has extended the State of Local Emergency for additional seven (7) day periods, most recently on May 12, 2020; and WHEREAS, as a result of the State of Local Emergency, many businesses have been closed and residents have been directed to stay at home; and WHEREAS, as the City begins to reopen, the City Commission wishes to assist businesses negatively affected by the COVID-19 crisis and provide additional sidewalk space for pedestrians by authorizing the City Manager to identify feasible portions of City rights -of -way that may be repurposed for pedestrian and sidewalk cafe usage and to take any and all steps necessary to effectuate such repurposing until August 20, 2020; and WHEREAS, pursuant to Section 2-33(e) of the Code of the City of Miami, Florida, as amended, the City Commission, by a majority vote, deems this Resolution to be of an emergency nature in order to immediately protect the health, welfare, and safety of the City's residents; City of Miami Page 1 of 2 File ID: 7449 (Revision:) Printed On: 9/14/2021 File ID: 7449 Enactment Number: R-20-0156 NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings set forth in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The City Manager is directed to take any and all steps necessary, including waiver of fees, if any, to temporarily repurpose portions of City rights -of -way, including parking lanes and vehicular travel lanes, where deemed feasible by the City's Department of Resilience and Public Works and the Miami Police Department, to allow for increased pedestrian usage for residents and additional sidewalk cafe seating to assist struggling businesses due to the COVID-19 crisis until August 20, 2020. This may include allowing parklets similar in nature to those allowed by the parklet pilot program adopted September 27, 2018 by Resolution No. R- 18-0427. Section 3. The City Manager is urged to collaborate with the Miami Parking Authority, the Miami Police Department, and the Coconut Grove Business Improvement District, the Wynwood Business Improvement District, and any other relevant and necessary entities to accomplish the goals set forth in this Resolution. Section 4. The City Commission urges Miami -Dade County ("County"), through its Department of Transportation and Public Works, to assist the City to the extent necessary to accomplish the goals set forth in this Resolution. Section 5. The City Clerk is directed to transmit a certified copy of this Resolution to the County Board of County Commissioners, the County Mayor, and the Director of the County's Department of Transportation and Public Works. Section 6. The Resolution shall become effective immediately upon its adoption. R-20-0156 ADOPTED ON MAY 14, 2020 FROM AUGUST 20, 2020 THROUGH JANUARY 31, 2021 IN ORDER TO CONTINUE TO ASSIST STRUGGLING BUSINESSES AFFECTED BY THE NOVEL CORONAVIRUS PANDEMIC; DIRECTING THE CITY CLERK TO TRANSMIT A CERTIFIED COPY OF THIS RESOLUTION TO THE OFFICIALS NAMED HEREIN. The recitals and findings set forth in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The program created by Resolution R-20-0156 adopted on May 14, 2020 which provided for an expiration date of said program of August 20, 2020 is hereby extended until January 31, 2021 with all other provisions of such Resolution to remain the same. Section 3. The City Clerk is directed to transmit a certified copy of this Resolution to the Miami -Dade County ("County") Board of County Commissioners, the County Mayor, and the Director of the County's Department of Transportation and Public Works. R-20-0156 ADOPTED ON MAY 14, 2020 AND EXTENDED BY RESOLUTION NO. Suarez ("Mayor") of the City of Miami ("City") declared on March 12, 2020 that a State of Local Emergency exists within the City in response to the Novel Coronavirus ("COVID-19") pandemic; and WHEREAS, in accordance with the provisions of Section 252.38(3)(a), Florida Statutes, the Mayor has presently extended the State of Local Emergency for additional seven (7) day periods; and WHEREAS, on May 20, 2020, the City Commission adopted Resolution No. R-20-0156 to assist businesses negatively affected by the COVID-19 pandemic by authorizing the City Manager to identify feasible portions of City rights -of -way that may be repurposed for pedestrian and sidewalk cafe usage and to take any and all steps necessary to effectuate such repurposing until August 20, 2020 ("COVID-19 Restaurant Recovery Program"); and WHEREAS, on July 23, 2020, the City Commission adopted Resolution No. R-20-0231, which extended the COVID-19 Restaurant Recovery Program until January 31, 2021; and WHEREAS, the City Commission wishes to extend the COVID-19 Restaurant Recovery Program until September 30, 2021 in order to continue to assist struggling businesses and prohibit the imposition of fees related to the same; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings set forth in the Preamble to this Resolution are adopted by reference and incorporated herein as if fully set forth in this Section. The COVID-19 Restaurant Recovery Program created by Resolution No. R- 20-0156 adopted on May 14, 2020 and extended by Resolution No. R-20-0231 adopted on July 23, 2020, which provided for an expiration date the program of January 31, 2021, is hereby extended until September 30, 2021 in order to continue to assist struggling businesses affected by the COVID-19 pandemic with all other provisions of such prior Resolutions to remain the same provided that no fees may be imposed in connection with this program. Section 3. In addition to the Miami Parking Authority, the Miami Police Department, the Coconut Grove Business Improvement District, and the Wynwood Business Improvement District, the City Manager is directed to collaborate with the Downtown Development Authority and any other relevant and necessary entities to accomplish the goals set forth by the Resolution creating the COVID-19 Restaurant Recovery Program. Section 4. The City Clerk is directed to transmit a certified copy of this Resolution to the Miami -Dade County ("County") Board of County Commissioners, the County Mayor, the Director of the County's Department of Transportation and Public Works, and the Florida Department of Transportation District Six Secretary. Section 5. This Resolution shall become effective immediately upon its adoption. R-20-0156 ADOPTED ON MAY 14, 2020 AND EXTENDED BY RESOLUTION NO. R-20-0231 ADOPTED ON JULY 23, 2020 A PERMANENT PROGRAM. SPONSOR(S): Commissioner Alex Diaz de la Portilla, Commissioner Ken Russell, Commissioner Joe Carollo, Commissioner Manolo Reyes, Commissioner Jeffrey Watson WHEREAS, on May 14, 2020, the City Commission adopted Resolution No. R-20-0156 authorizing the City Manager to identify feasible portions of City of Miami ("City") rights -of -way that may be repurposed for pedestrian and sidewalk cafe usage ("Outdoor Dining Program") and to take any and all steps necessary to effectuate such repurposing until August 20, 2020 in order to assist businesses negatively affected by the Novel Coronavirus ("COVID-19") pandemic; and WHEREAS, on July 23, 2020, the City Commission adopted Resolution No. R-20-0231, which extended the Outdoor Dining Program to further assist struggling businesses; and WHEREAS, the Outdoor Dining Program has been a successful and popular program that has enhanced the commercial experience for City residents and visitors, as well as help businesses in the City while keeping everyone safe; and WHEREAS, the City Commission desires to make the Outdoor Dining Program a permanent program available to all businesses throughout the City; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings set forth in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The City Manager is directed to take any and all steps necessary to make the Outdoor Dining Program created by Resolution No. R-20-0156 adopted on May 14, 2020 a permanent program offered to all businesses throughout the City. Section 3. This Resolution shall become effective immediately upon its adoption and signature by the Mayor.' 1 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
