A RESOLUTION OF THE ART IN PUBLIC PLACES BOARD PURSUANT TO
CHAPTER 62, ARTICLE XVI ENTITLED "ART IN PUBLIC PLACES" OF THE CODE
OF THE CITY OF MIAMI, FLORIDA, AS AMENDED ("CITY CODE"), APPROVING A
TEMPORARY PUBLIC ART INSTALLATION BY ARTIST WILL KURTZ TITLED
"DOGGY BAGS" IN PARTNERSHIP WITH AVANT GALLERY AT VARIOUS PUBLIC
LOCATIONS THROUGHOUT BRICKELL AND DOWNTOWN; MAKING FINDINGS;
CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, on January 12th, 2017, pursuant to Ordinance No. 13656 and 13657
the Miami City Commission enacted Phase I of the Art in Public Places Program;
established the Art in Public Places Program, the Public Art Fund, and the Art in Public
Places Board (AIPPB), with its functions, duties, and powers; and
WHEREAS, Pursuant to Section 62-655(c)(4), the AIPPB, with the assistance
and recommendation of the Planning Department, Public Art Division, and all other City
Departments, as necessary, shall have the function, duties, and powers "To approve,
approve with conditions, or deny proposed installations, dedications, or donations of
art"; and
WHEREAS, Will Kurtz the ("Artist") in partnership with Avant Gallery
the ("Applicant") are seeking to install a temporary public art installation for a period
not to exceed six months at various public locations throughout Brickell and Downtown
and
WHEREAS, the staff finds the proposed temporary public art installation entitled
"Doggy Bags" to be in accordance with the intent and criteria of Section 62-658 entitled
"Selections of works of art"; and
WHEREAS, staff is recommending that the AIPPB move to approve with
conditions the temporary public art installation as proposed; and
NOW, THEREFORE, BE IT RESOLVED BY THE ART IN PUBLIC PLACES
BOARD OF THE CITY OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution
are adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The Planning Department's Public Art Division recommends approval
of the temporary public art installation by American artist Will Kurtz titled "Doggy Bags"
with the following conditions:
1. The final placement and location of the art works shall be reviewed and approved
by the Public Art Division in association with applicable city departments.
2. The Applicants shall obtain all necessary approvals from the appropriate
departments, divisions and agencies prior to installation.
3. The temporary public art installation shall be for a period not to exceed six
months.
4. The Applicants shall immediately remove the temporary public art installation
upon the issuance of hurricane warning and or severe weather alert.
Section 3. This Resolution shall be effective immediately upon its adoption.
