THEREFORE EXEMPTING THE BALLOTING PROCESS, IN ORDER TO
EXPEDITIOUSLY PROCEED WITH THE DESIGN AND CONSTRUCTION OF TWO
RAISED INTERSECTIONS AS WEL AS A GENERIC DEVICE THAT WILL SERVE AS
TRAFFIC CALMING DEVICES AT THE INTERSECTION OF SOUTHWEST 32ND AVE
AND SOUTHWEST 5TH STREET AS PART OF THE OFFICE OF CAPITAL
IMPROVEMENTS PROJECT NO. 40-B50505.
Background of Item:
As directed in City of Miami Resolution R-19-0425, the Commission authorized and
directed the City Manager to design and construct traffic calming devices at the
intersection of SW 32nd Avenue and SW 5th Street, Office of Capital Improvements
Project 40-B50505, with the goal of completing said project by May 2020. This is an
effort to resolve significant cut -through traffic and speeding during rush hour periods,
which diminishes the residents' quality of life. After conducting three rounds of balloting,
the City did not receive a sufficient response from the residents for a concurrence,
therefore delaying the mandated completion by May 2020.

A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENTS, AFTER
A PUBLIC HEARING, DIRECTING THE CITY MANAGER TO TAKE ANY AND ALL
ACTIONS NECESSARY TO EXPEDITIOUSLY REQUEST THAT THE MIAMI-DADE
COUNTY TRANSPORTATION & PUBLIC WORKS DEPARTMENT ("DTPW')
CONSIDER PROPOSED TRAFFIC FLOW MODIFICATIONS REGARDING THE CITY
OF MIAMI'S OFFICE OF CAPITAL IMPROVEMENTS PROJECT NO. 40-B50505 AND
WAIVE THE REQUIRED RESIDENT CONCURRENCE AND EXEMPT THE
BALLOTING PROCESS IN ORDER TO EXPEDITIOUSLY PROCEED WITH THE
DESIGN AND CONSTRUCTION OF TWO (2) RAISED INTERSECTIONS AND A
GENERIC DEVICE THAT WILL SERVE AS TRAFFIC CALMING DEVICES AT THE
INTERSECTION OF SOUTHWEST 32ND AVENUE AND SOUTHWEST 5TH STREET;
DIRECTING THE CITY CLERK TO SEND A CERTIFIED COPY OF THIS
RESOLUTION TO THE DTPW DIRECTOR.
WHEREAS, the intersection of Southwest 32nd Avenue and Southwest 5th Street is in a
City of Miami ("City") residential neighborhood that experiences significant cut -through traffic
and speeding during rush hour periods; and
WHEREAS, such cut -through traffic and speeding on a local residential street not
designed for such volume, diminishes residents' quality of life; and
WHEREAS, in addition to quality -of -life problems such as noise and general congestion,
such cut -through traffic and speeding creates significant life -safety risks as this residential street
is narrower than nearby arterial roadways, increasing the risk of vehicular accidents, including
those involving pedestrians; and
WHEREAS, rush hour cut -through traffic tends to disobey posted speed limits and
signage in order to gain an advantage over using arterial roadways meant for such traffic; and
WHEREAS, in order to address these quality -of -life issues, the City took all necessary
and required actions to approve the "Traffic Calming Device at Intersection of Southwest 32
Avenue and Southwest 5 Street Project," Office of Capital Improvements ("OCI") Project No. B-
50505 ("5th Street Project"), the scope of which consists of installing a raised intersection along
with milling and resurfacing, miscellaneous drainage, replacement of damaged sidewalks,
replacement of damaged curbs and gutters, ADA ramps, landscaping, and pavement marking
and signage; and
WHEREAS, the City Commission believes it is in the best interest of the residents to
install raised intersections at the intersection of Southwest 32nd Avenue and Southwest 5th
Street as expeditiously as possible and the City Commission previously adopted Resolution No.
R-19-0425, attached and incorporated as Exhibit "A", on October 24, 2019, which authorized
and directed the City Manager to design and construct the 5th Street Project with the goal of
completing said project by May 2020; and
WHEREAS, Section 1.6 of the Miami -Dade County Traffic Flow Modification(s)/Street
Closure(s) Procedure ("County Procedure") as revised by the Miami -Dade County Public Works
Department ("PWD") Traffic Engineering Division in January 2009, attached and incorporated as
Exhibit "B", states that the construction of traffic circles "[r]equires 100% concurrence of affected
residents and/or property owners from four (4) corners adjacent to the proposed circles"; and
WHEREAS, the skewed geometry of the intersection at Southwest 32nd Avenue and
Southwest 5th Street requires more than the standard four (4) residents to be balloted; and
WHEREAS, after conducting three (3) rounds of balloting, the City did not receive a
sufficient response from the affected residents for a concurrence; and
WHEREAS, Section 1.6 of the County Procedure, attached and incorporated as Exhibit
"B", also states that "[i]n lieu of concurrence from the affected residents and/or property owners,
a municipality may pass a resolution after a public hearing requesting PWD to consider the
proposed traffic flow modification(s)/street closure(s)"; and
WHEREAS, it is in the best interest of the City's residents to waive the required resident
concurrence and request that PWD consider the proposed traffic flow modifications regarding
the 5th Street Project;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Commission, after a public hearing, authorizes' and directs the City
Manager to take any and all actions necessary to expeditiously request that PWD consider the
proposed traffic flow modifications regarding the 5th Street Project.
Section3. The City Clerk is directed to send a certified copy of this Resolution to
Director of Miami -Dade County's Department of Transportation & Public Works.
Section 4. This Resolution shall become effective immediately upon its adoption.
