Background of Item: On February 11, 2021, pursuant to Resolution No. 21-0065, the City of Miami accepted the amount of $14,130,464.60 from the United States Department of the Treasury ("Treasury") to establish of an Emergency Rental Assistance Program. On May 7, 2021, the President of the United States announced the allocation of the additional $21.6 billion under the American Rescue Plan for Emergency Rental Assistance (ERA 2), that was allocated to the United States Department of the Treasury ("Treasury") for distribution to states and units of local government with more than 200,000 residents. On May 7, 2021, the Treasury published the allocations, with the City being allocated an amount of $11,180,775.30 for regular allocation and an additional $11,598,541.80 as a high -need City for a total amount of $22,779,317.10. On May 22, 2021, the City received an allocation from the Treasury in the amount of $4,472,310.12 for the regular allocation and an amount of $4,639,416.72 as a high -needs allocation. The funds must be used to continue promoting housing stability for eligible households as stipulated in the guidance from the Treasury, as described in Exhibit "A". ERA 2 funds must be committed by September 30, 2025. The City's Administration recommends the acceptance of the Emergency Rental Assistance 2 ("ERA 2") funds in an amount of $22,779,317.10 from United States Department of the Treasury and authorizing the allocation of such funds as described in Exhibit "A", attached and incorporated, to prevent evictions and ensure basic housing security to those impacted by the COVID-19 pandemic. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The ERA 2 Funds from the Treasury are accepted. Section 3. The City Manager is authorized to negotiate and execute any and all necessary documents, all in forms acceptable to the City Attorney, for said purpose, subject to all federal, state, and local laws that regulate the use of such funds. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: ndez, ity Attor ey 7/13/2021 1 The herein authorization is further subject to compliance with all legal requirements that may be imposed, including but not limited to, those prescribed by applicable City Charter and City Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
