HomeMy WebLinkAboutR-21-0309City of Miami Resolution R-21-0309 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 9349 Final Action Date: 7/22/2021 A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING AN INCREASE IN CAPACITY BEYOND THE CURRENT ALLOWABLE AWARD AMOUNT OF THREE HUNDRED THOUSAND DOLLARS ($300,000.00) PER REQUEST FOR QUALIFICATIONS ("RFQ") NO. 184144 FOR GENERAL BUILDING/ENGINEERING & SPECIALTY TRADE CONTRACTOR SERVICES, FOR INVITATION FOR QUOTATIONS NO. 805382, ISSUED ON JANUARY 10, 2018 BY THE CITY OF MIAMI'S ("CITY") DEPARTMENT OF PROCUREMENT ON BEHALF OF THE CITY'S FIRE -RESCUE DEPARTMENT PURSUANT TO THE RFQ, THEREBY INCREASING THE SUCCESSFUL LOWEST QUOTE SUBMITTED BY EDFM CORPORATION, A FLORIDA PROFIT CORPORATION, FOR THE AMOUNT OF TWO HUNDRED SIXTY ONE THOUSAND SEVEN HUNDRED EIGHT DOLLARS ($261,708.00) BY THE ADDITIONAL AMOUNT OF TWO HUNDRED SIX THOUSAND TWO HUNDRED NINETEEN DOLLARS AND FOUR CENTS ($206,219.04) BASED ON THE SCOPE OF WORK MODIFICATIONS REQUIRED FOR FINALIZING THE INSTALLATION OF TWO (2) GENERATORS AT THE FIRE -RESCUE TRAINING CENTER; ALLOCATING FUNDS FROM THE VARIOUS SOURCES OF FUNDS FROM THE USER DEPARTMENT, SUBJECT TO THE AVAILABILITY OF FUNDS AND BUDGETARY APPROVAL AT THE TIME OF NEED; AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL DOCUMENTS, INCLUDING ANY AMENDMENTS, RENEWALS, AND EXTENSIONS, SUBJECT TO ALL ALLOCATIONS, APPROPRIATIONS, PRIOR BUDGETARY APPROVALS, COMPLIANCE WITH ALL APPLICABLE PROVISIONS OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED ("CITY CODE"), INCLUDING THE CITY'S PROCUREMENT ORDINANCE, ANTI -DEFICIENCY ACT, AND FINANCIAL INTEGRITY PRINCIPLES, ALL AS SET FORTH IN CHAPTER 18 OF THE CITY CODE, IN FORMS ACCEPTABLE TO THE CITY ATTORNEY, AND IN COMPLIANCE WITH ALL APPLICABLE LAWS, RULES, AND REGULATIONS, AS MAY BE DEEMED NECESSARY FOR SAID PURPOSE. WHEREAS, the Fire Rescue Training Center ("FTC") for the City of Miami's ("City") Fire - Rescue Department ("Fire -Rescue") required the installation of two (2) generators; and WHEREAS, on January 10, 2018, the City's Department of Procurement ("Procurement") on behalf of Fire -Rescue issued Invitation for Quotations ("IFQ") No. 805382 pursuant to Request for Qualifications ("RFQ") No. 184144 for General Building/Engineering & Specialty Trade Contractor Services in order to find competitive pricing as well as the best solution possible for the installation of the two (2) generators at the FTC; and City of Miami Page 1 of 2 File ID: 9349 (Revision:) Printed On: 5/29/2025 File ID: 9349 Enactment Number: R-21-0309 WHEREAS, EDFM Corporation, a Florida profit corporation ("EDFM"), submitted the lowest quote in response to the IFQ for the amount of Two Hundred Sixty One Thousand Seven Hundred Eight Dollars ($261,708.00); and WHEREAS, a City electrical inspection found that the scope of work did not meet the current building and fire code requirements and, therefore, required modifications; and WHEREAS, due to the scope of work modifications, the original quote was increased by an additional amount of Two Hundred Six Thousand Two Hundred Nineteen Dollars and Four Cents ($206,219.04), which caused the total IFQ quote amount to exceed the allowable award amount of Three Hundred Thousand Dollars ($300,000.00) pursuant to the RFQ; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. An increase in capacity beyond the current allowable award amount of Three Hundred Thousand Dollars ($300,000.00) pursuant to RFQ No. 184144 for General Building/Engineering & Specialty Trade Contractor Services for IFQ No. 805382 issued on January 10, 2018 by Procurement on behalf of Fire -Rescue pursuant to the RFQ, thereby increasing the successful lowest quote submitted by EDFM for the amount of Two Hundred Sixty One Thousand Seven Hundred Eight Dollars ($261,708.00) by the additional amount of Two Hundred Six Thousand Two Hundred Nineteen Dollars and Four Cents ($206,219.04) based on the scope of work modifications required for finalizing the installation of the two (2) generators at the FTC is authorized. Section 3. Funding is allocated from the various sources of funds from the user department, subject to the availability of funds and budgetary approval at the time of need. Section 4. The City Manager is authorized' to negotiate and execute any and all necessary documents, including any amendments, renewals, and extensions, subject to all allocations, appropriations, prior budgetary approvals, compliance with all applicable provisions of the Code of the City of Miami, Florida, as amended ("City Code"), including the City's Procurement Ordinance, Anti -Deficiency Act, and Financial Integrity Principles, all as set forth in Chapter 18 of the City Code, in forms acceptable to the City Attorney, and in compliance with applicable laws, rules, and regulations, as may be deemed necessary for said purpose. Section 5. This Resolution shall become effective immediately upon its adoption.
