Subject: Authorize Increase - Fire Rescue Training Center
Purpose of Item:
The nature of this item is to authorize a resolution of the Miami City Commission,
authorizing an increase in capacity beyond Request for Qualifications ("RFQ")
No.184144, General Bldg./Eng. & Specialty Trade Contractor ("Trades") for which has
an allowable award amount of $300,000.00. On January 10, 2018, Invitation for
Quotation ("IFQ") No. 805382 pursuant to RFQ 184144, was issued by Procurement, on
behalf of Fire Rescue Department, the quote submitted by EDFM was for a total amount
of $261,708.00, which was based on the scope of work, that included furnishing
generators, switches, panels, construction, and installation. Due to unforeseen changes
to the Scope of Work an additional $206,219.04 is required in order to finalize the
installation of two (2) generators at the Fire Rescue Training Center ("FTC"); allocating
funds from the various sources of funds from the user department, subject to availability
of funds and budgetary approval at the time of need; authorizing the City Manager to
negotiate and execute all other documents, including any amendments, renewals, and
extensions, subject to all allocations, appropriations, and prior budgetary approvals, and
in compliance with all applicable provisions of the Code of the City of Miami, Florida, as
amended ("City Code"), including the City of Miami's Procurement Ordinance, Anti -
Deficiency Act, and financial integrity principles, all as set forth in Chapter 18 of the City
Code, all in a form acceptable to the City Attorney, and in compliance with all applicable
laws, rules, and regulations, as may be deemed necessary for said purpose.
Background of Item:
The City of Miami's ("City") Fire -Rescue Department ("Fire") is requesting approval for
the additional repair of two (2) generators at the FTC. Initially on January 10, 2018 an
Invitation for Quotation ("IFQ") No. 805382 pursuant to RFQ 184144, was issued by
Procurement, on behalf of Fire, the bid submitted by EDFM was for a total amount of
$261,708.00, which was based on the scope of work, that included furnishing
generators, switches, panels, construction and installation. However, at the pre -
commencement meeting, the City's electrical inspector found that the work in the scope
of work required additional tweaking in order to meet the current building and fire code
requirements. Upon further investigation, it was determined that the existing conduits
were deteriorated and could not be re -used, and new conduits could not be buried
because the site is contaminated, therefore, new electrical bridges would need to be
constructed, which required new foundations, columns, and the bridge themselves. This
caused for the original quote to increase to an additional amount of $206,219.04, which
exceeded the allowable award amount on the Trades contract. In order to complete the
project and continue services at the Fire Rescue Training Center a change order to
increase Purchase Order No. 180499 is required for a new total amount of $467,927.04.

A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING AN INCREASE
IN CAPACITY BEYOND THE CURRENT ALLOWABLE AWARD AMOUNT OF THREE
HUNDRED THOUSAND DOLLARS ($300,000.00) PER REQUEST FOR
QUALIFICATIONS ("RFQ") NO. 184144 FOR GENERAL BUILDING/ENGINEERING &
SPECIALTY TRADE CONTRACTOR SERVICES, FOR INVITATION FOR
QUOTATIONS NO. 805382, ISSUED ON JANUARY 10, 2018 BY THE CITY OF
MIAMI'S ("CITY") DEPARTMENT OF PROCUREMENT ON BEHALF OF THE CITY'S
FIRE -RESCUE DEPARTMENT PURSUANT TO THE RFQ, THEREBY INCREASING
THE SUCCESSFUL LOWEST QUOTE SUBMITTED BY EDFM CORPORATION, A
FLORIDA PROFIT CORPORATION, FOR THE AMOUNT OF TWO HUNDRED SIXTY
ONE THOUSAND SEVEN HUNDRED EIGHT DOLLARS ($261,708.00) BY THE
ADDITIONAL AMOUNT OF TWO HUNDRED SIX THOUSAND TWO HUNDRED
NINETEEN DOLLARS AND FOUR CENTS ($206,219.04) BASED ON THE SCOPE OF
WORK MODIFICATIONS REQUIRED FOR FINALIZING THE INSTALLATION OF
TWO (2) GENERATORS AT THE FIRE -RESCUE TRAINING CENTER; ALLOCATING
FUNDS FROM THE VARIOUS SOURCES OF FUNDS FROM THE USER
DEPARTMENT, SUBJECT TO THE AVAILABILITY OF FUNDS AND BUDGETARY
APPROVAL AT THE TIME OF NEED; AUTHORIZING THE CITY MANAGER TO
NEGOTIATE AND EXECUTE ANY AND ALL DOCUMENTS, INCLUDING ANY
AMENDMENTS, RENEWALS, AND EXTENSIONS, SUBJECT TO ALL
ALLOCATIONS, APPROPRIATIONS, PRIOR BUDGETARY APPROVALS,
COMPLIANCE WITH ALL APPLICABLE PROVISIONS OF THE CODE OF THE CITY
OF MIAMI, FLORIDA, AS AMENDED ("CITY CODE"), INCLUDING THE CITY'S
PROCUREMENT ORDINANCE, ANTI -DEFICIENCY ACT, AND FINANCIAL
INTEGRITY PRINCIPLES, ALL AS SET FORTH IN CHAPTER 18 OF THE CITY
CODE, IN FORMS ACCEPTABLE TO THE CITY ATTORNEY, AND IN COMPLIANCE
WITH ALL APPLICABLE LAWS, RULES, AND REGULATIONS, AS MAY BE DEEMED
NECESSARY FOR SAID PURPOSE.
WHEREAS, the Fire Rescue Training Center ("FTC") for the City of Miami's ("City") Fire -
Rescue Department ("Fire -Rescue") required the installation of two (2) generators; and
WHEREAS, on January 10, 2018, the City's Department of Procurement
("Procurement") on behalf of Fire -Rescue issued Invitation for Quotations ("IFQ") No. 805382
pursuant to Request for Qualifications ("RFQ") No. 184144 for General Building/Engineering &
Specialty Trade Contractor Services in order to find competitive pricing as well as the best
solution possible for the installation of the two (2) generators at the FTC; and
WHEREAS, EDFM Corporation, a Florida profit corporation ("EDFM"), submitted the
lowest quote in response to the IFQ for the amount of Two Hundred Sixty One Thousand Seven
Hundred Eight Dollars ($261,708.00); and
WHEREAS, a City electrical inspection found that the scope of work did not meet the
current building and fire code requirements and, therefore, required modifications; and
WHEREAS, due to the scope of work modifications, the original quote was increased by
an additional amount of Two Hundred Six Thousand Two Hundred Nineteen Dollars and Four
Cents ($206,219.04), which caused the total IFQ quote amount to exceed the allowable award
amount of Three Hundred Thousand Dollars ($300,000.00) pursuant to the RFQ;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. An increase in capacity beyond the current allowable award amount of Three
Hundred Thousand Dollars ($300,000.00) pursuant to RFQ No. 184144 for General
Building/Engineering & Specialty Trade Contractor Services for IFQ No. 805382 issued on
January 10, 2018 by Procurement on behalf of Fire -Rescue pursuant to the RFQ, thereby
increasing the successful lowest quote submitted by EDFM for the amount of Two Hundred
Sixty One Thousand Seven Hundred Eight Dollars ($261,708.00) by the additional amount of
Two Hundred Six Thousand Two Hundred Nineteen Dollars and Four Cents ($206,219.04)
based on the scope of work modifications required for finalizing the installation of the two (2)
generators at the FTC is authorized.
Section 3. Funding is allocated from the various sources of funds from the user
department, subject to the availability of funds and budgetary approval at the time of need.
Section 4. The City Manager is authorized' to negotiate and execute any and all
necessary documents, including any amendments, renewals, and extensions, subject to all
allocations, appropriations, prior budgetary approvals, compliance with all applicable provisions
of the Code of the City of Miami, Florida, as amended ("City Code"), including the City's
Procurement Ordinance, Anti -Deficiency Act, and Financial Integrity Principles, all as set forth in
Chapter 18 of the City Code, in forms acceptable to the City Attorney, and in compliance with
applicable laws, rules, and regulations, as may be deemed necessary for said purpose.
Section 5. This Resolution shall become effective immediately upon its adoption.
