Subject: Execute - LAP Supplemental Agreement - Overtown Greenway Project
Purpose of Item:
A resolution of the City of Miami (City) Commission to authorize the City Manager to
execute a LAP supplemental agreement to the Original LAP Agreement originally
executed on September 23, 2013, per Resolution R-10-0337, that authorized the City
manager to accept Federal Government Funds, through the FDOT as the pass through
agency for $1,079,879 for the Overtown Greenway Project 40-B30624, between NW
3rd Avenue and NW 7th Avenue, further authorizing the City manager to negotiate any
other necessary document or amendment to the LAP supplemental agreement in a form
acceptable to the City Attorney.
Background of Item:
This Agreement provides for FDOT's participation in the Overtown Greenway Project
between NW 3rd Ave and NW 7th Ave. (the Project), as further described in Exhibit "A",
Project Description and Responsibilities attached to and incorporated in the
Supplemental Agreement, to provide:
a) FDOT financial assistance to the City;
b) state the terms and conditions upon which FDOT funds will be provided;
c) and to set forth the manner in which the Project will be undertaken and completed
"Attachment A" of this LAP Agreement modifies language, and "Adjusted Exhibit B"
replaces "Schedule of Funding Exhibit B" in the LAP Agreement executed on
September 23, 2013 to include the correct financial and audit terms and conditions
required by the Florida Department of Financial Services and Florida Statutes. Exhibits
D,H,I,J,K,L,M,N, and 0 referenced in "Attachment A" are not part of this agreement.
This supplemental agreement will not impact funding or any project specific information.

A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO EXECUTE A LOCAL AGENCY PROGRAM
("LAP") SUPPLEMENTAL AGREEMENT, IN SUBSTANTIALLY THE ATTACHED
FORM, TO THE ORIGINAL LAP AGREEMENT EXECUTED PURSUANT TO
RESOLUTION NO. R-10-0337 ADOPTED ON JULY 29, 2010 THAT AUTHORIZED
THE CITY MANAGER TO ACCEPT FEDERAL GOVERNMENT FUNDS FROM THE
FLORIDA DEPARTMENT OF TRANSPORTATION AS THE PASS -THROUGH
AGENCY IN AN AMOUNT OF ONE MILLION SEVENTY-NINE THOUSAND EIGHT
HUNDRED SEVENTY-NINE DOLLARS ($1,079,879.00) FOR THE OVERTOWN
GREENWAY PROJECT, OFFICE OF CAPITAL IMPROVEMENTS PROJECT NO. 40-
B30624, BETWEEN NORTHWEST 3RD AVENUE AND NORTHWEST 7TH AVENUE.
WHEREAS, the City of Miami ("City") applied for and was awarded federal grants for
four (4) Miami River Greenway Projects ("Greenway Projects"); and
WHEREAS, the Florida Department of Transportation ("FDOT") will serve as the pass -
through agency for the federal funds and Local Agency Program ("LAP") Agreements will be
required in various amounts in order to access funding of the grant awards; and
WHEREAS, the Greenway Projects will provide outdoor recreational opportunities and
an alternative transportation corridor for people living and working along the Miami River to
easily and safely walk or bike to mass transit connectors; and
WHEREAS, the grants are consistent with the Miami River Greenways Action Plan,
adopted in principle by the City pursuant to Resolution No. R-01-440 on May 10, 2001 and
follow the Miami River Greenway design guidelines; and
WHEREAS, grant award funding under the original LAP Agreement was One Million
Seventy -Nine Thousand Eight Hundred Seventy -Nine Dollars ($1,079,879.00) for the Overtown
Greenway at Northwest 11th Terrace Project, Office of Capital Improvements ("OCI") Project
No. 40-B-30624; and
WHEREAS, said amounts are currently included in the FDOT Five (5) Year Work
Program; and
WHEREAS, the City Manager was previously authorized to accept said grant awards
and to execute the necessary LAP Agreements in order to implement the acceptance of the
grant award funding; and
WHEREAS, the LAP Supplemental Agreement, attached and incorporated as part of
Exhibit "A", provides FDOT financial assistance to the City, states the terms and conditions
upon which FDOT funds will be provided, and sets forth the manner in which the Project will be
undertaken and completed; and
WHEREAS, the LAP Supplemental Agreement extends the contract end date to July 6,
2022 and includes additional amendments as outlined in Exhibit "A", attached and incorporated;
and
WHEREAS, funds are to be appropriated by separate Resolution;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings found in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized' to execute a LAP Supplemental Agreement,
in substantially the attached form, to the original LAP Agreement executed pursuant to
Resolution No. R-10-0337 adopted on July 29, 2010 regarding the Overtown Greenway Project,
OCI Project No. 40-B30624, between Northwest 3rd Avenue and Northwest 7th Avenue.
Section 3. This Resolution shall become effective immediately upon its adoption.
APPROVED AS TO FORM AND CORRECTNESS:
1 The herein authorization is further subject to compliance with all legal requirements that may be
imposed, including but not limited to those prescribed by applicable City Charter and City Code
provisions.
